Also, when sampling Music there is no 30-second rule. And because it is still music and not a parody it's not transformative, you might eat into the original artist's profits, so it is not fair use. You have to ask yourself ''is it fair?'' and ''How would I feel if someone did it to me''

The law does not ask if it was fair or how an individual feels if it happened to them. That isn’t how copyright law works- and Thank GOD lol. I feel your comment infringes my creativity. I’ll see you in court :P

The entire legal systems in all forms are an absolute game. And i mean they are as relevant as a game of tennis in this world. And they are as criminal as this world can get. Playing within them, well I'm sure you can join the dots.

Professor of Rock 🎸 told Tony Hadley that I Want It That Way (written by Max Martin and Andreas Carlsson) has a descending scale ⚖ which matches that of True (written by Gary Kemp, performed by his ex band Spandau Ballet, which Hadley was the lead singer). No word if Kemp will demand royalties from Martin and Carlsson.

The music publishers will inevitably devour the entire industry because even at this point, there is nothing left but bones for them to pick over. It’s rather ironic in an era where it mo longer requires talent or skill to make music.

There is no license for study or education. Where were the major labels and artists when Berkley held seminars covering an entire artists discography, analyzing it. Dissecting it. Teaching how to produce with those techniques. We already have all the copyright laws we need for wav masters. Which is all Ai outputs. If it outputs something infringing, you’re already covered. Do not be fooled. The major labels are throwing a tantrum cause they think they can get a ton of money and want to use this tech exclusively. Suno admitted they trained off pretty much every song online. If there was a class action every artist in the world would get $1.75. Nobody is thinking practically about this and just reacting off emotion and trends.

I feel it would be super helpful when you talk about “taking from the song” if you would make a clear distinction between taking from a RECORDING of the song, as DISTINCT from making use of the written melody or the written lyrics of a song. Of course both are copyright infringement. I would benefit from some clarity on how the process of compulsory licenses work for a cover songs.

So an example of interpolation would be Bryce Savage’s “Slayer” when he’s singing his song and alluvasudden he has the melody and lyrics from a line from Pat Benatar’s “Heartbreaker” then back to his original tune.

Question: Just to understand that right. If I want to take, let‘s say the melody of the chorus line of another song, and I incorporate it into a brand new song, then I need to get a license, right? And where do I get that from?

From the publishing company that owns the song. If the composer is not signed to a publisher then you should contact the composer directly.

You also need a license if you're taking someone's Melody, regardless of sampling . The definition of interpolation he reads out in his video is wrong in my opinion. Certainly in the legal sense. I've known it under for the last decade. There's no such thing as an interpolated melody which is identical, because that is composition / publishing copyright infringement. Interpolation to me has always meant the altering of an idea, both recording and composition.

So I am assuming you mean that if a heavy metal song was covered by a symphony, that is allowed (different genre, classical instruments) and the original band would get the automated mechanical credits collected by BMI (if applicable). Transformative copy right would be say mixing a Neal Pert drum solo on top of a Stairway to Heaven song resulting in a mix nobody would want to listen to, but might be a proof of concept. Transformative copy is very opinion based - and probably sometimes a waste of time. College Humor channel used to do some parodies of artists that were not complimentary - which of course is the definition of a parody and why it is allowed (not the same value) and it likely is viewed as critical free speech (protected). So you can not say what you want along with a protected melody without a license? Nah, that does not violate the First Amendment, what on Earth am I talking about? Interesting. The sync licensing discussions are pretty nice on your channel, the artists have looked at the big picture and put it out there 'here we are' you can license easily from us or have fun tracking down and groveling to someone else who may or may not waste your time if you ask them? Makes me wonder if I even want to do EDM music without hiring Perry Mason to narrate my documentary of the recording process. If the melody is recognizable to an artist, I would suggest the mechanical cover license could go to that artist without a fuss if you change the lyrics, although it would be worth your time to get a license and possibly get rights to make money. Opinion? The song lyric "Die MF Die" changed to "Live in Bliss to this" to the same melody sounds pretty transformative to me, would not hurt the original artist since it targets a different audience and would not effect sales - and I would quote that explanation word for word in the US Copy Right Transformative Fair Use application description box on the form. If they say no, I am out $200. If they say "right on brother, here is your registration number" somebody is going to be pounding sand? Lol, I would not do that, I am a different person than I was a few years ago. Suggesting something like that might give you leverage in licensing, but the one thing that is a constant drum beat in this business is make friends. Small world. Offer to help unload that drum kit from the parking lot to the stage, or what ever else they might need so people like having you around them because you care, but are not groveling. Be nice. A lot of people do not make a fuss about copy right either assuming they get mechanical rights or they just want the free marketing of their melodies as people eventually identify them. Have fun whatever you decide to do.

Well then it seems all music is interpolation. I mean that’s how you learn how to play - with other people’s songs and chords. So new songs are just interpolating what came before.

No offense but it often seems like the lawyers, business execs, and politicians who draft and pass these laws don’t understand or appreciate the creative process that an artist goes through to make an original creation. They seem to have decided on behalf of others that if money falls into the “right” hands, then it’s “OK” for someone to commandeer someone else’s art and profit from it. Seems warped.
