But they were parked in a space marked "no parking" see the crossed lines? This indicates that space is not a valid parking space, because of the layout of the lot, they keep that space open for larger vehicles to make the turn around in the drive thru lane. So actually if they get towed for parking there it's perfectly legal. The fact that they got towed for being their for only 15 minutes might be immoral but not illegal.
@JoeyCap.6 жыл бұрын
@@corbingarrett1206 I don't know what you're looking at but I clearly seen White Lines marked for parking , as well as a very obvious handicapped spot clearly indicated as plain as day... as well as a very illegal recorded physical act of him trying to tow the vehicle while the car is parked in the handicap spot for less than 15 minutes This is just wrong on so many levels.. it makes my head spin

@@JoeyCap. looking at it again, the back quarter of his car is in a no parking zone, the front half of his car is parked long ways in 2 different parking spots. If that doesn't fit the definition of "illegal parking" I don't know what does. Like I said this may be immoral and I'm in no way trying to defend that, but if he parked in a similar matter the day he got towed, that's pretty damn well "illegal parking" they probably are running a racket, but when someone parks like he did, he's not really in the "right" to complain about being towed because he was parked illegally.

I was a tow truck driver for three years before becoming an OTR trucker. When we towed abandon vehicles off of business property we had to have a permission release form filled out and signed by the owner or the manager of the property or we could not touch the vehicle legally! We also had to legally present a copy of that form to the owner of the car when they came to pick it up! That may vary from state to state but I can't see it being much different.

i had the same experience at another mc Donalds in the south bronx(new york city). I walked into an adjacent empty parking lot of a recently-out-of-business diner to smoke while my buddies who rode with me in my car, were inside the McD's eating the food they had ordered. I walked barely 40 feet - out of courtesy - so I don't blow cigarette smoke in the McD's parking lot into the faces of drive thru customers !!!! Less than 2 minutes later, this tow truck guy comes in and tries to take my car !!! I warned him and he wont listen ! Then I walked in to the restaurant and complained to the manager and pointed to my friends sitting at the table, eating what we ordered, and my sandwich and drink !! then the manager calls the tow company and asks the guy to bring the car back. It all made me so angry. Then I called the corporate HQ of McDonalds. I got feedback from them 3 weeks later that they fired 3 employees, and the manager (all spotters working for the tow company) and also got a restraining order against that tow company. They now have another tow company working there that follows certain rules before towing cars ! The rules they mentioned are : 1. ensure that a car is actually parked illegally - a person parks, and is gone from the lot for more than 40 minutes, and then, if the person does show up while the vehicle is being hooked up or towed, but hasn't left the parking lot, then release the vehicle with no charge. They also said this new towing company charges a reasonable $40 a day lot fee for towed vehicles in their possession.

This towing scam is common all over the united states. Especially in apartments. I was a victim of this years ago. Cost me 350 to get my car back. The lady at the tow company was behind bullet proof glass. What does that tell you. My neighbor told me it was 100% OK to park in his parking spot, mine was full with another car. Then i come back the next day to see my car gone. Keep in mind we do not have badges or car numbers or anything to verify what car goes where. I then find out it was towed and the tow company told me that they do not give info of who called in to tow my car. My neighbor said he never called anyone. My guess, the security guard for the apartment complex gets a certain percentage for each tow he calls in. This has been going on for years. Many tow companies are doing this scam "legally" and screwing people over. Which means thousands of people employed for these security/ tow companies know exactly what they are doing. They are straight scamming people out of their hard earned money. These people are pieces of you know what and do not deserve to be employed. If i knew where to report this higher up i would. And i mean above the police which will do NOTHING like usual because the tow companies have the law on their side. Anyway this is a serious issue that needs to be investigated.

I completely agree with you, however there is a grey area in his case. The car he was driving was a rental. While he was in lawful possession of the car, he is still not the registered owner. Does this make this companies practices legal?? I doubt it very highly, but it is certainly not fair especially after the car had only been in the lot for no more than 10 minutes. NEVER NEVER pull your car off the truck. let them do it, if they say no, tell them its a safety liability for you because you don't have the proper training. if they say no still call the police and inform them that they are attempting to force you to perform a dangerous act. They do this to trick you into an insurance claim. they will either claim you for damages to the tow truck, or if damage occurs when you're pulling it off, they put the blame on you.

