Sound advice. American law and the its penal system should be dealt with swift justice and objectivity though. While this situation can and will have debates on both sides, I really don't think its right for a judge to stretch a sentence or increase bail due to personal feelings or an overstepping of where their sensibilities lie.
@cheefussmith93804 жыл бұрын
Heavily Entwined bail is set at an amount reasonably calculated to ensure a defendant shows up to court. If you refuse to take your arraignment seriously, why should they assume you’ll take the order to show up seriously? Nothing unreasonable about what the judge did here

But anyway, look, you are saying she isn't taking it seriously because that is your perception of this situation, your bias. Sentencing and bail is not the place for stances and opinion as I said before. You believe that she deserved a bigger punishment because of your opinion. In full sincerity. do you believe that in that instant the judge decided to set a higher bail because he analyzed her comportment and rationalized that she isn't taking the ceremony "seriously" so there is high probability that she might not come back to court? Or was it because he took offense to words, got irritated because she didn't take his authority seriously,and decided to exercise his unquestioned authority and power to get back at this individual because I mean, everything he does is justice incarnate after all. Pretty scary that some of those with the power and ability to decide peoples fates have sentiments and egos so fragile that they let mere words get the better of them and, in a spur of emotion, will deal harsher punishment without a second thought dont you think?

The sarcastic smile and the adios was not formal and with a judge you need to be formal you don't disrespect the law the judge was not being a racist sociopath you have to treat a judge formal saying adios is not formal it is sarcastic I understand that she is of a Spanish heritage but it was not a Spanish courtroom it was a American courtroom therefore you speak to the judge in a formal manner like when he says bail is set at 5'000 dollars you don't say anything and wait for him to say court is adjorned and then you leave just keep your mouth shut and listen to the judge the judge is the power and you listen to them if you talk back even for a goodbye you have a chance of screwing yourself You have to wait for him to say court is adjorned and then walk away nothing else just walk away and your okay what point does this cocky big shot not understand about that tbh I applaud this judge this girl needs to learn that life will never be easy and acting like that will get you into trouble it's better late then never to learn that

@The Cooch Eater Don't you think that for example the fine for this light crime is from 5K to 10K range. And if the Judge thinks that this person who did this light crime, understands that she is guilty, and will not do that anymore, he will give her a minimum required by law. But if, this person acts like she has no guilt, and takes everything for granted, and most probably will repeat this crime again in the future, of course the Judge considers it, and may apply the maximum punishment which he can apply by law. and after all this she insults him personally, which I believe is another law violation, which gives even more power to the Judge, considering that she is not controlled person anymore and you don't respect the norms of society, who can stop her then to do this kind of behavior with other people? You can be free, until your freedom does not cross the freedom of the other person.
@hawatt10004 жыл бұрын
@The Cooch Eater So once again, if you ingest a drug that makes you inadequate and even danger to the society, you may hurt or kill an innocent person by accident being in this drug state of mind, then you still have the right to ingest it? I belive no. Since you have to respect other people in the state, since you cross their freedom doing this kind of irresponsible actions. Wanna live in a society without laws or in a one that doesn’t respect them? Why not moving to some tribe countries with cannibalism? Or on some lonely island? Buy an island and do whatever you want. As long as you live with other people, please respect what these people have decided to be the law. Don’t like the law - make something to change it. But don’t just moan or offense in front of the judge, the man is just doing his job. Wanna change somehting - do something. Grow up. Be an adult.

@marccohen13354 жыл бұрын
In the United States a judge isn't supposed to "be the law." He or she is only supposed to apply the law. The legislature makes them. The United States fought against the tyranny of King George III of England for claiming to be "the law" and the arbiter of the law. But we have a Constitution and local statutes. Maybe this judge comes from a place where the leader of the country or the judges make up their own laws. That's not supposed to happen here.

@McBoi 123 I think that flipping the judge off might ordinarily be considered out of order. That's because a judge does have to maintain order in the courtroom and can't tolerate unruliness. But in this case it was only the girl's reaction to the abuse she had just received for saying "adios." So even the finger in this case has to be considered in context. The judge had started the antagonisms by wielding his power abusively, so the girl's reaction was justified. Like some of the other posters said, it was the judge who escalated the situation to begin with. I think a problem with judges is that some are voted in and the only way to get rid of them is to vote them out. The others are appointed and how do you remove a corrupt one, anyway? I had a really corrupt and inefficient judge one time. I was taking someone else to court. The judge wasted my time by not wanting to do any work. What could I do but do it all over again by appealing it? So I just had to accept no justice. For poor people it's often financially impossible to keep starting over again. In my case, the judge put my life in danger. I guess justice isn't a perfect thing, but at least if people would complain and speak out when they see this kind of injustice, it might slow it down a bit.

@@AtomicAtom87 Respect/Disrespect is NOT how the judiciary should work, its fucking stupid. A person being disrespectful toward a judge does not justify or warrant a judge increasing bail, which sole purpose is used to ensure the person comes to trial and the safety of the populace/defendant. Saying "Adios" is not anything that gives off any of those indications. That guy simply shouldnt be a judge based on this alone really. Its also sad that people like you exist that thinks this way, which allows further abuse in our justice system.

There's a reason why you're standing in front of a judge in court, don't make light of it. Disrespect the court, pay the price, it's quite simple. 30 days in jail, I'm fairly sure she'll think twice next time...and that's the whole point, now isn't it.

Exactly it’s not funny disrespectful this person for 2 reasons (1) this man is a Judge in a courtroom and (2) this man is old enough to be her grandfather. My daughter got caught under age drinking at a beach she had to go to court never had gotten in trouble before. I already told her she was in enough trouble don’t make it worse and when she approached the bench it was YES SIR NO SIR when he ask her a question and he let her off with a warning.

"If the government decides something is illegal, then there must be a reason for it - a very serious respectable reason, so don't make light of it! Respect authority, it's the authority after all - it's simple. She'll think twiiiice before ever disrespecting authority again!

@@marwatson7408 "Exactly it’s not funny disrespectful this person for 2 reasons (1) this man is a Judge in a courtroom and (2) this man is old enough to be her grandfather." Well he doesn't deserve any more respect than any ordinary citizen of any average age for either of those 2 reasons - but what little he does, he's thrown away by acting like a manchild teenage girl while on duty; so no. And yes it is funny, she's hilarious. "My daughter got caught under age drinking at a beach she had to go to court never had gotten in trouble before. I already told her she was in enough trouble don’t make it worse and when she approached the bench it was YES SIR NO SIR" Did he find that hot "when he ask her a question and he let her off with a warning." So one question, what would've happened if she hadn't gone to court - there are situations where minors are detained for less; and on that: 1) Does one deserve less imprisonment and abduction as a minor for being a minor unable to make decisions, or 2) More abduction and imprisonment for being a minor and being in need of a really good lesson by a paternal smug authority figure who wants to hear yes sir right away sir So yeah you get threatened with abduction and imprisonment for "drinking" something that you can freely drink a few years later, or already now in some related country, and then instead of the oficers and judge apologizing to you for this "arbitrary" but "to their best current knowledge necessary measure to ensure statistical safety", they instead sit smug up there and demand respect and sucking up to them. It makes me want to throw up.
