A judge ruled Monday that Donald Trump again violated his gag order in the New York hush money trial, and he warned that he would consider jailing the former president if the violations continue. After the ruling, witness testimony resumed, with the prosecution calling retired Trump Organization comptroller Jeffrey McConney.
Last week, former longtime Trump aide Hope Hicks testified about campaign and White House efforts to keep a lid on scandalous stories about him. Before that, Trump’s defense suggested that he was the target of a shakedown attempt when his lawyer paid hush money to adult-film actress Stormy Daniels shortly before the 2016 presidential election.

Problem is he’s disputing the gag order as unconstitutional and he has a solid argument. So as it stands nobody’s trying to hard because they may not be able to enforce it. However if they punish him his lawyers will fight it and they’ll probably win which would screw over the judge and anyone associated with placing the gag order.

I actually wouldn't be suprised to see him end up in jail. It's unprecedented for a president to fight so many cases in court so we don't really have an instance where a former president went to jail, but that's because they all cut deals and often got pardons from the next president. Trump won't get a pardon, and he seems to be not taking any plea deals. Aka he might actually end up in prison

He had his employer (Washington post) pay for the board, so it’s a running gag that he has to prove that he’s reeaaaallyyyy using that board as much as possible in order to prove he isn’t wasting the company’s money. It’s a satire on how some companies can get with expensing out stuff

I would argue including the civil war, War is just far deadlier and easier to wage now so its not the go to tactic due to the way information travels. @@ialsoagree1634 It's an internal memo that was apparently altered. That's a misdemeanour in New York State, which would result in a fine. And since it's typically a misdemeanour, it would be past the statute of limitations. The only reason this is being called a felony, is because Bragg is saying the misdemeanour was to hide an actual felony. This felony is for a federal law, not state law. And this was actually investigated by the FEC. They decided that no election crime had been committed. Bragg is disagreeing with the FEC, and claiming he knows better than the actual investigators whose job it is to investigate election fraud. And just so things are clear, in 2022, the FEC found that Hillary Clinton had broken the law in a minor way with the Steele Dossier. They fined her 160,000 dollars. Trumps 'hush money', could have been considered something along those lines by the FEC. So a fairly large fine, pay and call it a day. There wouldn't be any jail time or even a big fuss about it.

@@ialsoagree1634 What crime occurred? The FEC investigated the alleged crime, which was their job, not Braggs, and said everything was fine. Essentially Braggs has declared himself the sole arbitrator for a federal law, and has declared Trump guilty without a trial, so he can charge Trump with a felony.

@@soulslvr9562 That is not the purpose of gag orders and such orders have never been upheld to challenge. Just because the judge says that's the purpose does not give it any legal weight. First Amendment applies still. The jury in this trial are ordered to not view social media or any other media related to the trial under law. If they become biased from something Trump posted or said, it is because they violated a court order to not engage with any form of public media related to the trial. In short, his speech should not impact the jury in any way as they are forbidden from accessing any avenue where Trump's speech can occur.

He violated the Gag order that was placed on him, and frankly, its one of the things i think he was in right for. He talked about the evidence, which is circumstantial, and if Biden was told not to talk about weak evidence that was being used against him, no one would side against him for talking about it. Hes pointing that evidence that would be tossed out in most other cases, is being allowed to be used in his case, while evidence his lawyers have put forward that is not circumstantial, is being blocked. If they are going to put the guy through the court system, he has the same goddam rights as every other American to a FAIR trial.

Trump: [exercises his constitutionally protected right to free speech] Judge: "I'm fining you and threatening to jail you for exercising your constitutionally protected right of free speech." That's a better summation of what's happening than what this guy is saying in this video. The judge imposed an unconstitutional gag order, and then expanded it to members of his own family because he didn't like Trump talking about their political background. Everything Trump has said is protected under the first amendment, and the judge has no right to limit Trump's ability to defend himself in the court of public opinion.

Gag orders are only Constitutional when they are used as a means to prevent potential witness tampering or attempting to unduly influence jurors through public media campaigns. Judges can limit certain speech about the trial to the extent that it is necessary to prevent the aforementioned witness tampering and influence to jurors. The problem with the judge's gag order in this case is that it is overly broad and extends beyond any reasonable preservation of due process. The judge has expanded the gag order, for example, to prevent Trump from speaking about members of the Judge's family, court clerks, and recently ordered Trump to stop calling him a "corrupt judge". None of those things are in the interest of preserving due process and are blatant abuse of power by the judge to prevent Trump from saying things he just doesn't like. Regarding the speech that was subject to the fine, Trump was found in violation for commenting on the composition of the jury, but the media has commented on this same exact thing, numerous times. The judge has not applied any gag order to the media (which he could do) nor found them in contempt for literally the exact same speech. Meaning that such a gag order on Trump could not reasonably be construed as in the interest of preserving due process if such restraint is not extended to the media as well. The only one that's not allowed to talk is Trump. Further making his selective gag order unconstitutional.

