Wrong. The proper retaliation would've been to report the initial Game for "stealing intellectual property" as it contained Movie and Book Characters mostly, which none of them probably owned. AND then ruin 'Camel' even more by reporting the illegal wild animals to the authorities.

Just call in the feds" *_However, Camel has money of some type and is clearly the petty/obsessive/deluded type of power-hoarder, so that action would have been inadvisable if OP isn't able to handle further fall out._* It's possible that was never considered both to expedite "moving on" entirely from Camel and Chihuahua, and also because of fear of further obsessive reprisals. @@MikayaAkyo Nah that's not how that works. The reason Camel was able to DMCA their game was because it was (admittedly) a quasi-copy of the original, aka "her", game. For them to DMCA camel in return, they would need to make some case as to how camel infringed on some intellectual property they own, which they can't. You can't DMCA on somebody elses behalf unless you are authorized by them, so only the copyright holders of the movies and books she lifted from could do that, and they certainly won't care.

I've never heard of livejournal, never heard of the kind of games he's talking about, and i've never heard of a dmca take down on anything other than youtube or twitch. Still, it's a very unusual set of characters. I feel like this could be turned into a campaign in and of itself. Maybe in call of cthulu. I mean the dirty broken down house in the middle of nowhere, the eccentric wealthy woman with exotic pets, the emotional highs and lows, and the terror of being forced into hiding...yeah, i could see it working.

I'm 99% sure the DMCA claim technically had nothing to do with the characters being played. Instead it would've been claiming the game itself - the premise of it, the wording used in the out-of-character info pages, etc. Even if it wasn't, trying to get the copyright holders of the characters involved would've been extremely messy. Not worth the huge risk of dragging the people playing the characters into that kind of legal mess. Especially considering this likely happened during a time that it was way more common for anyone doing fanfiction (or similar things like fan RP) to find lawyers coming after them indiscriminately.

What you make is public property and if someone else wants to make money off of your ideas and determination without having to put in even the slightest bit of effort, you should let them without a moment of hesitation or consideration. @JustDev i know and look at how much obviously stolen or copied stuff is in China right now cause there copyright law is practically non existent. I won't deny that it's a more recent thing and people were just fine without it prior, BUT people who invent or create things for profit want to protect their patent and make sure no one is trying to profit off their hard work. As stupid as it seems it's to make sure that people can't just make your products regardless of what they are without permission and without paying the price for it. Also the first copyright law in the USA was made in May 31 1790 so it's more 230 years old not 100.

This story... It uncomfortably reminds me of circumstances I've been through before myself... Twice. The first time was certainly more like on OP's side. The second time... I can't help but wonder sometimes if some of my players view me in a similar way that the players in this story view Camel or Chihuahua. I've got a lot to think about.

This is taking neglet to a whole new level, ambitious people often do this, they like a idea so much they put a lot of effort into it but don't take into the reality of maintaining that idea. I am a fairly new DM and I can say it takes a lot of time and work to make your own world or story for your game and it gets frustrating at times. These people in this story I just heard on this video sound like they have some serious issues with just putting any effort into anything in life.

As someone who grew up in a household like he discribed and now like my home to be clean to the best of ability, your right. Anything fun or getting paid for they put work in but fun things their sparatic. If you have mental issues deal with them, happy things don't fix them. Clearly these two saw it as okay when in fact it's terrible. They need help and RP is only making them feel better sometimes numbing a wound that has a bullet still in it as a solution will just lead to to having the hole and void inside you bleed for much longer. Sometimes you need to feel that pain pull out the toxic peice of metal and sow it back up. These two clearly want to lesson the effects but even that is effecting other people.

The work part is what they dont want to do but that is whats a important part of life, you work for something and you feel good that you finished it giving that sense of fulfillment. Thats a basic way of looking at it. The fulfillment without the work feels like a void.

He actually could have sent a counter-notice against the DMCA. Camel would have to declare a lawsuit against him within 14 days or else livejournal would have to put it back up. I think it’s pretty irresponsible that the site admins don’t know that. Also thank you for putting both parts in one :) .

