Don't forget the sergeant that was giving all the silly commands and death threats and authorized lethal force there. That weasel retired shortly after the incident and moved to the Philippines to avoid the trial.

The kid obviously never had to do that in his life so short. Not everyone has the muscle discipline to comply. That kid might as well have been an 18 year old in front if a drill instructor that had no idea how to act in shock, nor taken directions. All the cops had to do was sprint like 5 meters and sit on him.

Hilarious story. I had a Stuck Mojo shirt with that on the front of it. I was sitting in Denny's with some friends and two cops came in and walked past us. The second one stopped and eyeballed me for about 900,000 years and then says 'You kill people, huh 🤨' I stopped wearing it in public.

if you mean the Daniel Shaver case, the cop, Brailsford, who shot him was not the one shouting the commands, that was Charles Langley. I think Langley is as guilty as Brailsford as he was putting everyone under more tension than needed with his behavior

@@kber6288 And Langley retired, then left the country. Brailsford should have been convicted. He should have been extradited from the Philippines and put on trial. Of course that wasn't going to happen once Brailsford was acquitted. The pair of them belonged in gen pop in a prison for a couple of decades. Brailsford was administratively cleared in a previous excessive force incident in a great example of the thin blue line. So there was nothing to bring up at trial about his propensity for violent overreaction. Brailsford later declared bankruptcy, was reinstated to the Mesa PD, reimbursed for medical expenses for the PTSD he "suffered" as a consequence of murdering Shaver and was then retired on medical disability and given a pension of $2500/month. The city settles with Shaver's parents for $1.5M and his widow for $8M. He cost the taxpayers a lot of money and is continuing to be a leach on the system because cops protect bad cops. This is the sort of situation that makes people hate and distrust police.

Philip Brailsford should be in prison. That was one of the worst police shootings I've ever seen. He wanted to kill Daniel Shaver.

Definitely speaks to the mindset of an individual. I was taught that guns were tools, not toys, by my pawpaw and dad, and they stressed that when teaching me to shoot and hunt. Too many ppl treat them as toys, and that’s one of the major issues nowadays.

When I was in prison, one of the lessons I learned from jailhouse lawyers was, if you are innocent, go with a bench trial. If you are guilty, go with a jury trial, you never know what a stupid jury is going to do. That cop in the first video that got away with murder proves this lesson.

Suppressors should be banned and considered illegal. If you use your weapon for protection, firing it also alerts other people about you being in danger. Silencers are the opposite. Keep them illegal.

The prosecutor is going to attack your equipment no matter what. It's their job. FMJs? - Military grade! Hollowpoints? - Deadlier than the military! Same ammo as police? - Vigilante! The dept fired him, and then temporarily hired him back so he could be treated for the ptsd he gave himself. This enabled him to retire permanently and collect 2500 a month for life. After the trial more video of him beating on some innocent teens surfaced, in addition to another case involving improper use of force.

I once represented a defendant charged with murder. It was a road rage incident. After having been stabbed twice with a small pocket knife, my client pulled out his T-shaped dagger and stabbed the deceased once in the carotid artery. During closing, the prosecutor held up the T dagger. He made it sound like only a crazed Assassin would carry such a self-defense weapon. The jury took a very long time coming back with a not guilty. I talked to a couple of the jury members and found out that the delay had been over the two inch T dagger. Chicago. Mid 1980’s.

The fact that the NRA the National Rifle Association changed its View to a more radical View of the second amendment in the year 1970. If you listen to the recent video on KZbin concerning the latest Omnibus gun control act worked on, they bring up every mass shooting event that ever occurred in history. Except for ONE "mass shooting" got no mention. What is this "mass shooting" that the government doesn't even want to talk about. What is this event that in 1970 rocked the boat of the National Rifle Association, and caused every second amendment organization to literally "freak out" in the year 1970. On May 4th 1970 members of the Ohio National Guard fired into a crowd of Kent State University demonstrators killing four, and wounding nine Kent State students. The impact of the shooting was dramatic. The event triggered a national wide student strike, that forced hundreds of colleges and universities to close. I find it sadly ironic that the demonstrators were demonstrating their displeasure over the war in Vietnam in general and the bombing in Cambodia in particular, carried out by President Nixon. War is a "mass shooting" on a major scale ! . As for the Second Amendment as currently written, I have some serious issues with it. It is poorly written, it is so poorly written and confusing that it must be reinterpreted by the Supreme Court. It does not explicitly say anything about self-defense. This has inspired me to write my new and improved version of the Second Amendment. I have named my new version. Second Amendment 2.1 In order to maintain the blessings of liberty and freedom throughout the land.The pre-existing natural right of the individual to self-defense, shall always be upheld and protected. The right to manufacture, keep and bear arms ammunition, and parts and accessories for arms, will not be infringed or impeded. By any law or mandate, by either the states, or the federal government. A free market being necessary for a free people.The right to manufacture arms for sale, including, ammunition and accessories, for arms, will not be infringed or impeded. By any law or mandate. By the federal government, or the state's governments. This includes both carrying for an individual, or carrying for a company, for trade or sale in another state. Or any city or town, within a state. For any other moral reason. Uninfringed or impeded by law or mandate. And there you have it my new and improved version of the Second Amendment 2.1 and for further Clarity, let me explain the term "pre-existing natural right of self-defense". The Second Amendment to the Constitution was adopted December 15th 1791. The concept of self-defense was created and adopted after the Norman conquest of England in 1066. Coming back up through time back to 1970 and the mass shooting event at Kent State University there was a famous rock and roll band called Crosby Stills Nash & Young they made a song called "Ohio". Previous to their song was the song written and produced,1964, by a young Native Canadian singer-songwriter, Buffy Sainte-Marie, The universal Soldier. I consider her song. The Best anti-war Song Ever written by a human being on this planet. It is my most sincere hope that my version of the Second Amendment 2.1 will one day be recognized as being the best Second Amendment ever re-written, and adopted into law. Also I highly recommend the following books, Atlas Shrugged by Ayn Rand, Adventures in Legal Land, by Marc Stevens. Government Indicted, by Mark Stevens, Freedom from Government by Trent Goodbaudy, And Natural Law, by Lysander Spooner. :-)

