Is The VA Playing Games With Your Medical Evidence?

The process of filing a claim for disability benefits through the Department of Veterans Affairs (VA) can be overwhelming and frustrating. One major factor that contributes to this is the evaluation of medical evidence provided by veterans to support their claims.
It is common for veterans to feel like the VA is playing games with their medical evidence. This feeling arises from a variety of issues such as lengthy delays, improper handling and interpretation of medical records, and lack of transparency in decision-making processes.
One issue often faced by veterans is the VA's tendency to overlook or downplay certain types of evidence submitted in support of a claim. For example, lay statements from family members or buddies may not be given much weight compared to medical records or examinations conducted by VA doctors. This can be particularly frustrating for veterans who may not have access to extensive medical documentation but have the support of those who know them best.
Additionally, there have been cases where the VA has ignored evidence that contradicts their own findings, leading to denial of benefits. This is especially concerning when it comes to mental health conditions, as symptoms and severity can fluctuate over time. If the VA only considers a snapshot of a veteran's mental health at one particular moment, they may overlook crucial evidence that paints a more accurate picture.
Furthermore, there have been instances where the VA has requested repeated medical exams or tests without providing clear reasoning or explanation. This can draw out the claims process and cause additional stress for veterans who are already struggling with their health.
So why does it seem like the VA is playing games with medical evidence? Some may argue that it is due to a lack of resources or a high caseload, but others believe it is intentional. The truth is, there may be a combination of factors at play. However, as a veteran seeking benefits, it can feel disheartening and even unfair.
If you are facing challenges with your medical evidence in the VA claims process, know that you are not alone. There are resources available to help navigate this complicated system and advocate for your rights. It is important to stay persistent and continue to gather as much evidence as possible to support your claim. And most importantly, do not give up.
In conclusion, the VA's handling and evaluation of medical evidence can seem like a game to many veterans, but it is a serious matter that can greatly impact their lives. It is important for the VA to prioritize transparency and fairness in their decision-making processes and for veterans to stay informed and assertive in advocating for their rights. So keep fighting and don't let any games get in the way of receiving the benefits you deserve.

My husband also did an appointment at the QTC in Augusta. He had the same EXACT experience there. They tried to reduce his PTSD and ultimately he fought it and thanks to ppl like you he came out on top and got 100% P&T. It’s ridiculous how disrespectful medical personnel can be against our veterans

At my CP exam they asked how many migranes I have. Told them every other day and my head hurts non stop and have been going to the VA for the past 15 years over it. He wrote I don't have any migranes and I don't take any meds. I don't understand how these people don't get fired. I filed a complaint wanting a new CP exam. Been 7 months and still haven't heard back. They denied my claim.

Do you have a Headache complaints or diagnosis in your military medical records ? Are you taking VA prescribed Migraine meds? Are you getting accupuncture at the VA for migraines or other headache pain ? What does your decision letter say why you were denied..?

By watching your videos and learning about how the VA examinations work, my rating has jumped from 60 to 80 percent service connected. I have one more exam pending. Thank you so much for your videos 🤙🏽

Really recommend that veterans/service members print out the blank DBQ, fill it out ahead of time with your symptoms (include origin circumstances, date it started, the current frequency, the level of pain/loss of functionality, etc), and a list of your applicable medical records that the C&P examiner should review (ie, "PCM encounter on 24 Jan 2018, which diagnosed X condition). Just like Craig said, start the conversation with how you actually feel (not "I'm fine). For those service members still in when they file for a disability claim (is Chapter 61 medical retirement, BDD claim for regular retirement, etc), that C&P examiner will only have access to your medical records up to the date that you initially filed your claim. So if you receive any treatment or any records are populated between the time you file your claim and the time you have your C&P exam, print those records out and hand a hardcopy to your examiner so they can include those in their assessment.

In one 8f CC's videos he quoted one of the comments that said " I walked into the C&P exam, the examiner said hello how are you, the vet said good how are you, the examiner said we're done. You said you were good, i have other patients to see," and that ended the exam. So, apparently, it does happen.

Hey Craig, have you ever heard of the VA deferring your claim and sending it to QTC. Then QTC sets an appointment, but I am not included. Then they just deny my service connection. I have submitted a supplemental claim and provided information from one of the VA's own studies and outlined how my conditions correlate with that study and also presented them with the "Benefit of the Doubt rule the VA is supposed to use and how I should be connected and rated for this condition using a personal statement.

