The plaintiff says after her father became ill, her aunt tricked him into going to a nursing home and left him there for two years. The plaintiff claims the defendant stole stimulus money from her ill father, so she’s suing her aunt for stolen money and emotional distress. The defendant alleges that the plaintiff failed to properly care for her father, and she’s countersuing for emotional distress.

I have an aunt like this. First one to leave the hospital when my grandma passed and cleaned out her house… then tried to take my dad off of life support (before my sister became his legal guardian), and he’s still here with us (alive and well, 8 years later).

This case was so heartwarming. I love how the plaintiff really got a chance to let it out on her aunt and she did it in such a articulate way, and i love how judge.Mathis sat there and allowed her to say everything she's been holding in for god knows how long. This ruling was 100% right, especially morally.

I commend the plantiff for taking care of her mother and father because that's a very hard thing to do. Many just throw their parents in a nursing home or (ALF) Assistant living facility and say call when they pass away so then to collect the insurance. Either way this is a hard case to hear. Very sad

I never said that children are required to take care of their parents but I commend her for doing what she did because many others wouldn't have which I've seen myself. Second, who knows what a person's mentality and mindset or reasoning is when they get to the point of putting their parents in a home. I've seen many cases that go both ways. Some don't want to responsibility and then there are others who legitimately cannot take on that big a responsibility for a myriad of reasons. I've seen both

Austin, I actually took care of my very own mother for 16yrs due to multiple sclerosis until she ultimately passed so I've been there. Nothing was going to make me put my own mother in a nursing home or any other place. I took care of her by myself. So that's the side I'll always be on. In my case I was able and willing to do so, but many others ship their parents off and that's the end of it.

The stroke may have affected his judgement. I have experienced strokes. It took years for me to feel like myself again. Definitely affected my decision making.

No one but children, spouses, or parents should be beneficiaries, unless their are none. Any one else (cousins, "friends") would happily pay and knock you off in a minute.

This episode hit home, my auntie used my sick mother throughput my whole childhood. My mother passed away when I turned 20 and was able to care for her. I had just got my first apartment… I still haven’t healed from that 💯 my mom passed 3 years ago

I'm grateful for their vindication. The old evil minded, heard heated, stubborn, wicked generation is dying off. Let them go. I had Aunts on both my Mom and dads side attempt to steal or withhold money that was to come to me and my siblings when my parents passed. The Divine made sure we got it. I still believe one of the aunts did not give us all we were supposed to get but that's between her and the Divine Universe now. What is mine will come to me. Let them go! I am so happy to be free of all toxic family and get to live my life with Joy and Happiness and Love and Freedom! I have learned what not to take with me and what not to pass on to my children. The curse is broken yall. Let's move forward 💖

I’m 29 and have my burial plot already purchased. I realized after I started making some real money I need to get everything in order. All my beneficiaries on all accounts, will notarized, and exact funeral arrangements planned out to the very last detail. God willing it’ll be smooth for my family and no stress during grieving.

All Social Security checks go to the Nursing Home when the person goes there long term. The U. S. Government has it set up that way it has nothing to do with guardianship

Not really because if property and person dies it goes to spouse (if living and then children) Or it it would just go to the state. So the daughter has ever right. Just like on my case. I am the daughter. Not the sister or siblings

That is why you get Legal Guardianship immediately so it wouldn’t be problems with others…When you have Guardianship YOU are responsible.I believe everything the daughter said shame on the Aunt.

The aunt low-down by her hair is on pointe. Like who her stylist, I need to talk to them. But yeah, her aunt dead wrong. I don't know why I thought the husband was the father in question. They look so similar I honestly thought they were brother and sister instead of husband and wife. He really was a Pinocchio because he said and did nothing. The mother should be commended for what she did. She didn't have to take in her father or watch him. But she did in a day and age where they normally ship them off to the nursing homes. She tried her best despite her aunt's scheming.

Even if the person is your family you need some type of financial help. Your buying extra food, time off work for appointments, utility bill, home modifications etc. Everyone can't afford to take care of their elderly parents.

I know it's a hectic job to take care of an ailing old parent. You need to make huge sacrifices to be up to the job. Being elderly enough is a big issue, let alone if they are very sick and weak. Some are obnoxious and always drive you crazy.

