I work for USPS, won a sexual harassment lawsuit. I have the pictures, texts that were sent to me. Since then I have been harassed every time I take my intermittent FMLA (long standing chronic that will never get better) My manager is telling my supervisor that I can't take part of a day to go to the Dr or use it when I'm sick and come in late or leave early for the same condition. My Dr wrote 1 to 3 days per incident, up to 4 times per month. We are allowed to take increments in hundredths of an hour and my FMLA notes time for intermittent leave Dr appointment/ illness from disease. They will not ask for it in writing, but verbally harass me every time I use it. Saying that the manager said she is going to report me for abusing it. This is incredibly stressful and I'm seriously ill with a condition that will never get better

Sorry to hear that you’re going through this. Document what is occurring in emails to your manager and/or whomever is harassing you. File an FMLA leave interference complaint with the federal government.

Yesss I feel like my lawyer is low balling the hell out of me he stated my depression and anxiety is worth 20,000 I see a psychiatrist or still affects me 1 year later sucks

@@ramonahudson984 I would do your Oren research. And look into getting a new lawyer. Some lawyers. Just wanna settle easy peezy just bc there busy you know like one. On Vincent’s videos Some lawyers don’t wanna put the time and rush a settlement so they can say they made xyz in an hour or two

I had a severance package they was trying to give me in a promised me not to sue. It’s been going on 2 years now and we’re waiting on the judge to rule.

Shit...2 years....I just had a mediation where the amount offered was a tad less than half the BARE MINIMUM I was willing to accept. Can't state the details legally for obvious reasons but I have only 3 days to either take the "final offer" by my employer who wrongfully terminated me cuz of my autism and not cuz of anything I did....and I've been unemployed for 5 months now with my current career likely destroyed as I CANT use them as a reference now.... So I'm wondering whether to try and fight...and likely be where u are now, or just take the sum I have which was $3K less than the actual half of what would've been 1 year income.

@@croc560 my case is still pending because I refuse to take what they feel like I deserve. I’m the victim. So much had went wrong working for a company who didn’t care about what was right as so as I took my complaints I’ve their head. They started retaliating against me but the employer lawyer trying to get my case dismissed is why it’s taking so long because it’s in the judge hand they gave me a severance package in exchange for me not to sue them. Which was only 3k then they went up to 12,500 I refuse that I was out of work for a year on top of all that my son died I’m still waiting.

My question is if you can settle for $50k can you request that the previous employer pay your legal fees ? In addition that they write a letter of recommendation based off your actual performance rather than what they discriminated against you?

Things that never happened. Client saying he has ppl vouching for him being a good guy as evidence. This is the equivalent to doctors complaining about webmd and cops complaining about csi, complaining > than ppl actually think that ish by a lot - my Ted talk

An employee has a discrimination case at work (I’m her friend) and their lawyer calls me at work- do I have to talk to them. I do not want to get involved, I’ve only worked there 6 months and she’s had issues with employer for over 12 years.

How to you search to find a EEOC complaint. Haven’t had update from My Attorney and is EEOC different from USSERA do I need to file on both Attorney mentioned no need for it

Your attorney should be happy to provide you a copy of the complaint as-filed along with proof of filing from the EEOC

@@JobAttorney Thanks! Finding out Attorney didn’t file with EEOC as I had on mind when it was agreed . Just now my instinct was telling me to check with EEOC and was told no file. Didn’t know what a bad Attorney after being well recommended loss my case

Wish I would been more knowledgeable about this subject and finding better directions on handling this litigation better prepared with better representation fail effectively to defend on best’s interests not missing required deadline filing neglect professional services withholding relevant information in filing acting in attorney own interest without consulting me prior to decision

@@JobAttorney Thanks! Lesson learned can’t believe there’s bad attorneys out there. Getting scam by such a sketchy attorney taking advantage of my situation not going by initial purpose of hiring representation of reaching maximum results never file thru EEOC never provided any documentation copies filed o introducing court correspondence response not communicating details facts update status on schedule court hearing no participation on any negotiation progress . Force to take the settlement without option threatening to withdraw from representation have a lien on case and filing lawsuit against me for malicious … disappointed

