Yes, but tro what end. I've been binge=watching these clips of late. The common theme seems to be that the senators have very little time and at the end of their time, that's it - they move on to the next senator. Nothing seems to come of their questions. The the KZbin comments are filled with "Send [the nominee] to Jail" remarks. It all seems pointless.

@@PFirefly06 I haven't rewatched the video since my original comment over a month ago but I think the nominee may have briefly mentioned that the family agreed to the plea deal. Even if my memory is mistaken it's now standard practice and/or law in every jurisdiction I'm aware of that the prosecutor must seek the views of the victims and their families before making a plea deal, though this input is never binding.

If it was her mother, she wouldn't have been allowed to preside over the case. Sometimes prosecutors bring cases on flimsy evidence. Or witnesses disappear or stop cooperating. The prosecutor can either drop the charges and maintain a "perfect" record of getting harsh sentences or he can negotiate a plea.

I mean, lets be fair. If it was a negotiated sentencing the likelihood of it is that the judge had probably little choice in the matter. Even though the judge has the jurisdiction to deny the plea deal, the real fault lies in the prosecutor, who either had a weak case in front of a jury and felt the need to bring the plea deal forward in order to secure a conviction or the prosecutor just did not care enough.

The nominee said that the prosecutor told her the government could lose at trial due to problems with the evidence. The judge was left with two bad choices: 1. Accept the plea bargain and give a light sentence for a heinous crime or 2. Reject the plea deal and have the government proceed to trial, risking a finding of not guilty (and thus no punishment at all), if the evidentiary problems caused the case to collapse. It is a terrible situation to be in with no good answer.
