for me the very first thing to do is to grab a sheet f paper and make a drawing or written description of the bones of the idea ,,, once its there in front of you it becomes much easier to envision the path forward ,,, imo but then yes absolutely its research then and google is a good start point ,

So I am currently trying to start a business and need additional funding… I think I am going to take the direction to get more money using kick starter. My question for you guys is Do I wait and file The provisional patent when I’m ready to sell the product or when I am ready to put it on kick starter to protect my idea when it is released onto the kick starter website? What do you do to avoid patent infringement? Let's say if you have an idea similar to your competitors, as long as your idea has distinctly different aspects to it, are you safe? I've heard that Google makes a portion of its money by selling reports on what people are searching for. So if I type, "Barbecue spatulas" (or say, "Keys with pictures on them") into Google Images, doesn't my idea turn up in a report that's been purchased by a company that's looking for ideas? Won't they be first to market because they're ahead of me and can afford things like Google search reports?

No. You should use Google Image Search and Google Product Searches to study the market - as inspiration, in other words. What kinds of similar products already exist? You need to know. Whatever is novel or new about your concept will not be captured in a simple search. And, never underestimate how much work it takes to bring an idea to market! Having an idea stolen is an overblown fear. It sounds like you are new to this process. If you are interested in licensing, consider picking up a copy of Stephen's book One Simple Idea. Joshua, you're not dumb. There are very few actual requirements for a PPA. Contact the USPTO directly. They will help you out.

Why am LLC? To protect your personal assets? Is there tax advantages? If you are successful is it better to pay yourself a wage or mix all the income together? Do I need to open a separated bank account for the LLC? You guys are awesome.

I think you buys both need different backdrops. Andrew's backdrop should be just one color. The white stripe of wall above the dark curtain (his interior decorator should be shot) is also distracting. It's sometimes hard to listen to you guys.

While listening to your presentation, I was looking at google images for a tool that I came up with...and I did not see it illustrated on there. I am 99.999% positive that , if such a tool existed, it would be at the very top of the choices available. I got a working prototype done but it needs fine tuning before production. Should I try to pitch the idea right away to companies that deal in that industry...or make sure i have a PPA before?

Making a production run (even a small one) without any form of IP protection is always a risk, because you are making your invention public and there is a possibility that someone might copy it, or file it under their name. Google images does not show any prices & never did. While an image search is OK, the BEST first step to studying the market for a product is Amazon. You get images, and prices but you also get product ranks, which is probably even more helpful in your initial research than pictures and prices.

Regarding the specula ex', is it possible to make a product with the same properties, but with minor changes in design or improvement and it will still be ok to produce legally. Hi Laura. This is a great question. You need to study the existing intellectual property carefully. It should give you a roadmap of what to do next. Without looking closely, it's impossible to tell. Does your idea have a significant enough point of difference? Maybe. Maybe you can strengthen that point of difference. Maybe the patents are expired. When it comes to IP, it is always a gray area. Can your search ever hurt you? Like if you search for your idea, we'll say I have an idea for a "Bluetooth Spatula", should I type that in Google search? You think their search engine can suggest it to someone else? Like someone types in (spatula) and (Bluetooth spatula) is suggested for them and they are like, "hum thats a good idea, let me make that!" just wonder what your thoughts on that is.

my thing is a possible Killer App. it takes an app. that is already out there- a handful of apps., but none are like what I have. I've tried to get thru to a couple of large entities, for hrs., and hrs., and cannot get thru to speak to someone to see if they would be interested. I've a mentor from SCORE advising me, and he is very knownedgeable of these things, and is helping me. my idea is a thing that everyone anywhere just about anytime can find of use. I have looked aggressively, and there is nothing like what I have out there ... close- but not my thing...

Hi guys, I have an idea that has no comparison, it is labor saving, can be work safety (OH&S) implemented, and has dual purpose solving 2 problems that exist in the electrical trades, I have searched for 4 weeks and nothing like it exists, and it will be very simple to manufacture, now I have told a friend about it and his jaw nearly hit the floor and I could see the dollar signs in his eyes, his actual reply was "awwwe maaan you have got to do that!" So I have a question.... I just would like to know if it would be best to make a prototype or just approach companies with the design & schematics? a prototype would be simple to make, but I cannot make it myself with the materials it would be manufactured with, I would have to use metal or alloys, the finished product would be FRP.

@@inventRight My invention works like a hoverboard or segway, it has a seat that will squat you up and down to pick up objects and it also has a hornest that will keep your back straight from bending over; so your feet, knees, and back should never bother you. Also handicapped people can use it for sitting or standing with a remote joystick like a wheelchair has. Since my finances are not great, my question is what do I do next to get my idea sitting in front of me? I already have a patent, I'm just stuck at this point

IMPORTANT - You can be SUED for infringement if a patent exists that covers your product = do your homework and search both patents and patent applications. A licensing deal will end if your product violates someone else's patent. [and you will have wasted your time and money]

Your two funny guys !!! Don't I have to prove that it was my idea to start with? I have a man that is dying to make my product, the first words out of his mouth were, "Let's make these and ship them all over the country" then he has sent his young daughter to my young son to entice him into basically giving them my product, the guy is a millionaire and he is training his daughter how to basically steal my idea. I did hire an attorney out of New York and paid him $350.00 down and of course now I have to do all the paper work, ie , drawings, which I don't know how to use a cad program. My husband just died in my arms of a massive heart attack. I'm so confused. Who can I trust? I'm not a wealthy woman, actually, I've just about lost everything . HELP Ii is a Mother's job, to leave her child something of value upon her passing. I am trying to protect my product !!! How do I know I didn't just pay this attorney, with a balance still due, that I'll ever even get a Utility or Provisional Patent?

I just wanted 9 minutes and 10 seconds of my life just so that I could hear "Use google images" which I intuitively did anyway. Problem with you folks other than subtle condescending tone and this adamant assertion, if not constant pushing sotto voce: "Shut up. You are not a genius. You are just improving upon another idea" IS PRECISELY what kills the joy, fun and creativity of inventing. Then again, you guys are not that Japanese dude who has over 1000 patents. Mediocrity always view limitations, whilst genius possibilities. Having watched this drivel and having a smattering of grey-matter myself, my advice to kids out there and other new comers, despite not inventing any shit, is brainstorm and completely go crazy and wild trying to see where your idea would lead you and visualize the endgame. There. You don't need some folks who wrote for Forbes and Inc to spout sometimes the obvious. I wouldn't be so irked if you made your point in pat 2 minutes.

Wouldn't it be better to create completely new product which no one else has. Isn't it too risky to launch your product knowing there's a big competition in there and your sales would be very small? Don't we all want to dominate the market rather than be a little fish in it? LOL

Slight changes to existing products that are selling well can be a good way to go. They can see similar products are selling well confirming there is a market, but if you have a point of different that's great. Pretty much. But more importantly, it's the fact that being unique doesn't have any inherent value, as far as licensing is concerned in particular. Companies are risk-averse. They don't want to license ideas that are unbelievably unique, because there's not an existing market for an idea like that. Ideas that get licensed are simple improvements to existing products.