They should have called the police when their car got towed for pretty much no reason. I would have even had a police officer present when you go pick up your vehicle just to have a witness. Unless the police in this city doesn't give a shit about stuff like this going on... Then that explains why it keeps happening.

joemann7971 didn't they say it was Detroit, they probably didn't want to wait for the police, who would probably tell them to fight it in small claims court, probably why he started filming the guy refusing to unload his vehicle in the first place. perhaps if it was not a rental and in his home town he would have done things differently.

BearNDragon Yeah, it's in Detroit. I'm not talking about the guy filming, but just in general. I mean, this guy probably made more off the monetizing the video than he lost paying those crooks. Funny story about the same scenario. A good friend of mine's uncle works for the state dept that licenses these trucks. Its not Michigan. I was over one time when his uncle dropped by and he told me him and a coworker went to Burger King and he comes out and the car was on the tow truck. It was a state owned car by the same dept that licenses the tow trucks. His uncle basically told the tow truck driver that he wasn't going to say who he was but if he doesn't unhook and drop the car, the business will regret it deeply. The tow truck driver told my friend's uncle to f*ck off and drive off with the car. So he tells me the next day, he shows up to the towing yard with his boss, an investigator with the dept of revenue, and the state police. They walked right in, informed them they were pulling their state license to operate, seized all the tow trucks and put them on tow trucks, arrested the owner for tax evasion and fraud, and arrested the tow truck driver for auto theft and theft of state property. Then they locked the placed up and called it a day. Michigan tow truck drivers must not have a lot of oversight from whoever licenses them. Some states don't play around with this type of stuff.

Call the police (yes it takes time) to have them meet you at the tow Yard to get your vehicle. A report is made and the tow company then can sue you. Meanwhile look up your counties maximum toe charge. This also applies to mechanics. ONLY state and federal can "impound" your vehicle. No personal or corporate entity can hold your personal property. After the 10 minutes, you have to come back take another set of pictures with time stamps and then you can pick up the vehicle and have the property manager sign a paper authorizing the tow.

Hey Jason and Em! My family and I are tow truck operator's and owners. What happened in this video is ILLEGAL!! I don't know what your follow up had been, but you need to peruse it. AAA is a separate entity from this towing company and if they haven't already been informed you need to let them know. They'd be furious over the way this company is conducting itself. AAA has a rating system of who they give calls to. Our company is in the top 20 in California. We worked hard for that endorsement. If you would've been parked in the McDonald's parking lot for over six to eight hours? Then yeah, maybe you could've been towed. Key word, emphasis on Could Have. I'm implore you to see this through. Even if the McDonald's/tow company followed their 30 minute rule before towing, who would ever think they had only 30 minutes in the lot? After walking in , waiting for your food and bringing it to your table, eating, maybe going to the restroom, it would take most customers more than 30 minutes. This is clearly a scam and McDonald's should know it. Outrageous!!!!
@FlanneryYT6 жыл бұрын
Well, 30 Minutes from the time you get your food is fairly reasonable (which, 9 times out of 10 when a company has this kind of policy is what they do). The problem is only if they note the time you pull in or place your order as being the "top of the clock". The policy in and of itself is an anti-loitering policy. Some people will go into a store, buy a $1 item, and then just wait around for an hour or two because they have nothing better to do. This helps cut back on that to free up parking spaces for actual customers. As long as they have signs clearly marking the lot as such a location, they haven't done anything wrong. Another problem is when (like at this location) you're not even following that policy and towing after 15 minutes.

As of September 25, 2018, from the Metrotimes News: A Detroit towing company that has come under fire for its aggressive tactics and $400-plus cash-only towing fees is now facing a class action lawsuit that alleges it routinely engages in "illegal, predatory, and rogue practices." The suit filed Friday by attorneys with the Truth2Power Civil Justice Fund alleges that Breakthrough Towing violated state towing laws by hauling vehicles from private lots without proper permission, refusing to release vehicles to owners who showed up before their vehicle was towed, and failing to notify police before removing vehicles. Breakthrough Towing was recently the subject of a viral KZbin video that purported to show the company trying to tow McDonald's customers legally parked outside the restaurant's location on Woodward in Midtown. The allegations detailed in the suit plus a handful of additional horror stories shared by Breakthrough victims with Metro Times together paint a picture of an operation so aggressive that it easily catches people parked legally, taking their cars regardless of circumstance. As one of the plaintiffs in the case says she was told by a driver - "once he was dispatched, no matter if the car was hooked up or not, he had to take it." Once caught, vehicle owners can be robbed of a week's paycheck almost instantaneously, forced to pay cash for tows starting around $400 with additional fees tacked on for inevitabilities, like having to retrieve their vehicle registration from inside the car. The company appears to rely on "spotters" for alerts when a car has been parked too long (it denies this, but we've seen people stationed for hours at a time outside at least one of the lots from which it tows) and keeps its trucks idling throughout Midtown

