I respectively disagree because the flags were used in a “political context.” The issue is the Justice is on the highest court on the land. And the court isn’t a “political court.” The ethics of attorneys and Justices should avoid any appearance of “political leaning or bias.” In fact, the ethics of Federal Judges at lower level courts require them to recuse themselves if there exists even an appearance of bias or impropriety. Chief Justice Roberts put in place new ethics guidelines after the media reported Justices Thomas and Alito received millions of dollars in value of unreported trips, and “gifts.” For example, Harlan Crow paid for a RV and hose for Justice Thomas. My argument is that is not an effort to discredit Justice Alito. This is an effort to question whether Justice Alito should be recused. Justice Alito brought the question of whether he should be recused from any cases associated with the Jan 6 event and the Former President by allowing the two flags in question to be flown on his properties. Did you consider that Justice may have purposely flown those flags in defiance to current affairs or to state his stance to and allegiance to the Former President?

Thank you, reasoned argument. The one commenter mentioned flying a team flag. That is perfectly fine as a fan or player. But if the referee came to the game flying the flag of one of the teams it creates an appearance of impropriety. Judges are held to a different standard for a reason. They have to be trusted for society to have faith in the legal system. Even the mere appearances of impropriety should be avoided even if there is no substance. This should be obvious to a neutral 3rd party. To be clear...The same principles should apply to a liberal justice appearing to favor a party due funding, etc.

But see, Tom, Justice Alito is a US Supreme Court Justice, who is supposed according to Chief Justice Roberts new ethics, “avoid the appearance of any bias.” Because him and Justice Thomas were found to have taken millions of dollars in undisclosed “gifts.” Then heard cases from some of those people (donors) who provided the “gifts.” It just “smells bad” even though Alito and Thomas may have not “changed” their rulings in favor of the donors in any of those Supreme Court cases! So, Tom, it’s all about them avoiding the perception that they could be biased not that they really are biased.. they just shouldn’t be putting themselves in that position in the first place if they were NOT BEING POLITICALLY BIASED ON WAY OR THE OTHER. Interesting fact you stated. One of my offspring was asking this week if we were as recent as three generations so that he could get a passport from one of the EU nations. He's out of luck on that one. We've been here since around 1600. No cigar on that passport because a great- grandparents came from Europe thing.