Oh, livejournal rp drama. How nostalgic. I would like to add, though, that while there was lots of copyright infirngement going on, the bad mods would have grounds for DMCA if they just copy & paste the premise text. From what I remember, pan-fandom crossover games were a dime a dozen there, so just moving games should've been enough. Wonder if there was more to the premise than the usual games, the copyright law was just that bad, or if there was more to the story than just what we got.

IANAL: Technically the site is correct in that they cannot take sides and get in the middle of it, BUT, the DMCA provides a counter notice mechanism to claim something is not infringement. After receiving the counter notice, the site "should" put the content back up (or allow it to be restored by the account holder), then it's up to the claimant to file a suit to prove infringement.

So my understanding of dmca law is that if someone files a dmca takedown notice, you can file a dmca counter takedown notice and restore your stuff. Then it falls on the claimant to either file a copyright lawsuit or forfeit the rights to their intellectual property. If it turns out the claim was frivolous or malicious, then you can sue to reclaim costs. See Carl Benjamin vs Akilla Hughes

That is a trial from 2017, this seems to be well before that day. Also, fair use comes into play when altering it to fit into a narrative, this was done to exactly match by only changing location which is not enough for fair use. Now if they finished the plots made before hand and moved on, then it could be considered fair use as there is more added on to make it their own.

Perjury is a felony punishable by five to ten years in prison or a $10,000.00 fine depending on what the court decides.

I'm getting flashbacks to a number of things: one of them being the LARP I used to take part in, years ago. There are too many unsavory details for me to safely recall from that time; all I can say was that friendships were horribly broken, and even a marriage was destroyed. Other thing I remember was the copyright claim that was slapped against MxR Mods, years back, for him reviewing a Skyrim mod that was a collection of other mods; yet the person who did the "mod collection" practically slapped a DMCA against him, claiming that this collection of other people's mods was HER property. While I don't follow MxR as much, anymore (because he unwittingly doxxed someone on Facebook, a few months back, and his more radical fans DEFENDED him for it) I also refuse to touch any mods from the karen who tried to claim a bunch of other modders' works as hers.

Camel reminds me of the Roleplay Board i'm still a member of. The Admin of it would set ridiculous rules and regulations and be pissy about anything others brought to the game. You weren't allowed to play any character that she didn't like. Eventually she lost interest in the whole thing and the Co-Admins took over mostly, trying to keep the whole thing running, they eventually managed to contact the Head-Admin after a year of the Board dying and managed to convince her to revamp it into including more (The initial setting was a School for Non-Humans where there were Day-classes for the daytime-active species and Night-Classes for the nocturnal ones.) So it was reformed to include the surrounding City and mostly remove focus from the School-setting, degrading the School into just another facility characters could go to. My character back then started out as a Student in the Night-Class as i created her as a Demon initially (well Half-Demon specifically as i took her from another Board that was deactivated previously which was why i looked for a new one) Anyways, the Co-Admins sent out a Mail to all users that contained information and also gave a hook for re-entry. Basically it was to skip in time 2 years since the initial board's setting and detailed how more and more Non-Human species were found and the City kind of became a 'Safe' place for them to be at and also attracted them due to the Anomalies (Portals) that showed up there. Those were kind of existing in order to explain beings from entirely other worlds being there etc. As for me i decided to go ahead with the Story of my character and say that she attendet the School a year before she decided to return home since her father found out where she was and demanded her return and, since the school couldn't allow her to stay due to her being a Minor at that time, had her older sister pick her up. (It's to note she had Amnesia at the time and was under impression that said sister is her Aunt.) Her Re-Entry to the City was due to her wanting to return to School at the Academy and her father, after realizing she actually had fun there, allowing it as long as she didn't live at the School and instead lived with her 'Aunt' instead, which my character agreed to. Also she was changed from being classified as a Demon to being classified as a Hybrid. Co-Admins and me would work out that, since she wanted to conceal her identity as much as possible, she would lie about her heritage and say she's a Demon. (Which was another nod to her previous forum as there she was a Half-Demon that shared a Body with her sister and was under the impression of being the most evil Demon alive) Fast-forward a few months and the Head-Admin would return, smugly trying to get thing 'rolling' again. we later would find out that one of the players would tell her that the Board was active again and thus she returned to reap the praise for... doing nothing. The Co-Admins played it cool and didn't tick her off at all, but secretly we had created a Discord Server and constantly made remarks about how we really just wanted her to leave. Eventually she got caught up in IRL-Business and then, as the Board's activity tanked (due to her) she lost interest again. Lucky for us the Co-Admins, 1 year later, contacted the Board-Host and managed to gain FULL control over the Board as they could proove she hadn't logged in personally for a year and even a private statement from her that she wasn't interested in it anymore currently. We all questioned wether or not that was a nice move, but eventually agreed that 99% of the work wasn't done by her anyways so, why should she retain control? few months ago the now Admins annouced a big change which essentially was cutting ties with the Board-Host for good and launching a privately hosted Board instead which gave them more freedom in design and all.... and since we didn't run on the initial Account anymore, removing any chance that the previous Admin could regain any control.

