I disagree. This case shouldn't have come to trial. There was no chain of evidence so none of it should have come in. The Grand Jury was lied to by the accident reconstruction gremlin. His stuff shouldn't come in. I have never seen such intentional incompetence ...😢

The CW had the ARCAA report just like the defense. That should have been the end to this. But they doubled down and introduced Trooper Paul.

I agree! The chain of custody for every piece of evidence is such a mess, I do not get how it was ever all let in!

I’m from WA, I have no reason to like or dislike Karen or anyone else. I give cops benefit of doubt until I can’t. I have seen not one good argument for her guilt.

Agree with Andrea regarding the jury instructions, I got the couple of the higher charges- but I was lost with the DUI charges and felt they spent too much time on those.

Im following almost everything and All live trial with this case,this panel i missed maybe couse we are about 8 hours far than there. I live in Finland and have addicted to this case,thank you all talking about this🎉❤ sorry my not so good english,learning every day something new,started learning summer 2020,beginning Steve Wilkos show,judge Judy and paternity court😅 then came Depp/Heard trial and now this😅

I am glad Karen didn't testify, although if i was on trial especially if i was innocent i would want to have my say. Unfortunately i don't think she would be a sympathetic character, even though she's a beautiful woman she comes across as quite haughty and cold, in other interviews I've seen she doesn't come across as likeable. I'm not having a dig at her at all, i have the same problem (minus being beautiful 😂) I was the main witness in an elderly abuse trial that went to court 3 times, i was attacked by the defence for my cool calm demeanour, and was also told off by the prosecution barristers (who were on my 'side') for being unlikeable and having a face people just don't like 🤷‍♀️ i would be afraid Karen would give the same impression.

This goes to what Mark was saying about Karen not testifying and disagreeing with Andrea…… I agree with Mark and also when he mentioned how they were rushing Karen out and away from the cameras more towards the end of trial when we were waiting for a verdict, I think it was because of something she said when she was walking to the car the day the 2 defense experts testified(The Crash Daddies). There was a cameraman who asked her something like, how she was feeling after those experts testified and she said, “Great, they proved I didn’t hit THAT BODY”. I believe in Karen’s innocence and have been praying for her, but when she made that statement about “that body”, instead of saying John, I have to admit it made me feel some type of way……meaning, it kind of bothered me. Now, does that mean I think she’s guilty, NO! However, it’s one reason why I agree with Mark and say she shouldn’t testify! 🤷🏽‍♀️

Listening to Andrea Burkhart and Mark Bederow, it makes me wish I had a law degree! Great panel. Thank you all for showing up. The general consensus seems to be Karen Read should be acquitted: "beyond a reasonable doubt".

Great show! and I love the comment that Brian Albert didn't have whisky? Another thought Brian Higgins gave Brian Albert a ride back from New York and Brian Albert wouldn't offer him a whisky? That doesn't make sense. Its obvious John knew Brian Albert but he was not friends because if he was he would have known where he lived given Canton is not a big town!

The thrown glass theory is what cemented her innocence for me. I thought "Oh! He threw the glass.. it shattered... BA & Colin or Higgins confronted John, Chloe got involved, and sh*t went sideways."

Imo they can't find her guilty of 'anything', because they haven't definitely proven anything. The only actual 'evidence' is a he said/she said situation.

A question I've never seen posed; how do we know Karen dropped John off at the Alberts? She said initially she last saw him at The Waterfall, but Jen said no u were at the house. I mean, people supposedly saw Karen's car when she was already back at Johns house, so how do we know.

Damn! Andrea nails it! When you haven't paid attention to every single moment = things are easy to miss! And if the jury can't refer back to their notes, then how can the jury come to a solid decision? Andrea starts on this at 33:19

I’ll sorry, but shifting the burden of proof is NOT a “fine distinction.” If a jury doesn’t understand that all-important essential non negotiable concept, they aren’t capable of doing their job.

The thrown class theory allows the idea that John threw a glass, then Karen sideswiped him. I agree that theory of a glass being thrown made things murky. Personally I think Mass Troopers decided her guilty based on what Brian Albert told them and accidentally broke taillight when trying to break off a piece to leave at scene. I don’t know how John died and since no real investigation was done who knows if we will ever know for sure.

I did not view the glass thrown as a theory. I think the reconstructionists had this idea and testing it, they found it was one way they could replicate the damage to the tail light. However, the damage could be replicated in many different ways e.g. a baseball wielding person hitting the tail light.

Dang it! I forgot this panel was happening but I’m so stoked to watch! Brandi + Mark + Will (The Glarer) was a dream come true but now you have Mike and Andrea, too?! I’ve really come to appreciate Andrea’s commentary and insight covering this case from what I’ve seen of her repeatedly in Aussie Insider’s videos - I had to subscribe to her right away! She is incredibly smart and explains herself clearly. AND she’s a boxer?!? What a woman! 🤙🏽👑

Read the words in the release from Morrissey I see the text as a "catdoor" to get out of doing it (Catdoor is what we say in Denmark if you want to sneak out of something you said you would do)

Yes the goal was to confuse the jury but why the hell did they introduce the tail light evidence in the closing yet we never saw one photo like this throughout the whole trial? The dam, smoking gun at the very end. In fact, both did that, and neither interrogated Sergeant Barros about his observations of the taillight in question. The defence could’ve benefited from this, but they didn’t. Why why? Why why?

