It's a Leaky, Leaky Situation

The plaintiff claims the defendant had his truck for three weeks and was supposed to repair it, but he didn’t, so the plaintiff is suing for a refund. The defendant insists he fixed the plaintiff’s truck properly, and when the plaintiff’s vehicle started leaking, the defendant told him to bring it back in. The plaintiff reportedly refused to bring the truck back in.

The plaintiff gave his car to the defendant twice for a total of 30 days, and he couldn't be bothered in that time to troubleshoot all the possible reasons for why it might leak? He shouldn't be surprised he lost. Also, the warranty should definitely be on his bill, not just on his wall.

Why isn't the legal default position when no warranty is listed, that there is NO warranty. A good mechanic will check Everything when a vehicle comes back for the same reason.

Because in the US, we want to protect consumers at least sometimes. There’s an implied warranty in many services that the consumer will *get what they pay for* . It’s like consumer protections for purchased goods/items under the UCC.

@@supportvawa2213 Here reports say 29 in New York State and 48 across the country. We have had a couple of deaths on the road and 3 drownings in Victoria, I don't know how the other states are going. Christmas can be a joyous time as well as a sad time, we are all trying to enjoy the holidays, but we often let our guard down or suffer from fatigue.

It should be less than 30 minutes to check the PCV valve on that model. If you're jumping right into the main seal without checking the valve on the 2nd try that says to me you didn't have faith in the mechanic that did the work or the seal used the first time.

The defendant said that he had a notice warning clients that it's only a 30 day warranty and although he seems to be at his work, he couldn't even provide proof of that. He really had no excuse for not repairing the man's car, nor for giving him back his money...

Old seals get brittle and wear grooves into the crank. Next tech will have to sleeve it and replace the seal. An extra $20.00 to do it right. PCV do not blow out gaskets unless your revving it high all the time with a clogged breaher. Bad tech......

That or more likely it leaked because they didn’t line it up right when they installed the seal. Then were too rough when they matted the trans and engine back together. If it’s a pcv problem then you won’t have just one seal leaking over and over. It would be blowing out multiple seals and gaskets. Plus probably fouling plugs and all sorts of other stuff.

@@hankrhill324 well from my experience with seals i have found that u almost always have to get them from the dealer because the aftermarket will be a little bit off and with oil seals u cannot even be a little bit off or it will leak all over the place .

That is clearly a poor businessman. He doesn't stand by his work, he didn't check or troubleshoot anything, blamed the customer for not brining it back AFTER the customer already brought it back twice and they had the car for a month, and doesn't seem to give a damn that he did a crap job.

Most mechanics use aftermarket parts..that's why the dealer is the expensive place to go..

@@marleonetti7 I've dealt with many seals where the OEM part is 10x the price of aftermarket. Altho the OEM seal is almost always of great quality, sometimes an aftermarket seal is better.

Adrian...every car I've ever had has been used. And...had no problems because I've done my homework. The last car I owned, a 1994 Acura...had it for 18 years...best USED car I've ever had.
