must be working then. I'd rather have it and not need it, than have a bear find me and need it but not have it. Around here we regularly sight coyotes and there's nothing we can do about them. What's the point in calling animal control after somebody loses a child to one? We should be able to protect ourselves without this over-regulation.

Why doesn't anyone consider the fact that the people blocked the guy's driveway? They initiated the conflict by intentionally harassing/obstructing their neighbour. I'd be angry too if someone blocked my driveway and it's NOT an accident when somebody does that. It's deliberate. It sounds like the people with the vehicle were the aggressors here. They wanted to create a conflict and they got one. I'd charge them with harassment and with initiating this altercation.

Many years ago I was charged with causing bodily harm when I was defending myself. I had to do community service, go to group therapy Consequently I am very apprehensive of defending myself at all. I used to be proud of being a Canuck but really all we are is cucks because we are expected to bleed, back down an apologize. Had I fought it I would likely have won in principle but lost my career job. That is Canadian Justice for you

Bear spray, Canada is very confused as a nation. I drove from USA into Canada and they took the Bear Spray at the Border they said it was illegal and a weapon. So no Bear Spray from the USA. So we get into Baniff and the signs on the hiking trails said 'You must take Bear Spray to hike. So we went to town bought the same brand bear spray that they took at the Border. Just the price of traveling in Canada with too much government that is not coordinated and too many rules & laws . In case you think this is Yankee talking I am a Canadian.......

Nasty stuff to get in your eyes. In the US it is illegal to use those sprays for anything they are not certified for. Kinda like a drugs prohibition in concept where drugs are great, but they are only approved for certain uses. So if you spray someone with wasp spray, it is not an approved use, and it is illegal from the get go. Not sure how that compares in Canada. And then you have all the legal issues I am not qualified to talk about. But it might get sticky if your plan from the get go was perceived to be to use an illegal product for the considered use.

For anyone reading this comment. Wasp spray is legally equivalent to throwing acid at someone. It would be considered grievous bodily harm (like shooting and not killing), unlike OC/pepper spray which does not permanently injure someone. So if you are carrying wasp spray, consider it basically like carrying around a bottle of acid, you better only use it in DIRE circumstances otherwise you're going to jail. You can't throw acid on someone for beefing you in a bar or even throwing a punch on the street.

that the part i dont under stand, there is law that says if the so called ofender is walking away and you go after him/her n self defense, your in the wrong and guilty, the guy was getting in his truck when the other guy kicked his door, witch that driver acted in self defence, but again the 2 that were charged by there names, seems like natives, it is a well known fact the court let them walk or a small slap on the wrist, out of fear of attacks from bands crying out races, this persom was blocking his drive way, and they started a fight, when all they had to do is move there truck, my self i dont look for the owner, i hook a chain on and drag it out..

spent years with bear spray in a black nylon case on the handlebars of my adventure motorcycle, travelled to Mexico, baja, yukon, panama, alaska all places in between. Only once did US border agent when I was coming from Mexico mention it, but never had any one ever seem to notice it otherwise. I never had to use it I also hike in BC often carrying it when alone, have seen many bears, they always went the other way. One never knows.

I have a can of bear spray in my truck along with other off-road gear at all times, as I often go on back roads. Additionally, I live in a municipality where there are bears that have been known roam the streets. It is unreasonable for the law to make ‘assumptions’ that self defense from bears is a ‘planned’ event, therefore I should not be prepared to encounter them at all times, even if I drive to a downtown location with the spray in my truck. That’s like saying you should only be carrying a spare tire when you need a spare tire. Additionally, self defense of you or your loved ones can be required. That event of the need for bodily defense is not exclusively defined in ‘harm to body’ terms as being easily divisible AT THE TIME OF AN EMERGENCY between a bear or a person. There really is no ‘change of use’ of a bear spray for emergency defense. Defense of family and self is not easily altered by legal maneuvering. In other words, both defense of person from an animal or a person both share the same ultimate results. Danger. It is always a good idea to call wildlife authorities to deal with a bear running at you to rip you apart, instead of using bear spray, just as it is to call 911 when a person is running at you with a sharp object, but in real life terms, you’d still be dead or mangled if you don’t defend yourself. In Canada, we elect individuals from our community to represent us. When they make laws we disagree on, or laws that result in unreasonable prosecutions, WE need to ALL speak up to our elected representatives that they are required to alter those laws as directed by us, the majority. Speak out! And finally, this is NOT LEGAL ADVISE. Just my opinion. What’s yours?

