Madam, that court has no jurisdiction to rule on d suit with documentation. They sworn in affidavit to have defected to APC and each of d legislators submitted letter to d Speaker of their individual defection. What evidence does court need to rule on this matter?. Evidences are there to see for any court to base their judgement. Someone went to public domain to tell people that he killed his neighbor and he also went to court to obtain affidavit to confirm that he really killed his neighbor. What evidence does court need to rule on d man?. We dey watch Nigerian judiciary for their abracadabra.

Matters in court are better discussed and analyzed by the professionals. But I'm happy that the Assembly Members in Rivers State are caught up in the web of their mischief and shenanigans. If they are honourable men and women, men and women of integrity, and are convinced their action in terms of the now botched attempt at defection is justified, why are they pretending and trying to hoodwink that they are still members of the pdp. I find this appalling. Being very smart, Gov Fubara has effectively held these shameless, unscrupulous elements in the court of law interminably whilst he governs the State. Their misbegotten defection agenda having gone awry, they themselves are in a quandary. It serves them right! Presently in Rivers, it is the forces of godfatherism, of dictatorship as represented by the imperial Wike locked in mortal combat with the forces of liberation and democracy as represented by the governor and the people. From all available indication, Wike is losing whilst Fubara'power is on the ascendancy. I maintain that godfatherism is a plague in a democracy, as debilitating as bubolic plague. It is also a curse. But I'm happy the governor is dealing with the challenge in an impressive manner. By keeping Wike away from the Rivers treasury, Gov Fubara is now able to achieve significantly on behalf of progress-loving people of the oil-rich state in the Niger Delta.

Make no mistake. The Judgement of the Appeal Court is only saying that State High Courts do not have the power to make pronouncements on vacancies, and this means ALL the States High Courts in Nigeria. The Appeal Court did not, and at no time, say that the former rivers state legislators seats are not vacant, per the constitution. This constitutional infraction cannot be remedied or cured. Please, show me in the Appeal Court judgement where it says the former rivers state legislators seats are not vacant, per the constitution, section 109.

The state high court judgement that declared their seal was Nullified, and the entire decision to declare their seat vacant was STRUCK OUT BY THE APPEAL COURT...true or false?(2) Now when a case is stricken out by an appeal court, the issue in contention returns to staus quo before the case was filed.....moreover The federal high court judgement that Amaewhule and Damagun filed and won categorically mentioned that they are still members of PDP and that fubara and co was unable to prove their defection case via exhibits like party registers And the Appeal court upheld the decision of the high court that made pronouncement that fubara could not prove defection case (I knew that your ears are blocked right now while reading this) And ....

The Appeal Court ruling should be appeal to the Supreme Court for clarity as to the Power of state high courts to entertain cases of vacancies. Even with a Supreme Court ruling from this appeal, the former legislators seats would still be considered vacant. For the former legislators seats not to be considered vacant, the Supreme Court would have to rule on section 109 of the Constitution related to the former legislators seats being vacant, that this section should not be applied to the former legislators.