Attorney percentages range, I've seen as low as 25% and as high as 50%

Would you be able to answer if you think i have a good case? It is lengthy, unfortunately. California is the state. So I have been working at this particular company for about 2-4 years now. Honestly don't remember anymore but it feels like it's going on 4. Anyways, it's a security company. I have no issues with my employer, even though I may be getting fired due to my own actions after the events I'm about to describe took place. I'm not suing my employer. So, there are 3 companies involved. My company, the client and the client's client. I don't know who the client is because my company wouldn't tell me, but their client is the Dollar Tree. I've decided I want to move forward with some form of litigation and am unsure how to proceed. Several employees at this company (Dollar Tree) have been slandering me and making untrue written statements about me to management. Full blown defamation. As far as I'm aware there are 4 employees and possibly a 5th whom I have never met. We will call them S, E, D, R and M (M is the uncertainty). For several months now, S has been trying to ruin my reputation and keep the employees at the store from communicating from me. She has at one point even told employees if they talk to me that they will be fired. She has told some of these same employees that I harass people (I do not) and that I was under investigation for sexual harassment (which nobody ever informed me of). I do not know if this investigation even took place. If it did, apparently nothing turned up. My company had never mentioned it. Other instances of this occurred when I have taken days off, or my company required me to cover another location. S has repeatedly told other employees in this company that I had been fired. Each and every time. E has also made several comments about me despite me having only worked with her for 30 minutes or so until recently, bumping out total time up to a total of 1.5 hours over the course of 11 months. Her and S have been at this for a while, working together to ruin me in the eyes of my peers with several attempts to have me fired from my company. D and R are new additions to this dynamic duo of defamers. D has a sister, call her C, who recently worked with us. She was pushed out by S over a dispute that occurred over 13 years ago in high-school. S was constantly harassing her. She had even had her hours cut through methods unknown to me after C had tried to call in sick, came in anyways with the threat of being fired (to my knowledge), and after going home sick she had been told not to come in the following day. Her hours were then reduced to 8 hours per week. I'm unsure of how much she had previously been working. Eventually C quit after just 3 months. D and R are a couple. R has been harassing C and her BF for who knows how long and I can only take a guess as to why. R is certainly on drugs, evidence was found in the bathroom several times. Same with D. R and D have told everyone at work how C is trying to sue them and get a restraining order on R. C asked me if I could have the restraining order served to R. I was, at the time, neutral towards the situation. I told her I would assist her and have someone deliver it. I notified R that it was best to not avoid service (he liked to brag about that) but he could do what he wants. I told D the same thing. I brought the paperwork to work and asked D if she wanted to just get it over with or wait for R to be served by an actual process server, which was inevitable. I told her I never knew of avoiding service to work out well for anyone and advised her to get it over with sooner than later, as it would not look good on R, especially with all of the bragging he's done about it. She told me not to worry about it and she would talk to R. I had already planned on having my friend dump it on him later in the week. Unfortunately I left the papers after a coworker had spilled water on them and I had honestly forgotten about them. S found them the next morning and complaint to several managers about it. She went through all the paperwork and discussed it with several employees and reported it to the district manager. She had D and R fill out complaints against me alleging that I had read these documents loudly in front of the entire store to embarass them, which is untrue. So my manager called me recently while I was working and asked me these questions about the paperwork. I was livid. I immediately called S out and a liar after she said something to me with a dirty look as she happened to be working that day. Ended up getting sent home shortly after for other reasons and removed from the post until further notice. To top it off, C went in the day after I had left the papers to retrieve it. She was told to leave or her friend who works with us would be fired. Two other coworkers had tried to retrieve the paperwork but were told to stay out of it or they would be fired. Then the paperwork disappeared and I'm being questioned about it. I'm not the one who told everyone but am being framed as the one who did. E has gone to other stores and guards talking about me to them. I was informed by that stores security guard as she had told him that I'm a terrible guard and don't do my job, all untrue statements of fact. So there is quite a bit here. I'm sure there's more I'm unaware of and there are a few more items I've left out. Recently I've been having anxiety and it doesn't help that one of my cats went missing recently so I'm just fed up with everything. I've been having fits or rage over this entire thing and it takes everything I have not to completely snap sometimes. P.S. All of these individuals steal from the store, I've seen it several times.