I sent everything in for my 2nd and 3rd C&P exams. Even the lawyer and their medical people can’t understand why they keep denying my claims and increases.. so now going to an orthopedic DR to get examined and have him write up all that is going on and how it is directly related to my military injuries

Yes sir that's what the El Paso and Albuquerque VA A-holes did to me when I try to apply for my disability compensation. I left the service in 1986 with tinnitus but no one ever told me that I can get compensated for it,in fact, I never even got an exit exam. Flash Forward to 2022 and I read The pact act and I was like "oh crap I better apply". Everything was denied because I didn't know what I was doing. then I started watching your videos and other. I'm not bragging but I got a 119 on my test way back in the day. All I need is a tablespoon of evidence and I can build a case now. I just got a 20% and I feel like I'm the Fn king of the world. If only my father and grandfather was still alive. l could have helped them get the benefits they earned but never received😢 Tata (EAZ) 1st infantry Normandy world war II, Dad (EAZll)82nd airborne & walk with a limp his whole life but never received one penny because of his bad paper. Me ( EAZlll) third infantry Cav Scout & retired Cal Fire, that's all folks 👋🤠

Did my C&P exams back in April, now they are making an issue of my flat feet which were diagnosed in the military, My military records show I saw a Pediatrst twice who both times tried to give me inserts but I was unable to wear them due to me at the time mostly wearing combat boots. Since July they scheduled and canceled 2 C&P exams, they sent me letters now 3 times for ACE exams that i'm not sure happened or not. Those C&P exams they didn't schedule me for but said I attended them even sent me review letters on how the exams went. Even though They never informed me of them. Started this process on March 1st still going strong August 25th. No clue where I stand but I do have a huge trail of paperwork now that shows them screwing me around with this whole process.

I guess I am not clear on how saying “I’m ok” to a receptionist makes into evidence? Even if it does, that is easily challenged on appeal through simple rebuttal questioning. I have done a lot of C&P exams with QTC and they send you a form to fill out. I generally turn in a page or two of notes with that document where they ask you to speak to your disability. Fill it out and write on separate pages to continue your answers. They make the boxes extra small for a reason. Confirm with the examiner that your responses and notes will be sent to the VA with your DBQ. Let them know “casually” that they can keep that copy because you have your own. Saying “I am doing ok” to the receptionist and that comment making it into your evaluation, is grounds enough for that exam to be insufficient. You cannot be evaluated under false pretense and the receptionist is not a medical professional performing the evaluation per your Examination packet. Now, if this person meant they said that to the examiner…. Well, that’s different. That’s why I write it down and ask them if they have had adequate time to review the notes “they asked you to bring” as soon as the evaluation starts. That last part is key. You don’t have to rely solely on your verbal answers. They ask you to write it down in advance and bring it. Take the time to nail that part.

I have a question. If you are diagnosed with cancer do to military duty. And receive 100% permanent & total. If you go into remission, can VA reduce you back from 100%??
@TheDisco672
@TheDisco672 2 ай бұрын
Cancer is 100% temporary while cancer is active. When it’s treated and in remission you have 6 months then you lose the 100% rating. If you were 100% P&T before your cancer you won’t lose that.

I recently was awarded 100% P&T. I started intent to file in 12/22 for left hip pain secondary to bilateral TKR.. I had total hip replacement 10/23. Finalized claim in12/23, Was awarded 20% for hip pain in 4/24. Didn't get convalescence for surgery. Immediately filed for increased rating for left hip pain. Was granted increase that put me at 100% P&T, but still no convalescence for surgery. Concerned that if I file supplementary claim for convo of 5 months they might change rating. It' leaving $10K on the table. Yeah QTC did my first C&P exam, QTC did the increased rating C&P.

If you wont some fun information I could give you names to double check. VES is using nurse practitioners who have all online degrees, including some people who have worthless medical degrees from places like Montserrat etc.. If you want to have fun, start looking at the the qualifications of these people the VA is approving for the C&P exams. PACT team said my heart and other issues are military related, per C&P exam it isn't, even though I was in a unit exposed to (transported) Sarin in powder form etc..Hell trust me I haven't said I am okay for years when I go into the VA. Hell I have heart problems and my VA doc, despite the fact I have had cardiac surgery, kept telling me it was in my head until WRIISC told them to start getting me into more tests. Despite heart conditions, endocrinological issues related to chemical exposure, a tumor under my brain and more, they gave me 10% for each leg for pain. It honestly, as a vet just makes you feel like you are an inconvenient bit of rubbish, and does not fan the flames of patriotism, within your heart.