This is called racketeering, in case there is any question of it. This activity is very rampant in South Florida, especially around the Miami area. This is very profitable, as these companies are often "all in the family" operations with collusion and shadow ownership going even up to the highest of politicians and other "government" officials, active or retired. Municipal contracts are often awarded through no-scrutiy, no- bid contracts using obfuscation to hide the true structure. It would appear to only be getting worse over time, as well.

The key allegations were unauthorized use of AAA’s emblem to the public." I will further note the case was decided in January 2014, with the first cease and desist notice by AAA being issued in 2011. Here we are, seven years later and the trademark theft is still blatant in utter defiance of the Federal courts.

I have been to this McDonald’s, and walked out of the McDonald’s to the car gone and towed. @xxBEAUTY111xx6 жыл бұрын
I beg to differ. However, everyone is entitled to their own opinion. The types of people sitting in their parking lot, towing people who ARE eating at the McDonalds, is unquestionably wrong. With no probable cause of towing each car that comes in there, it seems as if there is some illegal activity going on within Breakthrough towing that comes into the private property of McDonalds; especially if McDonalds had not ordered for each car to be towed. Also, while sitting on the side of McDonalds I witnessed a handicapped man go in and order his food, and coming out to his car being gone. This man was disabled with a handicapped sign on his rearview mirror. What was he violating? Absolutely nothing. The man later explained that when he was on the phone with Breakthrough Towing, they could not give him a price until he came to the towing yard the next morning. He called again and the towing company told him a price of $575 for it to be removed from their lot. This man CRIED because he could not even afford the rent payment for his home. If this doesn't stand out and show the level of disrespect and illegal activity this towing company is doing on a private property, then some changes need to be made, and Breakthrough Towing needs to be shut down. But like I said before, everyone is entitled to their own opinion.

