The EJS w/ SPA was signed by 6 heirs among 8 heirs. 2 heirs did not sign. The lawyer notarized it since those 2 heirs who did not sign were included in the equal pro indiviso share stipulated in the EJS. Is the notarized EJS w/SPA legally valid?

Pano po gagawin nasa amin po un title ng lupa sakabayad na ng parents namin pero un title wala un annotation ng bank na fully paid na un mortgage. Nagsara na din un bank at hindi mahanap ng PDIC. Pano po ang gagawin kasi hinihingi po ng BIR.

Good afternoon po Atty Samuel Agoos ! Isa Po akong senior citizen at may katanungan lang Po ako kung Inyong mapapansin. Maaari niyo Po ba ako bigyan nang idea kung papasok sa extra judicial settlement yon Isang naghahabol sa lupa na not related sa taong nakabili don sa dating mayari. Non mamatay yon dati mayari atsaka Sila naghahabol na yon tao na nakabili ay nasa posisyon na 15 years na nakatira. Lately lang Po ay nagsabi di na maghahabol at iayos na daw non nakabili at ibalik sa pangalan Kasi Pina cancel Po nila. po, Tanong ko lang po sana regarding sa case namin, May lupa po kasi kami na gusto namin ibenta, may hawak po kami na TCT pero developer parin ang naka name which is "Verdant point" wala po ba problema yung kung ibebenta namin kahit di pa naka transfer sa name namin? kasi un po ang suggest ng Developer po, sabi nila since ibebenta naman din namjn yung lupa wag nalang daw IPA transfer sa Amin yung name para yung Buyer nalang daw amg Direct na magpa transfer from developer to our buyer's name. tama po ba yon? kasi may agent na nagsabi samin na hindi daw maitatransfer sa buyer namin yung name sa TCT kasi need pa daw namin ipalipat sa Amin yung name since name namin ang nakapangalan daw sa deed of sale po. naguguluhan kami kasi wala po talaga kaming alam po sa ganito. pwede po ba namin ibenta po ung lupa kahit na Ang naka name pa sa "Transfer cert title" is developer? and kung sakali po naibenta pwede po ba na from developer is deretso napo sa pangalan ng Buyer namin yung name na hindi na naman kailangan pa ipalipat samin? Hi po. Good day! My mother inherited a land from her parents. Unfortunately, they did not agree as to how it would be divided among themselves (heirs) thus resulted to a judicial settlement..and this happend more than 20 yrs ago.. All the while we thought that it was already ok since there is already a judicial settlement. However, lately, my aunt claims that the land where our house is located is theirs even if it is clearly stated in the judicial settlement that that part belongs to my mom.. Good day po atty, ask ko po sana if my procedures po na pwede naming gawin to revise a notarized deed of extrajudicial adjudication with sale . hindi papo nasurvey ng Geodetic engr yung area na nabenta.. Year 1998... Dinimonstrate po ng aming lolo ang hangganan verbal(walang kasulatan) at Dahil malaki rin po ang tiwala sa bumili hinayaan nalng ng aming lolo na syang magestimate sa sukat ng area (with the help of an engr.) tapos pinirmahan nalang ng aming lolo na nagbenta without expecting na masyado na pala malawak ang nilagay na area compared sa dinemo niya noon na boundaries.. No formal education po ang aming lolo, pati ang isang anak at kanyang manugang na nagwitness sa deed of sale ay elementary level din po(may tatlo papong anak si lolo pero hindi pinapirma sa deed of sale) seperate tax dec palang po hawak ng both parties.. Hi Gamer! Kung namatay yung husband, the wife and the children become his heirs and they all have rights over the property. Anyone can get hold of the title pero kung sa tingin nyo medyo may gagawing hindi maganda yung humahawak, you can file for an adverse claim sa Registry of Deeds. Pero I advise that you settle now the estate of your father. I encourage that you do an extra-judicial settlement to preserve peace in the family.
