As a reply to the people saying “what about the fact that they are blocking the road? What if an ambulance/pregnant woman is in that traffic jam?” in this instance, this would not likely be a viable defense. What many of you are appealing to, whether you know it or not, is referred to as the doctrine of necessity. However, the doctrine of necessity applies to the individual perpetrator, not a “what if” person. In other words, you can’t just shoot someone in the road because there might hypothetically be someone in danger as a result of the road being blocked, there must be an actual danger that you are aware of in order for that to apply. I know that people blocking the road makes you angry, it makes me angry, too, but at the end of the day, engaging in mental gymnastics to justify shooting people we don’t like is counterproductive. As far as the elements of the doctrine of necessity: “The defendant must reasonably have believed that there was an actual and specific threat that required immediate action. The defendant must have had no realistic alternative to completing the criminal act. The harm caused by the criminal act must not be greater than the harm avoided.” To oversimplify, if this guy had three people in the back of his truck who were going to die if he didn’t get through the roadblock, then he could justify shooting two or three of the people blocking the road, but only if there was no other alternative. I don’t think that this man met the standard to raise the defense, but I suppose we will see when all the facts come out.

The point is, if you’re in a situation where one person or another has to die, I’m willing to bet that a jury is going to buy a necessity defense if the blameless person had to choose between himself and someone who voluntarily put themselves in such a predicament. I have lived in Panama, this time, since June 2010 (I was here from Dec 92-Jan 99 as a US Army Service Member). This guy is not an American. He is a dual citizen by birth because he was born in the Canal Zone, but he has always lived here in Panama. His actions have shocked this entire Nation. It is all people talk about. EVERYONE is in complete shock at what he did and how he comported himself while doing it and immediately afterwards. This is so far beyond the types of things normally seen here that no one can even get close to understanding what he did. He appears to also be politically connected here, so people are already preparing themselves for him to get, at most, a slap on the wrist. There is already talk here about giving him home arrest, which is legally allowed for age of illness, but not guaranteed. There are also reports that he is/was one of the attorneys for the mining company these protests are about. Whether or not that is true I don’t know, but I wouldn’t be surprised. It will be interesting to see what happens in this case.

Panamanian here: 1. Owning and carrying guns is legal in Panama 2. Protests are wide spread in the country against both climate impact from a huge mining operation and the corrupt government ways that sold land to a private company so those were not only “climate protestors” but also against the government. 3. Protests had now impacted from hospitals to water supply and food 4. Laws in Panama state that there should be similar forces involved in self defense, so using a gun against an unarmed non threatening person is definetly a big no no. 5. Most panamanians aren’t used to seeing or interacting with guns, it is usually a peaceful country so my best guess is that the people there didn’t believe that it either was a real gun or that he was going to use it, still pretty dumb to risk it but i want to give a bit of context. Just my 2 cents

I am a non-Panamanian living in Panama, about 20km from where the shooting happened. This was clearly a homicide, since there was no indication whatsoever that the shooter was in imminent fear for his life. That said, tempers are running very short after nearly three weeks of blockades by people protesting a Canadian copper/gold mine. In the western part of the country, food, fuel and medicines are running short. Critical items like chemicals for water purification plants are being flown in on an emergency basis to avoid the loss of potable water in places. Things where I am are generally ok, although I spent three hours last week driving from Chame, where the incident happened, back to my home 20 km away. The response by the government has been generally weak. Last year, they caved in after a couple months to similar tactics protesting the high cost of living, so the protesters assume they will ultimately get their way.

Though I completely sympathize with his frustration, this is open and shut murder. Carrying a firearm means taking every possible attempt to de-escalate and remove yourself from conflict. He did the opposite.

