I'm not American but as far as I'm concerned lethal force is only justifiable when faced with lethal force, verbal threats or body language that can very easily be mistaken for aggression such as clenched fists, a bladed stance and so on......even hands in pockets could fall within that category as you can't see if the person has a weapon in their hands or not. This is a clear case of the typical USA mentality of "Do something I don't like and I'll shot you". Yes the KZbinr was in the guys face and following him after been told to go away and yes there was two of them but none of that warrants lethal force. I remember reading that the driver was a platinum USCCA member and they refused to defend him since the DA hit him with 2 charges. I was considering getting a membership and to be honest I would rather take my chances with an appointed lawyer. USCCA is just insurance, and it has a lot of fine print exceptions. Law Shield is essentially just having a use of force specialized attorney on retainer and is the way to go for legal defense. Speaking as someone who grew up in a rather rough area I have to agree it's valid self defense. I have first hand seen in more than on instance of an assault/robbery starting out with the attacker pretending to just be fucking with the mark. They will walk up and say some off the wall shit or act goofy as a way to disarm you allowing them closer to either hit you, stab you or shoot you then take what ever you have. So this could have been one of those events and not some moron who makes a really strong argument for abortion.

If he was 20+ feet away, sure draw and warn but at his distance with the person pursuing, drawing as a threat could be self deletion. He could have tried running away but that's not legally necessary and dude would've followed anyway, that's his whole deal. Seemed a bit much to me as well but as I go over it, I don't see anything legally wrong. He also only popped once and fled, proving he wanted to get away.

Fellow Florida attorney here, go Florida man! Job security at its finest. Reasonable apprehension of harm, two men vs one, one much larger, playing message involving swearing and giving a comand which could reasonably be interpreted as being confrontational. They were told to stop, they didnt and continued pursuing delivery man, he attempted to push away the phone and hand of the larger one, again telling him to stop. Simple battery levels of force didnt cease the conduct. One shot fired, no mag dump or maliciousness considering one shot, (and .380 in Texas is considered a weapon only capable of simple battery levels of force) the threat stopped, and in turn so did the delivery man. Absolutely justified. P.s. James, you should totally start the Fuck around and Find Out awards. Given out monthly. Then do a collaboration with Brandon Herrera to make a once a year "Fuck around and get Darwined' Out" special.

Another recent case where a person used a pocket .380acp was FL vs Reeve. Reeve a 👴🏻 older man, retired Tampa PD captain killed a larger, young guy in Wesley Chapel FL. The media termed it the 🍿 case. The courts took 8+ years but Reeve's was cleared, not guilty.

I'm not aware of attacks on Door Dash drivers being a particular problem in Virginia, but I am also aware that Door Dash drivers *are* targeted the same as pizza delivery drivers. Which is weird to me because I never carry cash, or anything worth stealing. Maybe not all Door Dash drivers are smart enough to leave valuables at home? But I do keep a lead injection device on me in case someone wants to FA/FO.

However, judging by the comments of his recent videos people are just subscribing and watching to see the prankster get shot again and are actually rooting for him to be shot. I'm 5'6" tall and stocky. A 6'5" tall guy and his buddy doing that to me would put me on edge for sure! However, as a 'Monday-morning-quarterback', I don't think I would have shot the guy at that time. Perhaps if they chased me out of the food court? My first thoughts were like “wow, he couldn’t have warned the guy or tried to get away?” But after thinking about it, no, not really. He did try to get away, he said “stop” multiple times and pulling the gun out to do anything but shoot it could have resulted in the gun being snatched away. If he believed his life was in danger, he did what he had to do. I use the deadly force triage: capability, opportunity, and intent. I think all three were met.

Lesson to learn here is: You don't get to determine the level of the next person's fear once you've provoked it. As a Veteran with PTSD and many like myself have struggled with social anxiety I've wasted years living in the Shadows grocery shopping at 2am, avoiding crowds, head on a swivel sort of thing, Extreme confrontation avoidance. Situational Awareness at Max levels all the time, thats no way to live and dudes like this make it even more difficult.

Yeah I 100% support the 2nd Amendment and own several guns myself but this blows me away, the guy had no weapon, said or did nothing threatening and was just holding out a cellphone with a text-to-speech saying something stupid. Guy drew and fired with no hesitation at all without any indication he was under attack. I understand these situations are confusing and happen quickly but there is nothing at all that I saw that even hinted he was in danger. If it were me I wouldn't have even considered reaching for a gun, I'd just tell the dude to piss off and stop harrassing me. I mean he could have even just brandished the firearm if he didn't know if he was in danger or not, but he went straight to lethal force. Prankster should be charged with harrassment though, not saying the dude who got shot wasn't being an ass.