Does raise the question of what good is a baseball bat in the trunk of your car. Maybe if you sell out of your car... I knew this guy who had a semi auto in a locked gym locker in his garage (no access from inside his house). He had these stories in his head about people coming over the back fence. And somehow he figured that if he was attacked he would get to his gun. Best not to go to jail for fantasy scenarios. It's a care, park it where you can drive away. In the movies the guy with the bat in his car is either a thug, or he sees a fight and mixes in.

It is illegal for a citizen to be "prepared" for an attack. If one occurs and you had the forethought to arm yourself to defend yourself - you are a criminal. The police would rather deal with your corpse than the assailants.

I live in an area where there are many bears (even coming into town). It is encouraged and very common to carry bear spray here. No one would ever be charged with carrying it here as you have legitimate reason to do so.

You can carry tools for the intended utilitarian purpose of the tool, You can carry sporting goods for the purpose of sports. And by law you can use a weapon in self defence. By law you cannot arm yourself with any weapon for self protection. If you need a box cutter to open your amazon packages you can have one in your purse for this purpose. If you are afraid of getting bitten by a large dog on your walk in the ravine you can have bear spray to ward off aggressive attacking dogs or wildlife. If you are tiny and/or vulnerable, but you like to go on long solo walks in the ravine you can walk better and climb rugged hills with a walking stick. NEVER carry any weapons for the purpose of self defence from humans in Canada, that is a serious criminal offence because it is a “danger to the public peace”.

It makes sense because :1) They have no idea who you really are and what you are really up to. In the case of police, they assume that if they carry a taser, it is to be used instead of their pistol. It isn't non-lethal, it is less lethal. It is within a force continuum. If the person carrying it tasers kids then tortures them and kills them, the taser is totally different in those hands; 2) Police receive training with the device which a) should mean they use them responsibly, and they have other force options if they get themselves in too deep for a taser, or need less than a taser; b) police also have a huge record of abusing tasers, all of a sudden they are zapping kids who talk back, or old people to save them form hurting themselves; so you don't want the public to use them (or knives, or clubs, etc...). Do we need more widely distributed electro torture devices. 3) while it sucks, in a place like Canada where it is as safe as anywhere on earth, particularly considering the level of freedom, it makes it possible for the police to arrest anyone carrying weapons. You don't need weapons in most communities. Sorta sucks since we are so responsible, but that is the way the authorities like it. There are levels of risk in society where it is better to make the job easier for the police. I have relatives in NI and a lot of people, just generically are on hit lists there. You never knew when you opened a door whether you would get shot. That is a place where a lot of average people needed guns. Canada not so much.

From what I've read it's illegal to possess any object with the *intent* of using it to defend yourself from a human. If you beat an attacker with a feather duster, then you've used a weapon on them, though that right is protected if it was found that you used it reasonably in self defense. However, if you noted to others that "I'm carrying this feather duster to defend against any potential attackers," then you've committed a crime.

Carcross is a spectacular mountain biking destination, and Wayne Roberts hand built a significant portion of the trails including "Mountain Hero", a massive 30km loop that takes 6 hours to bike. He was a tough as nails mountain man in the truest sense, "did not appear to need any help" gave me a laugh.

I will never understand why some jurisdictions (Canada, New York city for example) ban self defense devices. If you use pepper spray to fend off an attacker, how is that a danger to the public? Yes, you could use pepper spray to incapacitate someone before robbing them but you could also carry a can of oven cleaner spray and use it for self defense or offence. Oven cleaner would not be illegal to carry but using it on a human would would do horrible and permanent damage.

My brother and I were attacked by a group of people in our building , a neighbour and his friends. We defended ourselves unarmed and were almost able to make an escape when they emptied a can of bear spray on me. The whole building had to be evacuated. All charges were dropped because they are natives and gay. The judge assumed we attacked them , turned us into the bad guys. There was 40 people in total in that fight and just my brother and I. In Canada our Judges award violent racists and punish victims. So my new motto in life is , I will not hurt nobody as long as they don't hurt me and if they hurt me screw the rules I just want to get away if I have to defend myself to their death its on them not me. I'll do the time. Proudly.