Me and a good friend of mine decided to go Detroit to enjoy the weather and check out the city. We stopped at McDonald's on Woodward. Parked in the parking lot for McDo and went inside. With the drive being over an hour we had to use the bathroom. The men's bathroom was locked and we both had to use the restroom. We had planned on sitting down and eating but we had to use a restroom first. Apparently at this McDonald's you have to be "BUZZED" in to use the restroom. No sign letting us know that at all. So naturally we had to find the closest restroom. Next door happened to be the closest one. We leave McDonald's to use the bathroom at HopCat. We both use the bathroom and head back to McDonald's to eat. Keep in mind this took maybe 5-7 minutes to do so. As we are walking back there we look over at my car and we see a tow truck getting ready to hook up my vehicle. I flip out and run over to him. I say “Sir I'm at Mcdonalds” and explain to him that the bathrooms are locked. He says “you have to be a patron of Mcdonalds”.I said “we are”. “We just had to use the bathroom”.He says “it's too late”...He says “go get the manager from mcdonalds”. I go get her and she is no help as he continues to chain my vehicle up. At this point I am pretty angry. So I call the police while he is chaining away. I tell him and he says they already know about it. So I finish up my call to the police and they say they are sending a squad car. I tell the tow guy and he pays no mind that I asked him to wait for the police to arrive. He starts to get the vehicle all the way on the tow truck and we just stand and watch him steal my vehicle basically helplessly. We acquire info and numbers and addresses. So we know where the car is going, price, time etc. Tow guy offers no info but to call the number on the truck. I do that. The lady on the phone tells me it's $395 to get my vehicle back and they open at 9 am. It was currently 9pm and we don't live in Detroit sooooo... At this point what are we going to do? We are stranded... The tow guy finishes up and does a really terrible job loading my vehicle. My front right tire was on top of the side railing! EXTREMELY DANGEROUS! Not only for my vehicle but for him and all people on the road!!! He asks for my keys. I said no way am I giving you my keys. You just stole my car!!! He says “We are not liable for any damages that occur with your vehicle”. He drives away... My vehicle is ready to basically fall off the side off the tow truck.... At this point me and my friend have no clue what just happened. Luckily a nice young lady asked us if we needed a ride. We said yes and quickly thought of where to go. We had a few choices. Walk the streets all night till morning. Get a hotel. Call for ride back to Toledo. Uber etc. We decide the easiest thing to do is hit the casino all night till morning. That is what we did. So we waited till 7 am and called BreakThrough. It states on there online presence both 24/7 and open 7am to 7pm. Neither true.... Opens at 9am. Keep in mind we walked from MGM to their office. Got there at 7 am no one there. Ok so 9 am it is. We are exhausted by this time from staying up all night and walking. We go to Burger King to pass the time to 9. 9 comes around and we are ready to get the car and drive home. Praying the car is not damaged from the way he loaded it up. We get inside and see the sign that says cash only. I didn't have $395 in cash So I had to go to the atm at the gas station next door. The atm only allows $200 to be withdrawn at one time... I had to draw out twice to get $400. That's 2 charges from the ATM and 2 charges from my bank just to withdraw cash! Walk back over to get this nightmare over with. Guy at the counter tells us he needs license, registration and proof of insurance. Ok cool. I have all of that. Except my registration being in my car for legal reasons of course. I find out that it's $25 more because it is in my car and not in my wallet!!! Who has their registration in their wallet?!?! I hand over $420 in cash. He gives me a receipt. I asked him nicely can I have a time when the tow guy picked up my car. No time on file.... At this point we are exhausted and still need to drive home from Detroit to Toledo. He says “do you guys need a ride to the yard to get your car?” Yes I said not even knowing where it is!!!! Tow guy comes and brings me to the car yard about 4-5 miles from the office. We get there and it is a straight up JUNK YARD!!! The tow guy had to pull a smashed rusted vehicle out of the way so we could get in there. I'm soooo mad at this point! My vehicle is laying in a junk yard over night in a field of rusted metal and overgrown grass and weeds and garbage everywhere!!! I'm guessing my car is totally messed up. Thankfully it had no issues or dents or scratches from what I noticed. Very thankful of that blessing. Look I get it... People park at McDonald’s and go other places and should get towed. My situation was not that. No understanding and inhumane. It’s not about the money they stole from me. It’s a moral issue on their part. PLEASE SHARE! Let’s keep these businesses...OUT OF BUSINESS!

What they are doing is considered auto theft in the state of Michigan. Not to mention the bribes that the manager is probably getting to be complicit in such a scam. I live and work in the Detroit area and have worked as an investigator and seen such schemes but never one quite this blatant. Being in Detroit, they're very lucky somebody hasn't been shot yet. My next question is is if it was a rental vehicle that was stolen why didn't you just call the rental company and say the vehicle was stolen it was stolen by this company and send them to pick up their vehicle and bring you a a different rental vehicle. Tow companies have been ripping people off in the Detroit area for at least 20 years. Everyone complicit in these crimes should be jailed for a minimum of a year. That includes the tow truck drivers. Because they have to know what's going on if they've been there more than twice.

There is no reason to cite a blue truck going down the road. It could have been coincidence but it is likely that he is a "spotter" for illegally parked vehicles. These cars WERE illegally parked partially blocking a lane of traffic that goes around the drive through lane and also accesses a second drive through order window. The paint was faded but the areas was marked with white angled parallel lines that mean no parking. The legal handicap parking space is closer to the street. There are no marked parking spaces in this area. The video poster is parked across TWO legal parking spaces. The only thing I don't understand is why didn't the tow truck driver tow these vehicles.

You are correct that the paint should be corrected, but I think since there are no parking spots marked in this area it would be a clue. About the handicapped lady There is some confusion caused by the fact that is a slightly earlier part of the Video, it DOES show a car legally parked in a MARKED handicap spot. Notice the hubcaps design. Later the shot is about 100 feet deeper into the parking lot and the handicapped lady's car is similar, but different. Hubcap design is different including a missing right front hubcap. Also the spot she is in doesn't have the blue lines and handicap icon. This car is parked in the no parking zone.