If the person contacts or follows or attempts to contact or follow the person at whom the conduct is directed after being given actual notice that the person does not want to be contacted or followed, such actions shall be PRIMA FACIE evidence that the person intended to place that other person, or reasonably should have known that the other person was placed, in reasonable fear of death, criminal sexual assault, or bodily injury to himself ..." The law regards stalking and the issue is following after being told "no" ... AFAIK neither side brought this up at trial. Yet the shooter was in fear and told the offending party to stop whereas the offending party continued to follow.

I carry a .380 on me because I'm a single mom who wants to protect her autistic son and disabled mother. Sometimes guys when they are way bigger than me try to intimidate me in public for various reasons and I'm usually able to get out of the situation. I think you have to take into account that the man doing the shooting is a delivery driver. Delivery drivers, Uber/Lyft drivers, Taxi drivers are often the target of robbery. I think you have to consider the possible mind set of the shooter and his fear of the potential for violence committed upon him.

Facts are clearly shown in the vid ( and do you notice this video was made by a fourth person?): fact pattern consistent with common mugging- outnumbered, larger, physical and antisocial aggressive confrontation; victim objects, retreats four times total (steps backward, talks, steps backward again, talks, walks sideway, turns and leaves)- which retreat is evidence of intent to defend proportionally. I think wienieness of prosecutors, judge and jury account for secondary charge- because in principle if deadly defense is justified THEN THAT FORCE IS JUSTIFIED. @TonioD49 it was definitely defending him self from 2 to 3 individuals approaching on him even after he told them to stop as he is carrying food for a paying customer. And with a steady increase of these workers getting robbed it was hundred and ten percent self defense

It wasn’t just two dudes approaching him. There was a THIRD person holding the camera getting the footage. They surrounded him and followed him for reasons unknown. He was clearly confused and in fear judging by his body stance and reluctance to turn his back on them as they continued to follow him when he initially tried to disengage. This was clearly self defense by a person who was minding his own business and was suddenly thrown into a situation he didn’t understand and caused imminent fear of serious physical (a clues point to him being likely jumped by 3 people). He fired one shot towards the primary threat and escaped the situation. Good job on his part.

@@NonLegitNation2Let’s say that this wasn’t a KZbinr being a moron, and was a group of guys about to attack the driver to rob him, or worse, let’s say you’re in a park at night and someone comes at you with a knife. Do you get attacked, or do you defend yourself? If they decide it’s a public place, your life is ruined either way. Most employers won’t consider you if you have a misdemeanor, good luck with a felony. The law is cut and dry, the logic is murky and actively harmful. This law should never apply in a self defense case. It was not the intention when it was written. Think outside of the context of this one situation and you’ll realize how horrible it is. Near a park? Public place. Near a bus stop? Public place. In a parking lot? Public place.

@karalyzel3177 The problem is that there was nothing of significance to justify lethal force. He was acquitted of the charge for shooting the guy only because it indicated that he wanted to shoot the guy from the beginning of their interaction. Which isn't true. However, someone holding a phone up isn't grounds to justify lethal force. A knife, absolutely. I know y'all are salivating at the idea of being allowed to murder someone for something so trivial. However, that will come back to bite you in the ass as well. Get into a minor argument with someone. They delete you. Jury aqcuits because "he said a bad word, and his body language made me fear for my life." Careful with what you wish for.

A quote often used out of context, but well describes this scene. An interesting comparison to the book, which depicts a utopic, yet often violent world, where armed members of society deal with minor incivilities via duels, and politeness has a constant edge to it. The quote finishes, “…gunfighting has a strong biological use. We do not have enough things to kill off the weak and the stupid these days. But to stay alive as an armed citizen a man has to be either quick with his wits or with his hands, preferably both. It’s a good thing.”

Fully justified… delivery drivers are a hot target for robbery, and I’m sure that was something he was thinking about with two dudes aggressively accosting him, and continuing to pursue him after three pleas for them to stop, and using a phone as a distraction.

This huge fat guy was lording over the man, playing bizarre messages to him, staying in his space, and staring at him like a demon. If YOU arent threatened by that kind of insane behavior, then thats YOUR failure of perception. Anyone who is that passively abusive to another person deserves to be pushed back for their disrespect and intimidation, and this arguably constitutes a passive threat. Not saying it will pass in court but thats not really my consideration. People should not get a pass for harassing and abusing other people for fun, especially when they keep doing it and dont stop when asked. When you dont allow people to say NO to being abused, with force, then you are saying they should be allowed to be abused and made the butt of some demented thug's little internet joke video

@@hawk9mm I’ve had a black dude in a ski mask outside a bank in the ghetto of Sacramento threaten to shoot me while three feet away in a closed off corridor and I didn’t even pull a gun let alone shoot him because I’m mentally stable and was simply ready to do it if I had to while watching his hands. Also, your description of this interaction is extremely dramatized and shows that you’re just looking for any excuse to shoot some kid that’s not even a thug because they annoy you. There was no threat, you’re just a sheltered little man with an ego problem or mentally unstable. Maybe both. “Fighting age” lmfao….CNN level dramatization.