Pepper spray is incapacitating but not harmful .Unless you are allergic to it .Mace cause harm and so do black pepper oils .and cinnamon oils and other spices .Pepper oils are used in topical creams for pain relief .It's also and edible food product and does not cause any permanent harm .

My son was putting something in his trunk when he got hit with pepper spray. Blinded he grabbed the assailant and began to punch him about the head and shoulders. A neighbor called the police as this was happening and the assailant escaped by getting out of his hockey jersey. The police stopped the guy as they knew he was shirtless now and hooked him up and stuffed him in the back of the cruiser. They brought him back to the scene. It was a boyfriend of a girl that also was my son’s friend with benefits. By this time my son could see again the cops arrived with her boyfriend. My son was laughing so hard from seeing how badly he had beat him up and asked them not to arrest him.

I was always confused by the prohibited weapons language. It seems to classify things like circular saw blades and jump ropes as prohibited weapons (i.e shuriken & nunchaku.) I suppose that, like bear spray, it all boils down to intent while carrying? Love your channel!

Pretty much. If you are carrying bear spray to use on an aggressive animal but a person assaults you and you use the bear spray on them, it’s fine. But if you admit to carrying the bear spray to use on someone who assaults you you can be charged which is fucking stupid. So just lie!

If someone tries to attack her, she has my full backing to use it as self-defence. For legal purposes.. I never said that and it can't be used in a court of law.

Pepper spray is a micro pulverized powder suspended in aerosol. The powder in in your pores causes the irritation. Flooding with cool water without rubbing, which grinds in the powder, is the preferred decon.

Awesome instant karma cop story here, and it's PERFECT for this video: My late husband was at a 420 legalization protest before it was legal here in Ontario and got stopped and frisked by a cop who was parked nearby waiting to descend on any humble stoners leaving the event(as they might likely have been consuming or in possession of cannabis or other things). Well this cop made a big mistake. Several actually. First, he was a total Ahole to my late husband who was a very nice man and had important information to tell the officer about the vial of unlabeled white powder he would end up finding in my late hubby's backpack. Second, he based his next decisions on his own ASSUMPTION of what was contained in that little vial of white powder and refused to dignify my hubby by allowing him to explain anything or "give excuses"/"talk his way out of it". Third, he opted not to do any paperwork for the detainment and seizure of the goods, and "let my hubby off with a warning" like a "nice guy". Now idk if Runkle or my fellow lawtube viewers knows what it means when an officer confiscates what he believes to be a controlled substance and opts not to file paperwork regarding the seizure.... Spoilers: It means that officer may have some unconventional plans for "disposing" of the seized goods. My late hubby was fortunate enough to find out the next day, at least circumstantially, what likely happened next. Hubby was walking down the same sidewalk and got pulled over by the same cop, now with a suspicious looking bandage over his nasal pathways, who pulled up in an adjacent alleyway and called my hubby to the car. Mr. Power tripper gets out of his cruiser and proceeds to conduct an unannounced and aggressive "body pat down" and search through his backpack again whilst throwing all the contents violently to the ground around them. According to my hubby the cop just kept angrily repeating "You got any more of that STUFF?!". Eventually the cop gets his anger out and leaves. What was the fourth mistake the cop made? Well that would likely be, and we can only assume based on the sequence of events, probably snorting pure 99% capsicum powder under the belief that it was some other less painful party favor.

Not really, you always have the natural right to defend yourself. However, fighting is always illegal in Canada unless it's in the context of a sport (martial arts/boxing.) Since you have to fight to defend yourself, you're automatically charged with a serious crime and it's up to the judge to decide to dismiss the charges against you. It becomes extremely serious if you use an item (any item at all, not just ones intended to be weapons) to fight with, and if you use a firearm to defend yourself you're now in the SHIT OF YOUR LIFE and will be on "police watch" (targeted individual, full-time surveillance in your own home) for the rest of your life, IF you don't go to prison.

