"The real estate development firm partly managed by the sister of White House senior adviser Jared Kushner has issued an apology over a weekend event in Beijing in which Kushner’s name was used to attract wealthy Chinese to a cash-for-visa scheme commonly used by investment-hungry U.S. real estate developers.
Kushner Companies “apologizes if that mention of [Kushner] was in any way interpreted as an attempt to lure investors,” the company said in a statement emailed to NPR and other news outlets. The apology stops short of admitting that the company was leveraging Kushner’s role in the White House and his relationship to the president, his father-in-law.
Nicole Kushner Meyer, Jared’s sister and a principal in the family-run business, was in a ballroom at Beijing’s Ritz-Carlton hotel on Saturday asking a roomful of wealthy Chinese investors to consider investing $500,000 apiece in a New Jersey luxury apartment complex overlooking the Hudson River across from lower Manhattan.”*

Jillian Perrin Promoting for visas is quite legal, immigration lawyers do it all the time. The only thing that could get in the way would be the "Title of Nobility" clause of the US Constitution (aka The "Emoluments" clause); but it clearly states that you cannot accept gifts or profit from foreign entities with out the consent of Congress. Since one political party controls all the branches, they are giving passive consent (e.i. "we won't say anything cuz your on our side").

denise k Nope, EB-5 is quite legal and the easiest to get, if you have the money. It's on the highest immigration preference the USCIS has and advertising for it is quite legal too. Just to put it in perspective, to reach that level of preference you would either have to be a PhD, MD, or a leading researcher (no one advertises for this one), or be married to a citizen (no need to advertise everyone knows about this one). Add on to that, that you can literally get in the minute you present the money (waivers and what not) and you can literally BUY the US citizenship.

As someone who got my visa through EB-5, I cant complain~ My parents are not rich tho, they borrowed that money from friends and families for me to have a better future in America, I graduated from UCLA top 2% of my major, and now I work for a SF video game company, I love American culture as you can seen from my avatar. For Chinese people EB-5 is the most reliable way to legally work in the states, other wise its completely depended on luck ( Right now its basically a 20% lottery system ), I dont understand why you guys would love to protect illegal immigrants but somehow hating on people who got into states through investments and legal channels, EB-5 helps and stimulates the US economy, and it helped me to achieve my American dream....

It's a little harder than just spending $500k. You have to present a business plan that has to be approved by the Feds, employ at least 10 people then once approved it has to survive a year or more before it becomes a path to citizenship. So, they do create at least 10 jobs for a year even if the whole thing fails.

That investor visa has been around for a long time. It basically says you have to give 250-500k into a bank with "intent" to make a business. So its a freebie to the banks. In IT, I work with many Indian co-workers. One told me how its common that families pool money to give one relative US citizenship. The new US citizen provides help for $ for other immigrants (thus creating IT contracting firms that hire only Indian), as well as demands a high $ tribute for an immigrant bride. I guess the first is technically creating a business, but it's basically indentured slavery. The Indian worker not only makes low wages, but had to pay for the privilege for that job (at 5k to 20k), as well as make 25% to the firms 75%. Modern slavery.

IMPORTANT...Cenk: EB5 is intended to create permanent jobs. For every $1MM investment (& visa), 10 jobs must be created or maintained (that would otherwise have been lost). In economically challenged areas, "targeted employment areas", the required investment is reduced to $500K. What jobs are created in an apartment building...the manager? the maintenance people? If the Kushner Company accepted $50MM in investments under the EB5 program, they should have created at least 500 jobs. How the hell do you create 500 jobs in an apartment building? 500 maintenance people? Since the construction itself does not count, this is almost certainly a total scam!

This is likely a dead story, as this whole selling citizenship to wealthy foreigners has been used for years by US real estate companies to motivate sales. The only potential ethical issue is if the sister had previous knowledge she should not have had of future US regulations, which is not made clear based on her words. So an investigation into the sister would be warranted, however that is pretty much it at this point in time.
