Worst thing the defendant did was show her vindictiveness and trying to "win" with every word. When a divorced woman thinks she's been wronged she will work 1000 hours to get a nickel from her hubby. So she "wins". Men can too...but they don't have the staying power.

I don't see it that way. Once the kids are in college the child support goes to them. In most cases the support is automatically continued if the kids go to college, but they hadn't reached an agreement for college. With twins the need to make sure that agreement is in writing is pretty important, as even one child in college is a HUGE expense. I think it's in the twins best interest to have it revisited in court.

It will make you happy to know that my father felt that way too. After he Divorced my Mom and married his girlfriend he never paid a dime of Child-Support and not one dime toward's my college. I worked and went to school at night for 9 years to earn my BA.

Yeah, and her 'MY' house, when it only became hers after the divorce. Pisses me off no end the unfair divorce rulings, women are 'entitled' to the family home and compensation. Meanwhile the guy has to start from scratch and pay for the privilege. There's zero chance if I get divorced we aren't halving the assets and debts and I will get 50/50 custody of my kids to ensure both sides are forced to contribute equally. A friend of the family worked out she'd be better off leaving her hubby and doing him for child support, so she could sit on her behind 20 hours per day.

Yes, poor guy living off of his ex-wife for seven years, then his ex-MIL for four. And now refusing to pay his obligations I feel so sad, what a pile of shit. Why shouldn’t he be responsible for money that goes towards his children’s activities? He had already agreed to it in a legally binding agreement, plus she did him a favor by just asking via text instead of going to family court and having a court mandated judgment. Think about why after the divorce he lived in a house where she took over responsibility and then lived for free at the ex-mil, he absolutely looks like a bum.

When he asked about the tools at 1:47 she replied with “my property”. She did it again at 3:53 when she said “my son baseballs team”. Her mind is already locked in to Mine, mine, mine and see herself as the sole parent, him as the ATM and the court system as the enforcer.

It’s literally a 50/50 agreement. Yet that able bodied man is leaving the burden on the ex wife. @@dinahbrown902 I did as much as I could. He just had to wait out the legal system to finally get his things. She changed the locks and would call the police every time he tried to get his things. Even with a court order to get his things she didn’t let him in. Finally after 3 years he was able to get his things. She laid everything on the front lawn. He’s still missing stuff though. The main thing he needed was his passport, birth certificate, social, so he’s not too concerned about missing smaller items. I don’t talk to my mom to this day. She’s a narcissist and will never change.

The problem I see is this...he moved out of the family home because he was tired of being led by the nose by his ex-wife and wanted to have a new life/ relationship. He moved in with his MIL as she probably needed help due to age. He found a girlfriend, stopped paying for his kids' sports, and started paying for his new life. After all, kids are almost adults now. Now that he has moved out of his elderly MIL'S house, the mom now has to take care of the kids, her mother, and no man to pay or physically assist with any of it. He has a new woman, she has a ton of responsibility and is bitter he is finally moving on and she has no prospects of a future mate due to her bitterness. He should still pay half the sports, but the new court hearing won't force him to pay half the college expenses.

Children aren’t required to go to college so it’s the mom or kids job to pay if they want to go. He can provide half or a certain amount if he wants, but the courts can’t order him to pay that.

Neither one of them had a lawyer for the divorce. They came to an agreement. How is it better to ask him to pay for what was agreed upon? He didn't even pay rent when he lived at her mother's house. He said he helped with groceries. I'm so confused by people think asking a man to help contribute to his children is a woman being bitter. He admitted in court that he stopped paying when he moved in with the girlfriend except for the child support.

@@hemag93 Yes, but keep in mind if they were married and they lived in the house together, it was the matrimonial home meaning it belonged to them both. Sometimes one spouse makes a higher financial contribution, but the other makes a higher contribution to other aspects of married life, such as the caregiving of the children. Upon separation, both are legally entitled to the house hence why he "signed it over to her". He didn't have to do it, but he did...so I certainly wouldn't be suing him over baseball costs after such a gesture.

@@amberbiggs I highly doubt it was a selfless gesture on his part. She probably set it as a condition if he still wanted to live there, that he had to sign it over to her. He got to live there and then subsequently at his mother in law's house for basically free for many years, don't think he was at a loss for anything and could probably easily afford sports fees - as this was a part of their divorce agreement and he has a legal right to fulfill it.

Not nerve where I come from. If the kids had always been involved in sports, and he was involved with them, then he knew what activities they had and what they cost. He knew he was responsible for half. She shouldn't have to give him special notice of things he was already aware of, and they shouldn't have to be pulled out if she didn't duplicate the email he was already receiving from the sports organization. He lived with her and then with her mom at no cost for many years, which was more than generous. His expenses with a girlfriend should not come ahead of his kids sports, which benefit their health, mental health, social life, and keep them out of trouble. He may have signed the house over, but you have no idea who paid what, or how much equity was in it. Would you rather he made his kids homeless? She lives with them everyday and has to pay the fees no matter what. Just because he pays support and isn't in arrears doesn't make him a hero - it means he's owning a basic responsibility. And did you notice that his support is taken from his pay? That says to me that there was an issue.