How bad and shitty does your life's direction have to be to take an inheritance out of the mouths of a father's babes? How poorly do you have to run your own life into the ground to the point where you have to whisper into a dying man's ear "Listen, bruh... your kids don't need your monies or your life savings or your insurance policies when you die. You know they're going to spend it on junk and parties. Now then, you just sign on this dotted line, brother, and let me - your sister - take care of any assets you still have at your death. I'll do right by you, brother... you know I will. You just sign right here, and your sister will take care of all the details. I'll take care of everything - don't you worry 'bout a thing. I know what's right; your daughter doesn't know what's best for you, but I do. Lets be clear,lets not act like the daughter is a innocent. She could have at anytime took her dad out of the nursing home. She allowed her dad to stay for 2 year's??? Secondly the daughter stated herself that when her dad got a voucher from the state for housing SHE MOVED in with her dad. The daughter also stated that SHE is her dads PAID aid! So she is not taking care of her dad without getting a check herself. I say all this to say, i work in Healthcare and when my parents got ill i was NEVER their paid nurse i took care of both of them FOR FREE! I also quit my job and took a big financial loss but its my parents! Shame on the daughter for blaming the aunt only! I also disagree, if im paying the insurance policy yes i should be the beneficiary. If the daughter wants to assure her father is buried properly she should be responsible and take out a policy herself. Im not saying the aunt is 100% right, but the daughter is/was living off her dads dollar as well.

I've learned the hard way that family will turn on you when a family member is sick and/or dying. Parents and guardians, get legal advice and wills together while you are alert and oriented. If you become incapacitated, there is a chance some of your family will get greedy & dirty.

Shame on that old evil sister, the Defendant, of the Plaintiff!!! I'm glad that Judge Mathis saw right through her lies and games and rendered his judgement accordingly. Now she can continue to pay those high payments but she'll probably ending expiring before her brother because of her ways. God does NOT like ugly. The same thing happened when my late husband was tragically killed (murdered) in Stockton, California 4 years ago. His grown children struggled and it took 3 weeks to bury him because of the lack of funds. He was a kidney dialysis patient and disabled senior citizen so we couldn't afford to get life insurance for him initially when we got married. However, his youngest sister went and took out a policy on my husband, unbeknown to me AND my husband. Sadly, she didn't disclose to her own nieces/nephews (my husband's children from a previous marriage many years prior) that she had done so and acted like everything was normal with her evil self. The only way i ever found out about it was because I searched to see which life insurance company he had taken a policy on a few years prior and just told me about it 1-2 years before he died. I never questioned him about or asked for details because that was his business. He wanted me to know that he left myself and his eldest son as beneficiaries and I was fine with that decision. The State of California, due to fraud, requires ANY insurance company that holds a policy on a California resident to disclose it upon request. When i made an inquiry to the state, which i didn't know to do so when he was first killed because i was so distraught about how he died, that's when i finally received a response through the State of California that there was no policy where i and his son were beneficiaries. However, they state there was one that his youngest sister took out on him 5 years before his death which confirms to me that she was banking on him dying due to his health. Ironically, he died but it was at the hands of another and through no fault of his own. I got my attorneys involved anyway and held up the process of her getting paid, as his only beneficiary on the policy that she took out on him and paid for without his consent. I held it up for 1 year alleging FRAUD and demanding that they disclose my husband's signature to me on the document because i knew his signature and had it on his driver's license and our marriage certificate. Furthermore, I knew my husband would NEVER allow her to take out a Life Insurance policy on him, as they were not even speaking for quite some time due to the dominant treatment he received from her. As well, he had his own life insurance policy that he took out on his own self, as i mentioned, which i didn't even know until he told me 1-2 years before he passed away. The Life Insurance Company never did disclose the things that i had requested through my Attorneys who told me my options and left the decision up to me on how i wanted to handle it because they were ready to litigate. The Life Insurance Company kept badgering me about wanting to release the funds to her. They were trying to get my approval before they released the funds for fear of me suing the Insurance Company and my husband's sister per my Attorneys. At that time my late precious 91-year-old father was very ill and within months he passed away later on that year. Daddy was my ONLY priority and I chose to spend positive energy on him until he took his last breath. My husband's sister was NOT a priority to with that ignorance she displayed and those were the exact words I told both the Insurance Agent and my Attorneys. Life was too short and i was not about to waste it on her!!! Therefore, i told my Attorneys and the Insurance Company to RELEASE THAT BLOOD MONEY/INSURANCE BENEFIT to my husband's youngest sister. I did not want to pursue litigation but rather focus on spending the time i had left with Dad. SOMETIMES YOU HAVE TO CHOOSE YOUR BATTLES IN LIFE EVEN IF YOU KNOW YOU COULD WIN LIKE I DID!!! I knew that she would NOT enjoy that money and, and more importantly, God would handle it. In this case, the Auntie is way too old for that mess and she will reap it Defendant. It's the love of money that's the root to all evil. As a Christian woman of integrity, I chose to be bigger than my husband's youngest sister!!! She owes her nieces/nephews, who are my husband children, an apology for her deception but i know she'll never do it. My husband is resting with the Lord & I have peace in knowi it, as well as peace in my life. By the way about 2 years after my husband's death i did inform one of his sons, out of his 5 children what his Auntie had done. I did so only because i felt bad that he never told me until that time that he ended up paying for the majority of his Dad's funeral. At that time i was just disabled and just learning to walk ago without assistance so my income was very limited. It infuriated me to hear this information which is why i disclosed to him what his Auntie had done. I felt perhaps he could try to get some of his money back from her specially since they were very close and she was not only close to him as his Auntie but she and her long-term lover girlfriend together were his children's godparents. However, i doubt that he even asked her about it because he knows it would have brought down hell on her from the rest of my husband's 5 other sisters. Bottom line was i felt that If she could live with it, then so could I. SHAME ON MY HUSBAND'S YOUNGEST SISTER & SHAME ON THIS AUNTIE IN THIS EPISODE OF JUDGE MATHIS!!! I used to have to take care of my grandfather as a teenager. I had to change sheets, feed him, give him meds, etc. since he was diabetic he needed extra help. When i moved out the house he was placed in a hospital after being neglected and after awhile he died. And my family just cashed their check n went on with their lives.. its sick how ppl can only care so much abt money

