Is a woman SINFUL for stipulating in her Nikkah for her husband NOT to take a 2nd Wife

I stipulated this in my marriage agreement, and after 22 years of marriage, I found that my husband was cheating on me. I forgave him then and he ended that relationship. 5 years later, I found out that again, he is cheating on me, and now he says he wants to take this woman as a second wife. I think my only option now is to divorce him, as he has showed me he can’t fulfill the marriage agreement, nor his commitment to me and our family.

Women can stipulate such a condition. If her husband wants two wives he can simply divorce the first wife and take another who wont stipulate such condition or not marry the first wife with such condition in the first place. I've realised that people- the less knowledgeable they are the more irrational, emotional and unreasonable they are.

No woman would agree that their husband marry another wife unless it would be sinful for them not to. If we say she wouldnt be then the verse about marrying four wives would be pointless. Allah says marry 2 3 4 1. He doesnt say whether we should with their permission.

From my own studies on this topic, it's my opinion that a man should seek his wife's permission BEFORE doing nikkah with another woman. And she has the right to say no. However, the man has the right to divorce his wife if she doesn't allow you to marry another woman. I think that's fair, but please correct me if I'm wrong. Allah swt knows best.

The man must let his wife know he wants to take another wife not ask her permission. But he must not destabilise his family rather he should try to make her understand and comfort her and if she doesn't want that, can seek divorce.

no it's not a womans right to stop her husband from getting married to a 2nd wife if that wasnt stipulated in the marriage contract. rather you should follow a scholar or a madhab and follow the opinion from them. only when you are well grounded and have studied a lot, under qualified scholars, that's when you can take your own studies and have your opinion. even sheikh assim does not give his own opinion, he gives the opinion of the scholars he follows

I'm guessing whoever wants a second wife will have to divorce the first wife because of a stipulation in the nikkah. Is there a Hadith where the prophet himself said a woman can have a conditional marriage? Because our prophet not wanting his cousin to marry the daughter of his enemy doesn't answer this question.

That was the daughter of abu jahl and it Salaam It is absolutely understandable that the daughter of Prophet a.s. can't accept her. For such a condition I think it would be better if we have some more example from sunnah. Bcoz this example itself became invalid as the issue was not the second wife but the relation with abu jahl. Can you clarify how a women can make a divorce by returning khawala? Is there a need for a Muslim judge to orchestrate it? If the man does not want to take the khawala, can a divorce still happen? If the women received many gifts like jewelry, does she need to return the gifts as well? If the women is a housewife, the mahr, usually money, can be gone if marriage lasted for over a year, so the women will not be able to pay anything back, in this situation, can she divorce without giving any mahr? Are there other cases of divorce using khawala? We only know of one, from other videos I watched, but I was wondering if there was other cases. Was the marriage for a short time? If it was short, then the reasoning for divorce can make sense to me, but if the marriage was for a while, then I think the use of khawala is different? Question is, how was women side divorce done in Prophet Muhammad(SAW) time, and the sahaba's time?

A one more question, that what are permissible condition we as a husband and wife could put in the contract. Because I find such condition as a tool of feminism and at the end of the day we men have to suffer at all. Women have enough right and most of the cases they are fulfilled as well. So can we make condition like you have to stay with our parents, normally in subcontinent this is understood by proxy. And that time no one ask for a seperate house but just afer marriage the bride family start thai is her daughter right to have separate house. Is this fare?

Most men that plan on marrying multiple wives don't tell their wives about it. And to be honest they shouldn't cuz we all know no woman will ever give permission. Hence just marry her, then when you want marry another wife. It's very simple.