Retired LEO here: Stuff like the Mesa officer's dust cover have an appeal to the "Hur! Hur! Rah! Rah!" dudes but just like their other toys and "statements of individuality" they should be aggressively discouraged by leadership. This is especially true in today's environment. Now, that said, back in my early uniform days when pepper spray was all the rage, I re-labeled mine "Whoop Ass" and often pulled it out, showing my marker-enhanced label and said, "Don't make me open this." I got more violent offenders to submit doing that than I ever got actually spraying them. LOL ... but today ... hell, before I got promoted to detective in the late '90s I took that crap off. A jury trial is a circus. Most of the folks there don't wanna be there and your fate is in the hands of the 12 people who were too dumb to figure out how to get out of jury duty AND most of them probably associate you with "Ticket Ted" who wrote everyone including his mother chickenpoop tickets. Not a very favorable environment.

I am going to disagree. An accessory shouldn't be justification as intent. The prosecution, had they been interested in a conviction instead of mere pandering to the brief outrage (knowing it wouldn't last because the media wasn't causing enough outrage like other incidences because the victim was the wrong skin color), could've gotten plenty of people to speak about the officer's character, anything he's said or done in the past. I'd be willing to bet there were previous reports of behavior or another officer heard him say something that showed future intent. But let's say none of that existed, that he was as squeaky clean as a freshly washed Hillary Clinton, and nothing showed up in his past. The body camera footage alone showed he murdered the individual. If anything, it should've been a manslaughter charge, but in my opinion it was second degree murder. I feel the prosecution had no heart in pursuing the case.

You’re dead on about Brailsford’s previous conduct, and disciplinary record. His father was also involved in the local or state government iirc. He’s now on a forever paid vacation, funded by the local taxpayer of course, because his PTSD from this event doesn’t allow him to continue to work.

We live in the days of 100 rounds being "an arsenal". If you have a shotgun, you want to murder with one shot. If you have an AR, you're a delusional COD fanboy/ school shooter. If you have a wood-stocked 30-30 with a scope, you must want to be a sniper. A glock? You think you're a cop and want to take the law into your own hands or you're a gangster. Even using basic defense ammo is proof: "This ammo isn't even allowed in war zones!!!" I'm not advocating for people to make poor choices about decorating their firearms. James, thanks for making this video, it's desperately needed. I'm a retired LEO supervisor and reluctant field trainer from one of the major metropolitan police departments. I had this conversation thirty years ago. Guys seem to be more interested in impressing their buddies in the locker room than employing good sense and tactics. Another issue that I've discussed is, not posting self incriminating photos of yourself on social media or getting psyco tattoos. Yeah, I got it, you're free to self express, but remember people are going to make decisions about your character based on visual representations.

Yep, I run suppressors and heavily modified or custom rifles pistols and shotguns for 3 gun competitions/ targets shooting etc. spent tens of thousands on them load all my own ammo for them. My home defense gun is a stock 870 with a wood stock with store bought ammo says self defense on the box. As a federal law enforcement officer of 30 years and one has has testified in fed, state and local court hundreds of times, I can tell you defense attorney's or prosecutors will go after absolutely anything they need to in order to paint you a psychopath. I've seen them hone in on tattoo's, knives officers carry (with a skull engraved) even though they weren't used, social media posts (HUGE these days), firearms accessories (like highlighted here), ex-spouse testimonies, even cowboy hats. I've even seen a defense attorney highlight the fact that an office had two rottweilers with spiked collars (they had gone by his house). It never ends....Ona side note, in AZ video used here...IMO that was 100% murder.

