I’ve skipped too many Contract law lectures to give an opinion. It’s the background stories that interest me here; why did the seller change their mind on the deal and did some professional not do their job to tie down without doubt such a large deal.

The auctioneer in this case was exhibiting some sketchy behaviour, the first reports of this case suggested that the other bidder in this, Monty Regan was not asked for his final offer before Magnier claimed the deal was done.

Contract law ,is driven by how much money you have,on the face of it magner has no case,he did transfer 15m byt that does not bind the seller,auctioneers deposit is not binding, but the more money you have the more arguing power it will be interesting to see if the strict interpretation of law is applied !! Or like the vulture funds and the judges contract law is bended or just ignored !!!

Land contact law is a matter of written note signed by the "party to be charged".

I sense, it's a little bit more complicated as you say because it's now a company I gather probably a limited liability company. I want to whether this might enter in to realms of company law and Maybe contract. In any event, it was ready require evidence in writing where both parties agree to form of agreement unconditionally.

This will be an interesting case and eventual judgement. Any experience I have suggests that Auctioneer's memo will not carry it through. The existence of a much higher bid adds another dimension.
