I gotta say the VA examiner and rater were correct on this one. MH issues do not physically cause your airway to narrow. The only OSA claims that I've heard of related to MH issues that were approved were the ones who used weight gain as a bridge between the two, i.e. the veteran's MH issues caused him/her to gain weight which, in turn, caused the narrowing of the airway resulting in OSA. I'm curious what justification this veteran's outside doc used in the DBQ/nexus letter he provided.

There’s plenty of studies that say ptsd cause or make OSA worse especially when you are on sleeping meds that cause your muscles to to relax

@@jeffborgeson9948 That could be yet the veteran chose to just say his PTSD caused his OSA without mentioning anything about any medications he was taking causing his OSA.

I had a Guy who won his OSA claim at a Zero Precent and he's prescribed a CPAP we just refilled with more medical evidence because he should be rated at 50

I spoke to the head doc at the sleep clinic and she pretended to listen to my ptsd related sleep problems vs sleep apnea. She kept trying to get me to get minor surgery for cpap but I explained everything why it wasn’t sleep apnea but still forcing me into more sleep apnea exams rather than prescribe the new sleep med. I loathe that clinic. I would assume there’s some va connection with cpap devices but that’s my opinion.

I had the same situation. Was denied, I had an IMO that stated it was directly caused by chronic rhinitis and aggravated by PTSD. Also had obesity in my evidence. I've had this same reviewer twice and she is very anti veteran which you can plainly tell by her conclusions. In any event it's sitting in a HRL. Fingers crossed, if i can get this one I'll be 100%. Not sure if one of my recent SC hits is static.

I’m currently rated a 90. I took a sleep apnea test the my va provider gave me. I have mild sleep apnea. When I got my claim decision back they increased me from 80 to a 90. I have weight gain from mental health and cervical ddd. Is it wise to go private from another sleep study or do you think I’ll be fine with the va? Va diagnosed me with mild sleep apnea

Just had a C&P exam (for other things). Very good interaction BTW. Got into conversation about OSA and being secondary to my MULTIPLE RESPIRATORY ISSUES. Mine,to her, is baffling (long story, I’m not overweight and my throat doesn’t fit profile). She wouldn’t rule out sinus but included, for me, inflammatory stuff going on in my body because of musculoskeletal issues. (Neck,back etc). But she did say 90% of cases ARE DEFINITELY related to weight gain. In her experience. She is a full fledged DO btw, not just a practitioner. Just my input, that’s all, If anyone is curious.

@@heavychevy2289 no, medical always said to get more exercise. I had multiple complaints of daytime sleepiness in service and documented in STR’s. I have ITF in now and will see where I land on this last round of claims.

Dude, here in my neck of the woods. The VA facilities are ranked in the Top 5 worst hospitals in the Nation. With that said, it seems like I have nothing wrong with me. I'm 100% healthy (50% rating). I did file before the deadline for sleep apnea & hearing loss. But with all my tests coming up with no injuries, I am worried. Looks like I may have to pay out of pocket for a medical Nexus paper. Any feedback is much appreciated. Thanks

Yo Craig is there a way to restore intent to file dates? I think my intent to file date was lost while the VA website was glitching and now I have s totally different date, I still have the original letter from when I opened mu intent to file date. Can I submit this to the VA to have this fixed in your opinion?

Is it true that you no longer get a percentage if you file a claim for Sleep apnea?...i heard that a law was passed and pretty much if we file a claim for sleep apnea and we require a CPAP, we get rated at Zero percent?...thank you!!

Project 2025 proposals. Although Project 2025 aims also to proposes changes to the VA's Schedule for Rating Disabilities, which is the guide the Department uses to assign applicants' disability rates, not eliminate pensions that are currently allocated. However, some beneficiaries could see their pension amount reduced due to revisions in disability rates. It will also revise the PACT Act of 2022 and the Agent Orange Act of 1991 to limit the number of health conditions that qualify an applicant for a VA pension. If implemented, Project 2025 will open the doors for more private companies to provide health care to veterans receiving benefits. Only time will tell how it will ultimately affect VA health programs and end beneficiaries. Does anyone else know how this plan will affect us disabled veterans moving forward?