Carcross is 73 kms south of Whitehorse on the Klondike Hwy. The population can't be much more than those few people fishing on that bridge. And you can expect to run into bears anywheres in Yukon; even in Whitehorse there are warning signs posted on city trails.

No! You’d be in jail unless you were able to “justify” and “prove” the use of force like the invador having a knife or a some tool. Always have a camera at the door(front/backdoor and halway/corridors of main and basement. Stupid laws in Canada encourages thiefs to enter homes because they are protected even if they have guns pointed at you… avoidance and deterance are highly recommended than anything else! FYI, water makes things *MUCH* worse, it allows the spray to move around the entire eyeball, and carries the spray into places it normally can't get to. Wipe it away the best you can with a towel or clothing (that wasn't sprayed), and wait it out... do your best to keep keep your breathing consistent. Don't panic... unless you have respiratory issues, you'll just be uncomfortable for 20-40 minutes. Side note... the spicier food you enjoy eating, the less effective bear spray is on a person. Also, most people that have been sprayed multiple times can become almost immune to it's effects, so never rely on bear spray to stop someone.

I was talking to someone on a firearm forum and he mentioned that he works at an outdoor/sport equipment shop. They were having issues sellimg bear spray to patrons because the police usually comes to question and the product they sold were used in robbery. So they have indoor policy now where, someone shifty comes in, oh, the bear spray soldout. Female patrons come in looking like they don't do outdoor stuff at all, sorry all sold out. Not saying this policy work but the number of times police comes in has reduced significantly. Princess auto do sell high pitch alarm that once it's activated, it could emit high decibel up to (120) which can cause perm hearing damage if you shut it off. This might be another option for self defense. Also, it might not be significant, you can't carry stuff on your for self defense, but If it's some junk items on side of the road, you can totally use it to your advantage as well.

As a older person who hikes alone in the vicinity of coyotes and occasional cougars, travelling and practicing with bear spray and noise making non lethal reloading cartridge startle devices are comforting, as is a walking stick, water, sweater, flashlight and cell phone. Would personally prefer a camp style sidearm but a carry permit is hard to obtain.

If someone breaks into your home in the middle of the night and you observe them coming up your stairs towards where you are can you use bear spray to dissuade them from continuing to proceed towards you? To me, a stranger that has forced his way into your home in the middle of the night presents a real potential threat to your personal safety. The bear spray won't kill the intruder, but it will change his game plan at least for a few minutes giving you enough time to flee to safety as opposed to having to deal with surprising or interrupting the intruder which could result in harm or death to you. Would you be charged with using a prohibited weapon for acting in this way?

don’t bother to worry about self-defense if you don’t have cameras in halways and potential entry points to your house! Coz you need intrusion proof! You can’t simply say he broke into my house because you can simply break your window and say intruders did it! Or say they made to the upstairs while you could have dragged him upstairs after finishing him! add to that that you would have to justify the use of force lethal or non lethal does he have a knife while charging at you? Does he have a weapon or something you identified as a weapon! Its not that simple! He can simply pretend he is your friend and you attacked and sue you as a result! If you are serious about your safety make sure you starts with cameras everywhere and window sensors with 300db alarm sound that scares the hell out of the whole neighborhood! Peace

one factor that may be relevant.......as an employee of Northwestel (the phone company in the northern territories) i was issued Bear Spray as i regularly encountered Bears at or near remote work locations i was required to sign a document which clearly indicated the product would not be used against humans my understanding was this was not an internal "company document" but conditional to any and all people who were in possession of Bear Spray as such would any use against a fellow human be some kind of violation ??

I carry dog/coyote spray all the time. It saved me and my family from a dog attack, I've had dogs run at me right in front of my home by some idiot with an off leash pitbull, dogs coming off their lawns at us when we're out for walks in the country etc, etc, etc.... I'm not planning on getting mauled because of stupid Canadian law. So I'm glad for this ruling, but we all know some cops, politicians, or courts love to punish people by arresting them. I don't know if it was covered, but a few years ago I was doing this wasp nest eradication thing. Not my best hour, I managed to get wind drifted spray in my eyes, and did a lot of searches online for first aid. I came across US law that said that it is illegal to use a spray for anything not covered on the label, or for which it was designed (not sure which). No idea about Canada, but conceptually, it could be illegal to spray a bear with wasp spray, and vice versa, let alone a human. And bear spray is a lot harder on humans than the legal sprays that are designed for use on humans, at least by legend.