My mom died when I was 23. She was sick our entire childhood. My younger sister and I had to fight off our aunt's and uncles because they tried to take control of her affairs. Since I was the eldest child, I had to go to court and be awarded Executor of her estate because they were really trying to get her VA benefits, sell her house, the works. I didn't know much about any of this since I had just graduated college. Two days after I got the Executorship, they called me pissed off that I had ruined their plans.

Man my uncle been living in my grandma house since she had they went to court and he didn’t even come so now he has to get out and clean everything if he doesn’t that cleaning fee is coming out of his shares mind you this man owns two houses in the hood and renting but won’t gtfo and he got the house nasty and living up stairs on a cot like he still in the service dude weird . When the money can help everybody and a family member wants to buy it and turn it into a bed and breakfast the house is definitely big enough I can’t wait to see it renovated . I agree. It's best to get your own insurance policy when you are well and pick your own beneficiaries. Sounds like dad was asking his sister to do things she wasn't authorized to do. Sadly, even if you want to help, it's best to let the spouse and/or children handle it. If think it's not being done properly, call a 3rd party.

This is the perfect example of why my mother taught her kids to stick together like glue and we have a great sibling relationships. As the oldest I am to split the difference after her funeral we have to agree on how that’s going to be done. She will never be in a nursing home because we are to take care of her. We have had trials and tribulations as a family but we always stick together and allow nothing to penetrate our relationship

I’m so proud of the way JM drilled the defendant and asked her all the right questions to incriminate herself. As an older sibling I didn’t learn fast enough how that relationship becomes secondary to a spouse but especially kids. Look who is in court fighting FOR their Dad vs stealing. The Dad is wrong for ever being spiteful and switching his payee and power of attorney. Put your kids first always. The IRS was sending those checks to old address on file. They were even sending checks to deceased people. So it's a strong possibilty the aunt got her brothers money.

I thought that I was the only one that went through such a terrible and painful ordeal like this except it was my mom that collected on my dad's life insurance and didn't give me a dime of it instead she spent it on her new husband that she married six months after my father's death. I took care of my dad for four years. She claimed she couldn't even come up with two thousand dollars the remaining balance of his funeral expenses but as soon as she got remarried to Lucifer she bought him a brand new F 150 truck and herself a brand new equinox. Her husband is only 9 years older than me and he forbids her to have a relationship with me so she says. She is 69 years old. All I have to say is karma is a b*tch...reap what you sow. Stay blessed 🙏