It depends on state law. Some states require child support through 21 for college expenses. Of course, those orders are tailored for the child support to go directly to the college, based on passing grades, and/or payments going directly to the child instead of the custodial parent.

This entire case stinks of jealousy because David moved on. The defendant's "proof" is cut off texts with only her end of the conversation and not a sentence from the Plaintiff. On top of that, she already showed she had no issue with their agreements, up until the Plaintiff had a girlfriend and all of a sudden everything was bad. The entire reason why this woman is taking her ex to court isn't because of the kids. It's because he moved on and is living with a girlfriend.

Not sure what the laws are, but it would make sense for me that the divorced parents should discuss the expanses (clubs, college, etc.), not just the custodial parent signing the kids up for stuff and expecting the other one to pay half.

Typically, these issues are made part of the judgment of dissolution and there is an agreement that they discuss the costs and share them in some agreed upon percentage. All too often the parties forget to address these sorts of issues so if the judgment is silent on it, then one can go back to family court and seek a modification to get some order on these expenses. Typically, support ends at 18 or graduation from high school, whichever comes first, which I think is lousy. My advice, always get a lawyer, a lawyer would protect against this very situation.

@@lisafink98 Yes, it's great that courts seek to regulete these things. 😁 I just wanted to say that even in situations where the non-custodial parent has, lets say, agreed to pay for a certain kind of expanse, they should be consulted when the kid chooses to pursue that (because some options can cost more or less, some things can be more or less necessary, etc.), much like they would be if the kid was living with them. For example, when I went to college my non-divorced parents sat down and decided what they could afford.

In my case, either parent has the right to sign up the kids for whatever activities they want to, and the other parent only pays half if they want to. So we both pay half for all sports, and she is on her own for her "horse camp" that is over 800 bucks for 2 weeks of the summer. Basically it's whatever you agree to, not based on any laws. But once it's agreed upon and goes in front of the judge, that's now final and must be followed.

Everyone is pouring on sympathy for the rudegly handsome ex-husband however I'm not impressed with a man who lives with ex for 7 years after divorce, move in with ex-mother-in-law and now moves in with girlfriend. There's a pattern here. When has he stood on his on two feet? After this girlfriend he'll move in with yet another woman. Not saying the defendant is not bitter, but she should move on. This guy is waiting for the next train to pull in.

Actually child support in most states only covers 1/2 the children's portion of housing, utilities, food, clothing etc. It is up to the lawyers to negotiate the rest. Some people like me never receive child support and have different arrangements. Sometimes that backfires like it did with my ex LOL (He thought since he paid the house payment and the "free with his job" medical, he would get the house) I received $30,000 equity payment from the sale of the home as payment of my services for 7 years.

The divorce decree probably also mentions that mom is responsible for providing dad with proof of costs. That means costs prior to signing them up or paying for anything, not her cleared checks where you can write anything in the memo. If mom didn't provide proof of costs, dad isn't required to pay unless a judge tells him otherwise. Sounds like dad refused to pay when mom refused to give him his tools back. Tit for tat and force mom to take him back to family court. She chose to wait until the children were almost 18 and dad had new girlfriend before bringing anything to court, and the judge is well within their rights to refuse anything prior to the current year because she waited so long to take him back to court. Also, without proof of costs, the judge has the right not to force dad to pay even though mom has proof she paid. She didn't follow the 1st part of the order; therefore, it's as if those costs never existed according to the courts. Next time, mom needs to follow order, not hold dad's tools hostage, and/or take him back to court sooner. I'm assuming she didn't take him back to court sooner because she would look like a fool, just like she did her, for holding his tools hostage for no reason. She also didn't seem to care until dad chose to move on. Spiteful women is another judges don't like dealing with either.

She withheld his access to his tools because he moved out to her mother's house. He withheld payment because she refused to give tools back, and now she's bringing him to court for many years prior he didn't pay because she had his tools, and is only doing so because he's got a girlfriend. She lucky Judge Judy even entertained her part of the case. Usually, she dismisses it and sends back to family court before they can get their entire story out. She must have entertained so she could get full picture of how the ex-wife actually is.

Because their court order requires mom to give dad notice. No notice from mom, no payment from dad. It's very simple and I've seen mothers act just like this woman did and then looked shocked when dad refuses to pay. My husband's ex-wife did this very thing many times. She would sign his daughter up for this or that, with no discussion prior to signing her up, and then demand payment. His order stated they had to have a discussion prior to his daughter doing extracurriculars and if a disagreement came about mom had final say. My husband's ex-wife would skip the discussion and expect him to pay. Not how it works. The court order is there to be followed not to be looked at as a suggestion.