I read through the case myself and followed along with you, am I missing something here? Were Eriksen and Profeit seriously acquitted of all charges? I don't see how that works, the conflict was all, but over until Eriksen kicked Mr. Roberts truck door and then possibly pushed him, Roberts restraining Eriksen makes sense (5'7 vs 6'3, jeez) I just don't understand how Eriksen walks away from that.

@@TheWolfsnack for sure, it is a well known fact, i am shocked the cops even charged them, the cops and court let them go or a small slap on the rist, out of fear of that band coming down on them as being races as is the case all the time here. i had one fraud me of over 10k in Aug 2016, in spit of me supplying all the canceled checks, testaments from our terminal showing she was doing refunds from our terminal to her debit card, to this day the Thunder bay Ont police have done shit.. never even talked to her, every time i called to see were things are at, i was told, oh i am the only one that handles these cases and i have been really busy, but i will get to her, here it is Nov 2020 and nothing been done, and we are out over 10k

While I don't think that bear spray should be classified as a prohibited weapon, I think this ruling is absolutely disgusting. I mean this is some bleeding heart BS. That couple instigated and escalated the situation on multiple instances in that encounter. 1. By blocking the man's driveway. 2. By kicking the mans truck door instead of just driving away and escalating the interaction into a physical altercation. 3. By Ericson telling his girlfriend to grab a can of bear spray and assaulting Roberts after the fact. 4. By Ms. Profeit grabbing a second can of bear spray, trying to assault Roberts. But it's Roberts who was the aggressor..?? And the couple acting in self defense..??

Please do a video on dog spray if used against a multiple attackers. If the person using it argued that they had a fear of dogs/coyotes but found themselves threatened or attacked by multiple people and used the dog spray in self defence. I lived in an area where a coyote was prowling and ended up killing a neighbour’s cat. I bought dog spray just in case. Separately a group of strikers attacked some coworkers of mine (I wasn’t there) but I’ve wondered if I had used the dog spray to defend myself and my coworkers would I have had legal trouble.

In my opinion Roberts did nothing wrong. Erikson and to a lesser degree Profeit caused the event by parking in Mr. Roberts driveway and escalated the event at every step . In my opinion the judge made an error. Unfortunately they've been known to do that.

Interesting that you imply I could get in hot water for having bear spray in a vehicle that is being driven in a city center. I keep a can in the center console of my Jeep, as I may wish to carry it when in the woods and by leaving it there it will not be forgotten. Likewise, many of my employer's company trucks have cans in them, as our clients will insist we have it while on site. I think both I and our clients are using sound logic by carrying it. I take both my Jeep and these company trucks into major city centers (Vancouver, Calgary, Edmonton, etc) on a regular basis, but I have never considered that the presence of bear spray could be interpreted for a use dangerous to the public, nor would I have thought that a LEO would push this matter as vehicles are capable of traveling great distances in short periods of time and while there may be no bears in downtown Vancouver (other than when there is, they do have a problem with habituated bears) it is not unreasonable that within a few hours drive I may be in a place where there is and carrying bear spray would be advised.

Rediculous- past offenses and the person in the right “roberts” roadway being blocked had his door pushed kicked... obviously Ericksen was aggro when Roberts was moving his truck... the fact Roberts didnt break an arm showed he was using his means of self defence to make a stalemate for people to talk or backoff... Ericksen actually only backed off when he was sprayed. Judge messed up. Bearspray/dog spray is a balancer for women vs men. This rule sucks...

I am disappointed to note that the fact that Mr. Roberts had turned and was getting in his truck to move it was not taken into consideration and that Mr. Eriksen had tried to kick the truck door closed on him. If he had not done this, then it would have been over with. That makes Eriksen the aggressor. Eriksen was also the one who called for the bear spray to be used. I am sure if they had used it on him at that time. Mr. Roberts would have also gotten a beat down. Thank you very much for sharing.