The guy is still in jail for discharging a firearm in public. His lawyer is contesting that bc the self defense aspect of it should negate the firearm charge. Probably the ideal response here would've been pepper spray. I don't feel like the youtuber found out enough.....

I had a run in with these morons a while back near Dulles Town Center at Home Depot. Was visiting the area and getting a few things and the big fella that got popped walked up to my brother and myself saying some guy was being weird filming us. The guy with the phone was just barely scooting his feet coming down the aisle towards us. Within a short period I realize they are most likely together and the big fella was just hanging around aimlessly looking at stuff a few feet from us. I told both of them to move on I wasn’t in the mood for their prankster crap. They moved on and I told a young associate what they were doing and they said they had been in before pulling the same thing. They eventually left and I watched them get into a vehicle parked way away from the building. I can’t believe this guys parents haven’t put their foot down with his antics even before he got shot. Part of me thinks it was all a rouse for more publicity. The times we live in!

As someone who lives in Northern VA and used to work at that mall. I would say, it's a mixed bag to what you'll find in behavior of aggressors. I've seen brawls, drive-bys, weapons brandished, jumping, all kinds of gang stuff down to drugs heads and drunkards with beer muscles, to the worst of the bunch wealthy twits that think they can do whatever they want cause their parents are wealthy and can afford a lawyer to get them off whatever dipshit thing they do. I wouldn't have handled it the same, but that's cause I'm older and have seen enough to read the type, but at the same point I can genuinely understand the perspective of not knowing how that's going to go down and being fearful for ones well being and life.

I absolutely agree you should do more videos like this, reaction videos within this category always do well and provide a steady stream of views based off the other channels I watch, especially when it's tied to a profession such as "Doctor reacts" or "Lawyer reacts". Could also be a great way to spread firearm tactics/self-defense education amongst the 2A community

One factor I think also was a factor to acquittal would be fired a single shot and kept retreating. That does not equate to intent to cause grievous harm especially when considering it did stop the threat and was only force used.

Agreed James, it goes to the edges but it is within what can be reasonably so disposed. Jury hit him on the lesser charge of discharging a gun in an occupied place and I believe their thinking was, "ok, everyone here did something we'd rather they had not, but it's ridiculous to give this guy 20 years for something like this; what's the least of all these charges that applies?". And yeah, the obnoxoid doesn't seem to have suffered any permanent incapacitation. But hey, that .380 goes a few inches over into the aorta and he'd not be leaving the Food Court.

Looking at the totality of the circumstances from the driver's perspective, I'd vote for acquitting based on self defense if I was one of the jurors. A lot of people also miss that this was a 3v1 situation, because the person holding the camera we're looking through is also a participant.

As someone from the UK I’d have done the exact same thing in his situation tbh He gave a fair warning and the harasser was right up in his face, alongside another guy, he probably didn’t know about the cameraman or at least his intentions but in total, 2 guys he knows of within range to do serious damage and a third he potentially knows of but not what they could do. You saw how quick the delivery driver pulled out his firearm, now imagine how quick the other 2 could pull out a knife or gun of their own.

I have to say that there was no hesitation from when the delivery driver pulls the weapon to when he fired the weapon. It was smooth, quick, and practiced. He didn't say anything, he just went to work. I'm not saying that he was right, but the KZbinr put himself in that position.

Need more information. But the more I learn about these 'concealed carry insurance' companies the more they seem like frauds. You'd literally be better off if you put the money they would charge you into a bank certificate and let it snowball into a personal defense fund for all the good these companies do some people.

Even then, especially USCCA has a clause where if you are charged for a crime, they will not hire a lawyer for you. It is a scam because in almost every self defense case that makes news, the defender gets charged by the DA and have to plead not guilty.

Shot placement, not caliber. I was a CSI, I've seen lots of people DRT (dead right there) from 22, 25 and 32. My guess as a former CSI... could go either way, leaning 60-40 for self defense; as we know it depends on the lawyers, prosecutor and jury. Remember OJ? I was 8 when that happened and I remember.

I think the driver could've tried a bit harder by pushing them away or something, but I do see how two dudes (who are taller than you) coming up to you, getting in your face, and doing strange things could be intimidating enough to fear for your safety...

Usually in this situation, if you push that guy, he's going to grab you and pound your head into the wall, or something like that. The delivery guy had no way of knowing that this was just a prank, and the prank seemed tailored to emulate the prelude to an actual attack. In fact, I think that was the premise of the prank.

The driver didn't need to see any of that for this to be justified. All he needed to see is a strange 6'5" man who is clearly over a foot taller gets up in his face and following as he tries to create distance. Idiot is lucky he didn't get a darwin award.
