I didn’t like the Supreme Court’s decision in favor of the State of Washington in CHIAFALO ET AL. v. WASHINGTON. I found the reasoning in the 7-justice majority decision tortured and absurd. I did find the minority concurrence by Justices Thomas and Gorsuch well reasoned (based on enumerated powers, plain English, and the 10th Amendment) and surprisingly solid, even if I didn’t like it. I say “surprisingly solid” because I completely didn’t anticipate such reasoning after older rulings about state restrictions on who can run for Congress, not because I doubt the intellects of the justices. The silver lining of CHIAFALO is a gift it presents to state legislators by notifying them of powers that they already had and probably didn’t suspect they had. The SCOTUS majority ruled that states can hold electors accountable for their votes and replace or punish the electors if they do not vote as expected. Electors don’t even have to pledge as a condition for running for elector to be subject to such sanctions. Thomas and Gorsuch concurred in this particular case with different reasoning, but might not in another. It’s been ruled that states cannot place additional restrictions beyond what’s in the federal constitution on who may run for Congress so adding an oath or pledge isn’t possible like it is for electors, whose manner of selection have explicitly been left to the states. Yet, US senators and representatives do swear an oath to uphold the constitution. States could pass their own versions of USC 18 §242 to punish government officials who violate that oath by violating or attempting to violate the federal constitution, an agreement to which the states are parties. The states cannot constitutionally recall violating US senators and representatives, but they can fine and imprison them. That means they cannot attend votes, potentially to violate the federal constitution more. That would mean less representation in Congress unless the respective house expels the convicted member so a state could replace the convicted member. Temporarily less representation is a small price for bolstering the constitution and individual liberty. Besides, no state should want continued bad representation. While neither of these scenarios are spelled out in the Holy Scriptures, the principles, at the foundations of these rights, are clearly contained within the Bible. There was a reason why the Old Testament accounts for cities of refuge. I do not condone blatant violence, but I 100% know God has given me a RIGHT to defend myself and my loved ones from blatant violence. Christ NEVER sinned and yet expressed a violent action by “casting out” the money changers. Christ was defending the temple. Stephen lay his life down for God, and perhaps we Christians may be required to do the same in our walk of faith.