Back in the day when LiveJournal was still a thing, RPGs could survive for 5+ years. I never RPed on LJ, but on places like ProBoards and InvisionFree (now Jcink). Nowadays, play-by-post RPGs like this are lucky to see 6 months. I imagine the game went on for quite a while but ultimately died, as is the fate of all games. 🤷🏽

Never build a new relationship / friendship by using a negative foundation (eg complaining about another person, group or thing). It will ALWAYS come back to bite you. It’s tempting to do when you both hate the same thing(s), but leads to an intrinsically negative relationship and bad juju. Always focus on the positive and build on that. Just my thoughts based on this narrative. Love the channel.

Gonna get some flack for this, but, the whole story aside, OP has a writing style that really gets under my skin. The over use of big words (half of the time incorrectly) and overcompensation of "good grammar" are things that I almost exclusively experience from people who want to be viewed as the "nice/good guy" in any story they recount. I'm enjoying the story as a story, but I can't see myself buying everything that OP said happened as truth. Anyway, thanks for another good story time!

Am running a quietly successful homebrew sf play-by-post on discord, and I once was caretaker GM for something like it on a vbulletin forum (wow im old). And one thing I've seen time and time again is that *GM is a verb!* A moderator who isn't active or trusted has no power to affect people whatsoever, and a regular player who stirs positive activity and crafts the plots will have all the authority a GM would normally ask for. If anyone's running a play-by-post and reads this, i actually recommend choosing 2-3 co-GMs by player election. You will rapidly see the creative players elevated, and the That Guys will get themselves retired through self-inflicted drama soon enough.

OP could have easily retaliated. Camel was harassing the group. OP might of had to sacrifice a few new rooms of games but a clear pattern would get live journal to take action and if she persisted then that opens legal options too.

Intellectual property theft does not exist. Intellectual property is not property and therefore cannot be stolen. Intellectual property is a synonym for monopoly. If I have a monopoly on apples and you produce your own apples in your own backyard then you are not guilty of theft but of monopoly infringement. If I have a monopoly on a character and you produce your own version of that character in your own story then you are not guilty of theft but of monopoly infringement. I know the term is confusing, but intellectual property has nothing to do with property law and everything with monopoly law.

Does anyone else think this story seems greatly exagerated? I'm not saying the story didn't happen and I don't doubt someone would abuse copyright in this way but I am saying that OPs description of Camel and Chihuahua and himself seem very exagerated and fake. I'm mean the OP paints himself as an inocent naive angel while Camel is litteraly comicaly bad.

I too was there, when the russian army came and stole our land. Leaving us no choice but to migrate to other places. These young-ones don't know how lucky they are that they didn't have to go through that. the confusion, losing track of people you knew, hoping to find them again once new land was found suitable to settle on.
