The validity of a "pirate presence" off the coast of Somalia extends only to the prevention of foreign ships dumping nuclear waste. Essentially, because of the dissolution of ANY formal government in the country, any protectionary naval force would qualify as "pirate". This validity is lost, however, when commercial freighters using the shipping route are hijacked. The continued search and subsequent argument over where this all started will do nothing to rectify the situation.
