Insurance company refuses to pay 82-year-old Las Vegas woman's claim after her home burned down

A national insurance company refuses to pay the insurance claim of an 82-year-old woman whose home in Las Vegas caught fire and burned to the ground in July 2023, destroying 70% of it and the majority of her possessions inside, the 8 News Now Investigators have learned.

I'm a retired electrician. That fire started in one of those electrical panels. If it started from a cigarette, the fire damage would start at the ground, not 3 feet in the air.

Yep, looks that way even from a layperson's perspective. As another mentioned, would be a covered loss regardless. There's much more to this than where the fire started. The overarching issue is they believe it's insurance fraud. Raising objections every way they can to challenge her credibility. Hopefully the public adjuster is in it for the long-haul, since this could drag out for years.

The insurance companies invest the money and make profits on the principal. The problems come when the insurance company takes your money but refuses to pay the claim for bogus reasons like a cigarette butt 12 feet from the origin of the fire. I’ll bet she doesn’t even smoke. Adjusters are paid to find reasons to deny claims.

I've been a licensed claims adjuster for decades. This is a sickening story! Whenever I have a house fire, I send a fire investigator to determine the cause of loss not the company field adjuster! Just looking at that electrical box is proof the origin of the fire happened in that box. If I discovered during the claim there was a concern of a business being run from the home, I'd verify that information through my before denying the claim. Liberty Mural does wasn't to PAY WHAT THEY OWE. They are a company I would never work for, and I've refused catastrophe adjuster jobs with them before.

Extra people on the property or in the home 2. Business equipment 3. Storage of business supplies 4. Storage of completed products 5. Compensated workers Because of Etsy and other similar sites, many insurance companies will allow for "some" home usage as part of a "hobby" business. The same goes for "work from home" situations where the policyholder has business equipment and possibly business supplies in the home. Of course, if the policyholder is employed by someone else, the items used in the course of business are covered by the employer's policy, etc. The "problem" with an undeclared home-based business is the increased risk of damage to the home. For example, let's say you are selling handcrafted soap on Etsy. To make the soap, you keep a five-gallon bucket of lye in your garage. The lye gets wet from moisture in the garage, then creates it's own heat that sets the shipping boxes in the garage on fire. If you weren't engaging in a "home business" of making soap, the opportunity of the garage burning down due to the improper storage of a chemical wouldn't have happened. The insurance company always wants to charge the appropriate premiums for the risk they are insuring. Since the entire concept of insurance is that the "losses of the few are paid for by the many," the only method for "fairly" charging policyholders premium is to have customers who do more than use their home as a "living space" to pay more in premiums, or deny their claims when an investigation reveals how the home is being used for a business. If the insurance company can prove the policyholder was running a business from the home, and that business was a cause of loss, the claim should be denied for "misrepresentation" of material facts or whatever wording the state allows when the policyholder fails to notify the insurance company of a "business" in the home. In this video's situation, there's no evidence that the fire was caused by the son fixing motorcycles in the garage. That information is a reason to "non-renew" her policy next term, or charge her more premium for the home business; that's not a reason to deny a claim. The best thing a consumer can do is be upfront and truthful about how they use their car, home, etc. when buying insurance. No one wants to ever be in the middle of a claim and find out "things" aren't covered by their insurance policy. Liberty Mutual isn't the only company out there who encourage their claims adjusters to "find" contractual reasons why the company doesn't "owe" part or all of a claim.

@@rebeccadee4107 Different fire codes, and if you run a business out of your home you need to have a business license & usually an LLC that way the business space can be claimed on taxes, so if there is a business being run out of the home it does change things legally, but that motorcycle thing with her disabled grandson(?) is NOT AT ALL what caused this particular fire, and I agree with @devilonlyknitslace on this all the way. Usually you get in trouble for businesses being run out of residential homes because space is expensive, you can claim the space on taxes, you can claim a whole host of other business items under certain tax laws... basically it's definitely more as a deterrent from running your business at home.

I dropped them like a bad habit because that’s what my insurance policy specifically stipulated and I wanted to make sure that it was written in the language of the Contract for service assuming that somebody without insurance were to hit my car I could get a new one come to find out that they had the same policy as State Farm that they would pay the bank first and I said oh no you’re not if I’m paying for full coverage I intend to get a new car out of it and they basically said no and I said You will do what I’ve told you with this contract stipulates and if you try to deny me, I’m gonna come after you and they refused. I dropped him like a bad habit the next month and then they sent me a bill on top of it which I never paid because I’m not gonna pay an insurance company to treat me like crapfor no reason just because they want to pay the bank first and I said no you get another car. We get the new car model and I get that one insured as well specifically if somebody were to hit me and they said no so I went away, and I never paid them.