No, gag orders are not unconstitutional. They have been part of the court system for decades now. The Boston Bomber faced trail in Boston. New York City being mostly Democrat doesn't mean they can't find an impartial jury. Gag orders are heavily scrutinized to avoid first amendment violations. Of those in this trial Trump is has by far the biggest and longest track record of endangering court proceedings. That's why Trump has been singled out for a gag order. It's not. That's why Trump is being charged with 34 counts of falsifying business records which he did in order to hide the fact that he paid Stormy Daniels to keep quiet about his affair.

well the issue isn't even that. Trump and his team have said that they had no knowledge of what the expenses were on the invoices from Cohen. They just paid them. Which is a common practice, since most people wouldn't question every bit of time a lawyer was working on a case. Though funny thing is that Cohen admitted to stealing from Trump on many occasions by over charging him. so why would it be any different for him not knowing that his lawyer took a loan out on his own home to secretly pay Stormy Daniels.

Its that Cohen took campaign money to pay the porn star and charged it to trump as legal fees when it should have been announced as campaign expenses. And since Trump had all the invoices, ledgers, etc marked as legal and not campaign expenses, they are saying trump has 34 counts of false business records. The worst part about this is that gag orders are essentially unconstitutional when done in this way, and the reason the court hasn’t had a ruling is because of how the court has decided to handle this. His gag orders pertain to “everything” in his life, which you can’t do. You can ask for a gag to be placed until your image is threatened, which they tried, and then CNN same day blasted him so it got canceled. To explain how this works like a gorilla here you go. - Can’t talk about case Mr.Trump unless someone is talking about you in the case - CNN blasts that SAME DAY - Gag is therefore canceled because someone spoke publicly about the involvement of Trumps case and he has a right to defend himself - CNN mad he didn’t get punished for talking back - Rational people mad at CNN and MSNBC for running smear campaigns which allow him to circumvent the entire gag order - Court finds him in contempt, but no charges against Trump due to CNN and MSNBC kicking an anthill - Court angry because now they can’t use Contempt of court, but trumps lawyers can use that as evidence the court is trying to silence him and deny his rights as an American - TLDR Trump got out of a gag order because the news could not wait three days. This made the court angry, and now they can’t punish trump for revealing case information.

What he's not allowed to do is make or solicit statements about specific players in the trial, "if those statements [...] interfere with, or [...] cause others to materially interfere with, counsel's or staff's work in this criminal case, or with the knowledge that such interference is likely to result." He can defend himself from personal attacks, what he can't do is attack the people responsible for ensuring the fair and just application of the law (or their loved ones, another thing that shouldn't have had to be specified).

You don't have unrestricted access to do anything you want if it's in one of the amendments. The Supreme Court has what's called the strict scrutiny test. One of the prongs of that test is whether restricting a right serves a "compelling state interest." In this case, the interest is to protect the well being and impartiality of the jurors. One of the ways that is done is by restricting access to and statements about the jurors.

Because if you seriously find the following vague, I don't see a point in explaining anything to you further if this is beyond your reading comprehension. "All interested parties in this matter, including the parties and their counsel, are prohibited from making any public statements, or directing others to make any public statements, that target (1) the Special Counsel prosecuting this case or his staff; (2) defense counsel or their staff; (3) any of this court’s staff or other supporting personnel; or (4) any reasonably foreseeable witness or the substance of their testimony."

The judge wont do it because if Trump were to be imprisoned during the campaign period, it could escalate the case to a higher judicial level(Supreme Court). This escalation would effectively remove control of the case from Judge Merchan's hands, shifting it to a higher judicial authority which would then need to handle the mistakes made by the lower courts and defining a precedent for these situations.

This entire thing is dumb. Even if he is actually convicted, this is going to scream appeal. Also, can you imagine the optics of jailing him for contempt from what amounts to a free speach issue of a leading presidential candidate? Bleh. Both sides of this are ridiculous.

I feel the judge forgot that gag orders exist to protect the defendant. The existence of trials in the first place is a protection for the defendant.

According to the Supreme Court, they sure do have the right to restrict speech (as long as proper procedure is followed). As for interfering with a campaign, getting put in jail certainly does that too, and that hasn't stopped at least one candidate from running. Having a court date tends to inherently limit one's freedom of travel, and SCOTUS hasn't seen fit to address that (I wonder why). If you seriously think that the gag order in and of itself interferes with his campaign, all I can say is I hope you'll actually read the court order and ask yourself if the speech outlined in it is actually pertinent to any political campaign in any circumstance.

​ @lars1701again 1) no, this is not a "political hit case" trial, the man committed a crime and delayed the trial so long that it's now an election year 2) Where in the Constitution do you find any basis for that bald assertion? If the judge rules incorrectly in this case (which is a jury trial in the first place, 99.9% likelihood the judge will hand down the verdict reached by the jury of Trump's peers), the case will be appealed and reversed by a higher court. The trial itself can't possibly be unconstitutional.
