The defendant will be advised not to take the stand in 99% of situations. It almost always hurts your case unless you're really good at answering questions in cross-examination (most people aren't). It's better to not even bother with it as opposed to taking this big risk that can kill your case if the jury gets the wrong idea about you. Even if you have legit answers to most of the questions, they can still think you're a bad guy if there's something they don't like about your tone or demeanor (like seeming too cocky).

I agree with Korey for the most part but the sentiment that Majors should be left off the hook because Mel Gibson was is pretty misguided. Mel Gibson should very much be held accountable for that as well and not work in hollywood either, saying the opposite and that anyone doing things as bad as Mel Gibson or slightly worse would be left off the hook would have a very toxic spiral effect that would have a lot less accountability which is the exact opposite point to what he's trying to make here. It's like when people were saying that Ezra Miller's off the hook so Majors should be too...how about just calling out WB on that bs and pursuing Miller being accountable instead of letting more of these nutjobs do what they want?

It was also a conviction of reckless abuse but that was due to her finger being hurt as he was running away i think. But regardless headline will read convicted of assault and no one will care to look into it.
@adamsimon822010 ай бұрын
That’s incorrect. He was found guilty of third degree assault. The relevant statute reads: “A person is guilty of assault in the third degree when: 1. With intent to cause physical injury to another person, he causes such injury to such person or to a third person; or 2. He recklessly causes physical injury to another person; or 3. With criminal negligence, he causes physical injury to another person by means of a deadly weapon or a dangerous instrument.” The only prong of the statute whose mens rea could be read as “unintentional” in the everyday sense is the third prong, and he evidently wasn’t found guilty under that prong (there was no deadly weapon involved).
@JB-sc1tg10 ай бұрын
@adamsimon8220 You're wrong. Prong #2 uses the word "reckless" which is the unintentional charge the op was referring to.
@adamsimon822010 ай бұрын
@@JB-sc1tg Can you read?--I said "unintentional" in the everyday sense. You know that the legal definition (either CL or statutory) of what is "intentional" and what we would call intentional in the everyday sense differ from one another, right, and quite often come apart? (Literally, the first day of a Torts class with Vosburg v. Putney.) What's more is that this is a criminal case, where the divide between recklessness and our everyday notion of "unintentional" is even more pronounced. What the OP is trying to do is say actually read something that they haven't read in an effort to downplay the charges. To the extent that the media is playing up the charges, it's ordinary media distortion because Majors is such a visible public figure. Surprising to me, since I worried that this would be played into the old tropes of black male harms white women (since his ex was passing). Thus far, it's ordinary stuff that any celebrity would get if a DA decided to pursue charges and was convicted. I suppose that's some progress for us as a society, and helpful to Majors' ex ante since it gives him...a fighting chance of working on something that is not straight to DVD within the next decade. But still no need to lecture people about looking at the charges, while misleading them. It's like, OP, "just watch the video and enjoy the discussion." Also, at-JB-whatever, don't correct unless it's a substantive point and you know what you're talking about.

The footage did not show him grabbing her by the throat. He picked her up and bundled her into to the car. Her team said he picked her up and threw her like a football after assaulting her in the taxi. The taxi driver not only contradicts this but says she was the aggressor. So I don't know why you claim otherwise. Your evidence is a text message and her recording him. However you are ignoring the taxi driver, the other witnesses and the her in the club. More importantly you are leaving out the part where the police stated they had enough evidence and wanted to charge her.

Misdemeanor assault and harassment. Meaning he had no intention to hurt her or harass her, it was an accident. However, their relationship did seem toxic. It wasn't "reckless". Plus, there are people the general public loves today who have done worse with intent and people still love them. Give him six months to a year and he'll be back.

This man down bad for Corretta? I don't think his rizz is strong enough for necromancy! Mel Gibson does a lot of direct-to-streaming movies, so he's *definitely* off the A-List. Jonathan should definitely work on himself, especially the control and verbal abuse which has been too overlooked in this case. He can make a comeback on the B-List.

Honestly i was dissapointed he didnt take ANY responsibility for anything that he did that day whatsoever. Ya u can say i should have left her earlier and shouldnt have been in the car, but fact is he was man. Yes it was probably completely unintentional, probably in a tussle for the phone or trying to put her in the car or whatever. Nobody knows, but im gonna be honest and ppl will prolly tear me to shreds, first time i saw the footage i said to myself the dude did look like he got overzelous when he kept repeatedly shoving her in the car. Im sure it was not his intention to hurt her and it was prolly out of frustration, but he was convicted exactly for that, unintentional hurt. In a vacuum do i think he should be canceled for that? Absolutely not. when u add on comparing urself to mlk and obama, thats when he lost me. Dude, just cuz ur a talented black man doesnt mean ur all that, and then lecturing his partner to act accordingly...it all does paint a picture of being toxic and they both seem at equal fault in the big picture.