The article mentions she had solar panels and The panel did not look like a federal Pacific or a zinsco based on the breakers, do you know what method these solar installer used to connect their wires to that panel? Did they put them on a breaker or did they do those piercing tap connectors that have a spike in them and you put them over the main feeds and tighten them down and the spike pierces into the wire making the connection? I'm an electrician and I have never liked any form of piercing connection or connection that relies on spring pressure to hold it down I always prefer a good mechanical connection like a wire nut vs those push-in connectors or wago lever nuts or a breaker with a screw and putting it around the screw on outlets versus the backstabs o

We had Liberty Mutual in insurance for 10 years. When we had 24 inches of snow in one storm, our gutters were decimated. Liberty Mutual skirted around and paid us $900 for a claim the should have been 3600. We were paying around $3600 in premiums that year. A couple years later, our premium was increased to $4,800 per year, To make the premiums more affordable we went to a 10% deductible which they said was $100,000. Official market value of our home was $225, 000 at that time. I’m not surprised this poor woman is cheated by them. Oh, we have switched companies.

State Farm is not good either. 7.2 earthquake here in Alaska nov. 2018. My house was broken in half, literally. Adjustor approved a house lift to bring my house back to livable. I contacted the appropriate company within days of incident and they were already bombarded with work. They were the one and only company in Alaska to lift my house, booked out 27 months because of urgent bookings from earthquake. State Farm refused to pay my housing in another place, (middle of winter, I coudnt live in a cracked house, let alone heat it) Then because their policy of 'one year' from 'date of incident', they would not pay. Im still, to this day dealing with expense and repairs to my property. Since then, they have dropped me.

Her son would inherit the claim in progress. The same thing happened to my dad when his dad's house was destroyed in a fire, they spent 3 years in court before he had a heart attack. My dad spent an additional 2 years in court and won the full value of the property, plus 50%, plus an additional $50,000, plus all lawyer fees paid.

Allstate isn't different. I had a bad experience with Allstate they denied my claim on my rental property during the pandemic. I had them for over 20 yrs cancelled after that cannot trust them,my house was vandalized and destroyed after eviction and they only said I had bad tenants

I should have taken this to the local county DA to hold them accountable. The best option, is to file a complaint and then go after the insurance company, as others have done in Riverside County, Ca.

My house is paid off. I have come to not trust homeowners insurance companies to honor any claims after paying premiums for over 45 years. At this point I have decided that the risks are extremely low, but the loss could be extremely high. I am tired of being taken advantage of by most businesses of all kinds. Same thing happened to my mom. Her house burnt down, adjuster came out and called it totaled. Then they didn't want to pay. She didn't even get half of what she was supposed to get. Never got her house rebuilt. Ended up losing it. She didn't have solar. It wasn't Liberty, it was a different company. Insurance companies are a scam. Got to have it, but they don't want to pay out.

Amazing... Usually, insurance companies want to settle out liability claims by third parties. Of course, you put the claim into your own company, they subrogate.... unless the dollars of damage are too low.... then you often can negotiate with the other companies adjuster... I have had TWO parking lot incidents where my commercial vehicle got hit by others' personal cars. One covered by Geico, the other by Allstate.... and even THEY were VERY generous on the payout. Without any haggling.

A year or so ago I watched a video about a neighborhood in Southern California experiencing flooding and the evacuation of residents from their homes. I think the insurance company was Allstate or Farmers. A couple was interviewed talking to media about how everyone in that neighborhood with structural damage had to use one contractor and because there were so many homes that needed services there was a very long wait list. The couple did not get property insurance when they bought their home, instead they took the cost of the insurance payments and saved it. Almost 20 years in that home, including the interest, they had more than enough money to hire their own contractor. Their home was fixed in 2 weeks and they even added an extra room! And they still had money left over.

That’s great. But they took a very big risk during all those ensuing years before the nest egg had accumulated. I had CalPERS long-term care. They started doubling and re-doubling the premiums once they started putting out a lot of claims for aging baby boomers. A lot of long-term insurance companies are finding that the product is not sustainable. There was a class action lawsuit against CalPERS LTC, and I opted to terminate my policy and get a percentage of my premiums reimbursed. I would have been in a much better position if I had simply invested those premiums over the years.

My homeowners and auto insurance doubled and their explanation is that with all the storms in the south, they needed to raise everyone’s rates! WTF? I don’t live in the south, or in a hurricane or tornado state? Also it was explained that with so many unlicensed and uninsured drivers, they are overwhelmed with claims. But I have a clean record with good credit but yet are paying outrageous prices. Folks this needs to stop. Immediately if not sooner!