He did not create the conflict, the environmental cultists did. The conflict they created was one he could almost certainly not remove himself from unless he could somehow turn his car around, which does not seem likely. That said, they did not create a deadly level of conflict requiring the use of lethal force. He escalated the level of conflict to deadly, which means he should expect to face charges. On the third hand, when people create a public conflict like these cultists are doing, law enforcement has a duty to end that conflict by removing the illegal traffic blockades. The use of force to do so is entirely legitimate, even up to the use of deadly force if the level of resistance makes it necessary. The refusal of the police to carry out their duties made an event like this inevitable. It can be argued that the police get their authority to act from We the People, and if they refuse to exercise that authority in the face of criminal behavior then it becomes necessary for average citizens to take back the authority normally delegated to the police to end that criminal behavior.

Since there is never any ramifications for their actions, blocking busy highways, which put thousands of lives at danger , maybe if more highway things like this happen, more less likely it will happen int he future. If you have a lower burden of proof if you kill someone than you do if they survive, then that would discourage people from stopping once the threat is neutralized and encourage them to continue shooting until the threat is dead. I'm not a lawyer and I don't know what the laws are in that place; but I consider forcibly blocking a highway to be a "violent act." It's a use of force to stop and, in some cases, illegally detain others. Since I consider that the first violent act, that would make the protestors the "aggressors," if that's applicable. They have the right to protest; but they do not have the right to use force to obstruct, intimidate, or detain others. All that said, without the context of what was said to the man, I don't know if brandishing his firearm would be "reasonable," regardless of who is technically the "aggressor." There didn't seem to be any risk of personal injury to the man, or to another; but we don't have any audio clues as to what was being said. Certainly, the shooting itself seems to be unjustified. There does not appear to be anything which would cause him to have "reasonable fear ..." there. (Edited for spelling and to address the shooting itself.)

He would definitely have legal problems based on US law. What's more noticeable to me is that all these protesters continued to obstruct the guy after he brandished his gun, then I didn't see much running or moving away from him after he shot somebody. I can't understand the mindset of that, I would think the protester would at least think to themselves to maybe let that guy be and bother someone else who seemed less dangerous.

Based on the video I've seen, I don't think this would qualify as a justified shooting. There may be circumstances that are not contained on film that we are unaware of, but strictly going off of the footage it appears he is in the wrong. He does, however, have a great one liner. He's reported as saying before the shooting, " this ends here. "

Bravo James for the level headed synopsis of this. There is a lot we don't know. What was the actual protest about? Was this mining company going to level a neighborhood to mine there by bribing the local government with no compensation to the people who live there, or was it a single tree that they wanted to save? Either way, use of deadly force was obviously not warranted.

I think in cases like this, la policia should be charged with criminally negligent homicide for not clearing the road when people are obviously disturbing the peace and committing potentially multiple other crimes. Lack of willingness to enforce laws on the part of the police is leading to acts of vigilante-ism, which should never have been necessary in the first place.

@yndsu Washington DC mall area is regularly the site of protests, speeches Etc. On January 6th they were given the proper permits and therefore were not illegally blocking traffic or anything. Blocking a random highway or roadway (1) does absolutely nothing for your cause it just pisses people off that may have otherwise than sympathetic and (2) is illegal under numerous different laws and statutes depending on the location.

@yndsu I never said that the shooting was justified in this case, just that the act of vigilantism legal or not could have been entirely avoided if the police had done their job. I'm not sure how January 6th pertains to this case at all but since you're hung up on it I believe the pertinent issue there is that there have been multiple demonstrations protest whatever you want to call it in the past where people have occupied the Senate Office Building, the Capitol Building just this week they stormed and vandalized the White House grounds and in none of these cases has nor will any prosecutions been pursued because of the ideology of those involved. There are people that committed crimes on January 6th that I believe should be prosecuted for those crimes where they were involved in vandalism or assaults but the vast majority of the people there, peacefully protesting being led into the building and walking around escorted by security, many within the guide ropes taking pictures etc. Prosecuting people that did that or those that simply were there outside protesting on the lawn is just absolutely ridiculous.