Its all about the story. If you as a gun owner get caught in a self defense situation and have been publicly worshiping guns and been playing at being John Wick at the range, then it is easy to tell that story to the jury in an unfavorable light. Dear jury the defendant spent years refining the tools needed for this crime, he researched the best holster for hiding and drawing his gun, he assembled parts to make the gun hold more rounds and be quicker too shoot. Not only this, the defendant would go weekly to the range and practice something called bill drills and mozambique drills where you basically train to commit murder by either shooting six shots as fast as you can into a human shaped target or shooting two shots to the body before you finish with a shot to the head. On top of this the defendant was using ammunition that by several third party reviewers call the most destructive bullet you can fire from a 9 mm. The defendant drove around with two extra magazines of this in his car incase the 20 rounds in his pistol did not cause enough mayhem and murder. The defendant also watched hours of so called guntubers every week on youtube, watching them test the destructive capabilities the defendant would later unleash on his victim. Watching and learning. So the question here is: Is this a man that just happened to get into a bad situation where he was forced to shoot an unarmed man, or did this man go searching for a situation where he could live out the gun fantasy in his head on an innocent victim? The behavior prior to the incident must carry some weight and we ask you to look at the evidence and make your own decision about the tragic facts laid before you.

I don't think it should make a difference in court but the sad reality is it does. It is the main reason why my carry/home defense guns are bone stock. No "threatening" accessories, no laser etching, no rattle can paint job, no enhanced trigger. They are as I got them from the the FFL. My range toys aren't held to the same standard, which means a hyperzealous prosecutor might try to use that as an excuse. They'd also use how much ammo I own too (even if most of it is 22LR).

Personally a 12 guage shot gun is your best home defense weapon, multiple ammo choices, everybody has one and it’s not an “assault weapon” I was a street cop for 33 years in AZ, the Mesa cop was guilty of murder in my opinion, I was placed In this position hundreds of times including when I was a rifle operator and I never shot anybody. I recently pulled out a double barreled 12 guage that I keep in my garage loaded when my tenant, that I’m evicting, drove on my personal residential property to personally serve me with an order of harassment in a vehicle I didn’t recognize. The Judge found in my favor that I had the right to a show of lethal force on my property, and quashed the order of harassment, If it was my AR15 I’m not sure he would have ruled that way.

I can understand not putting stupid bumper stickers on your weapon as well as trying to avoid using ammo with dumb names if possible. But I can't accept villainizing someone just because they added something that improves the functionality of their self defense tool. (better trigger, red dot, etc.) To me, having a more accurate weapon system is a way of exercising more responsibility for the safety of innocent bystanders, not less. I am especially irritated with laser sights being demonized. As someone who wears corrective lenses and who is far sighted, lasers are extremely useful to me if something were to go bump in the night. Obviously, taking time to put on my contacts is ridiculous if there's an imminent threat. Fumbling to for my glasses in the dark MIGHT not be a much better situation either. There's never a guarantee I will find them and put them on quickly enough. How about if I'm out and about during the daytime and I end up in a situation where my glasses are broken or knocked off for some reason? Day or night, as long as I have good enough lighting, I can always reliably ID a threat without my corrective lenses. However, without my corrective lenses, iron sights and even red dots become blurry blobs because they are close to me. The only way I'm going to hit an identified threat accurately without my corrective lenses is with a laser sight. Excuse me for not wanting to miss my target by a mile and hurt a loved one or innocent bystander that I didn't intend to. If some anti-justice, anti-2A prosecutor is going to send me to prison because I used a laser on my firearm that happened to make me and my family safer, then so be it. Better to be judged unfairly by 12 then me or my family to be carried by 6 to the deep 6.

@@HGRAP1 that's not what I said, at all. Saturday Night Specials are effectively compact, low caliber, inexpensive handguns for rheir concealability. Compact to subcompact in todays terms. There are no "Saturday Night Special" long guns and a basic Glock or otherwise unmodified full frame size pistol is not a Saturday Night Special. Even a HiPoint doesn't qualify. The 70s aren't dominating the Courts anymore.

This was actually on a police officer’s pistol and the civil plaintiff tried to enter it as evidence but the judge said it was inadmissible.

Im a retired LEO (21 yrs in USMC and 20 yrs as a deputy sheriff) and held many people at gunpoint. It's like walking a tightrope between officer safety and judicious use of force. Scary. What's also scary is the political lens that you will be judged by. Everything will be brought to bare. What you say before, during, and after can be used against you. Taking a life is traumatic, regardless of the situation. Think before you act. Perserving life (including your own) is the number one priority. Time is on your side.

In all seriousness though, this sucks. I tricked out my CZ Scorpion Evo 3 with a holographic sight, a 2 lb trigger, suppressor (because if I fire it in self defense it will be in a long, narrow hall) and fancy red aluminum mag release, trigger and AK style safety so my artistic wife would think it was cute and wanted to shoot it. Guess I'll call this rig the, "I want to die in Cell Block D Special".

You should make a video about jury selection and venue. People need to understand that matters more than the gun itself. All of this talk may be moot if such a situation happens in rural Arkansas but definitely applies in your average metro city where people dislike guns in general

That's a gross over simplification of the events that took place. The 14 year old was contacted by the FBI for making violent threats online a year prior. His dad bought him a rifle as a gift knowing that the FBI had talked to his son. His son shot and killed 4 people and injured many others.

It's either justified or not. Prosecution will start looking at ammo type, decals and modifications when the material facts show you acted in self defense to sway the perception of the jury. It all boils down to the politics of your locality. If you live in a deep blue district, youre better off with a bench trial.
