“For any drug where they fail to play by our rules, and if that drug came about because of federal funding for what’s called ‘R and D,’ research and development, I will snatch their patent so that we will take over. Yes we can do that. The question is, Do you have the will to do it? I have the will to do it."

Insanity is letting drug companies use federal funds to pay for a drug's research and development, getting a U.S. patent on the drug they develop so that no generic version can be marketed by a competitor, and then charging the consumer an exorbitant price for the drug while unethically using the cost of R & D as their excuse for the pricing. "The pharmaceutical industry spent $83 billion on R&D in 2019, according to the Congressional Budget Office. Companies are estimated to spend somewhere between $1 billion and $3 billion on average to bring a single new product to market. In 2019, the U.S. drug market generated more than $490 billion in revenue, accounting for almost half of the global pharmaceutical market, according to the database company, Statista. Americans spend more on prescription drugs per capita than citizens in any other country. In 2019, that worked out to more than $1,200 per person. A 2021 Rand Corporation study found U.S. drug prices were 2.56 times higher than those in 32 comparable countries. A Kaiser Family Foundation Health Tracking Poll published earlier this year found that eight in 10 adults said the cost of prescribed medications was unreasonable." from UC San Diego

There is just so much horrible stuff to unpack in this. Why doesn’t she tackle the fact that taxpayers are funding R and D for pharmaceutical companies? Why doesn’t she say that she’s no longer going to allow the federal government to mandate that we buy specific drugs that they decide are good for us? Why doesn’t she call for transparency in pricing for not just drugs but all medical care? Why doesn’t she discuss the unholy relationship between the pharmaceutical companies and the regulators? It was government meddling that created this hot mess in the first place. Now she’s promising to fix it with more government meddling. To the point where she’s willing to set a precedent that the United States government can seize patents.

This 2019 video taken from CSPAN from a campaign event in Iowa featured Kamala Harris arguing for the government setting a “fair market.” Companies that don’t comply, she said, would be stripped of their patents if the drug company received any federal funding. “For any drug where they fail to play by our rules, and if that drug came about from federal funding for what’s called ‘R and D,’ research and development, I will snatch their patent so that we will take over,” she said. “Yes we can do that! The question is, do you have the will to." Harris argued in 2019 that a “fair market” price for drugs would be determined by the government based on an average of the cost worldwide. “We are going to set drug prices based on fair market,” she said. “So, essentially what we’re going to do - and you can visit the website if you will, and if not, get you some documents - but essentially what we’re going to do is set drug prices so that American consumers are charged a price for drugs that’s the average price that’s being charged around the globe.” Notes: ✔️A new study showed that taxpayers have been footing the bill for every new drug approved between 2010 and 2019. The increase in pharmaceutical sales has also generated enormous profits for the pharmaceutical industry. Another study, recently showed that from 2000 to 2018, 35 large pharmaceutical companies had cumulative revenue of $11.5 trillion and net income (earnings) of $1.9 trillion. Moreover, that study also showed that large pharmaceutical companies had median net income margins of 13.8%, significantly greater than those of other large corporations in the S&P 500 (7.7%) and similar to those of other research-driven companies. (What is S&P 500? The Standard & Poor’s 500 index - The index contains about 500 of the largest publicly traded companies in the U.S., making it a bellwether for stocks. It includes stocks across all 11 sectors of the economy representing about 80 percent of the total value of all stocks trading in the U.S. markets.) ✔️U.S. markets are subject to less price regulation than are the markets in many other countries. Drug companies can mostly set their own prices, although some federal agencies purchase drugs at prices subject to a statutory cap, impose statutory limits on how quickly a manufacturer can raise its prices, or receive rebates from manufacturers that are specified in statute. ✔️A super long sometimes boring & complicated read!: www.cbo.gov/publication/57126 "Finally, the patent system and certain statutory provisions that delay FDA approval of generic drugs provide pharmaceutical companies with a period of market exclusivity, when competition is legally restricted. During that time, they can maintain higher prices on a patented product than they otherwise could, which makes new drugs more profitable and thereby increases drug companies’ incentives to invest in R&D." About the H.R.3 mentioned in article: Elijah E. Cummings Lower Drug Costs Now Act passed in House Dec 2019. R-Nay 192; D-Yay 230. Received in Senate 12/16/19..Sat there - Republicans controlled the Senate. The bill passed on the House Floor in December 2019 and later served as the blueprint for the drug pricing provisions included in the Inflation Reduction Act. www.govtrack.us/congress/bills/117/hr3/details ✔️"Contrary to industry claims that March-In authority was not envisioned to address price gouging, the >Congressional Record< leading up to the passage of the Bayh-Dole Act reflected the understanding that March-In Rights were necessary to foster market competition and combat unreasonable profiteering on taxpayer-funded inventions.": www.citizen.org/article/expanding-access-and-affordability-to-taxpayer-funded-drugs-the-use-of-march-in-rights/

So, essentially, you're saying that it's OK to smatch those patents because the drug companies received federal funding for development. See, here is your classic problem-reaction-solution game. It why the federal government grants funding to anything: For control. The solution is not to fix one problem (corporate corruption and profiteering) with another problem (allowing the government to engage in price fixing and giving the government more control over the economy and our lives). Instead, end government funding. The government had no business giving our tax dollars to private companies in the first place. They don't have any business funding our school systems, etc., etc. Government funding is the poison that corrupts every situation. Now every enterprise, no longer free, only jumps through hoops to get federal funding instead of seeking to satisfy free market demand. We have not had a capitalist free market for a VERY long time.

What is she right about? Why would pharm invest in new drugs if the feds price set or take their patent? They will only produce drugs that make them a profit and stop R&D and investing in high cost drugs. Price controls are nothing new. Countries have tried and failed many times because it will always cause shortages in the product being controlled. The feds shouldn't be investing to begin with since they also approve the drugs. It's a conflict of interest. Set a time for the patent to expire, and then generics will compete. That's how prices come down.