Just like every motions, questions and evidences that the defense team presented in pre trial hearing's, and the Judge denied or delayed, i think that she have intentionally been doing everything she can to help Lally and hurt the defense team...i wonder when she decided that the closing arguments would be restricted to 1 hour, because we have all been seeing her disrespect for the defense team..😢

Is the story that JOK was drinking out of a cocktail glass?? As in, they claim he took it from the bar? I don't know what bars they're drinking at, but you can't usually just take the drinks home with you (unless you're in Vegas) even if you're a cop. You also can't have an open glass of liquor in a car, like wtf?? If I have the story wrong, sorry. Otherwise, it makes more sense if he went inside and got a drink. Also, the gall of all of the cops and their family and friends to accuse KR of a DUI, while openly admitting to drinking and driving that night, while none of them can even remember if she was even drunk.

Yes, they showed him leave the establishment with a glass on video. I dont recall if they matched it to the bar glasses, they did not attempt to match it to the glasses inside the BA home at fairfield. Everyone was drinking and driving, which is sad and disturbing but they all were guilty of it.

I’ve been a bartender over 25 yrs, tons of ppl do it! And it’s ppl from fine dining all the way to ur whole in the wall strip club, they take their drink with them all the time! Esp if it’s a place that doesn’t have xtra security watching ppl coming and going, bartenders don’t see everything.

@@babsmageezie3932 wow! I was a regular at a bar in NYC for well over a decade, and I never saw that there, but I probably wasn't paying attention. I know the bartenders there (my friends who worked there and owned it) woulda been pissed, but also the nypd crack down hard on anyone drinking outside, so I genuinely can't imagine anyone doing that. (Obviously doesn't mean it doesn't happen just cause I didn't see it, lo!). I lived in NYC as an adult for so long (I only moved away recently) that I was never around DUI culture either, so seeing all those witnesses casually admitting to it is bananas to me.

The defense isn’t asking us to believe a conspiracy. They DONT have to prove anything! That is the prosecutions burden. Defense ONLY needs to create reasonable doubt!!! There is freaking PLENTY OF REASONABLE DOUBT.

Why does nobody talk about the reasonable question a jury might have namely "why kill someone and put him on your own frontlawn?" I cannot wrap my head around why tbe defense did not explain it to the jury that John HAD to be put out there?? And...no word was said about the blood John MUST have lost... where is it? where can it only be....no word... Unbelievable

Unfortunately a 9 week trial was condensed into a 1 hour closing speech. Aunty Bev wouldn't allow witnesses to testify to anything because of Lallys constant objections. Some witnesses were banned from testifying at all. A lot of evidence wasn't allowed in either. DR Russell was more than qualified to testify to road accidents, bruising, etc....but was only allowed to testify to dog scratches!! The biomechanical engineers weren't allowed to testify to their experience just strictly the tail light. Yet cops with no medical degree were testifying to injuries etc!! It's been a complete and utter ish show

I would like them to have compared Karens phone to Johns to prove that her Appledata didn't show her climbing stairs or taking steps at the same time as John. The problem they had was that you have to have a witness to introduce it .....Lally objected to literally everything to stop things being introduced

I don’t believe the McAlberts meant to kill him I think there was an altercation possibly with Colin involved and they let John leave or threw him out expecting he would be found incoherent somewhere on the road. I don’t believe they thought he was that badly injured.

I am with the minority that Andrea is too ..If I was Karen..I would have testified.!!! If you are innocent you have NOTHING to lose. Especially when the demeanour is rather chilled and showing no grief 💯

That’s a high risk I’m happy she didn’t testify. Things can be twisted or answered innocently but wrong. If these corrupt people brought this trial on this crap evidence what do you think they would have done to Karen on the stand even with Lally asking the questions. 🤷‍♀️. I’m just hoping to hear NOT GUILTY today

When you’re innocent you have everything to lose not sure where you’re coming from at all I couldn’t disagree more, its all the more reason not to testify and make the state prove your innocence and don’t give them a chance to paint you in a more guilty light then they already are especially w as illicit as this CW is , its a huge risk to take and I believe they gave her great advice and she had great representation imo. ;)

When she is up against such institutional corruption that has existed for generations getting this to trial was a landmark. I think it was wise she didn’t take the stand.

Testify about what? She doesn’t remember anything from that night. What does she have to testify about? Jurors ARE NOT PERMITTED to use the fact that she didn’t testify as “evidence” of her guilt. The 5th amendment provides a right against self incrimination. Your constitutional rights CANNOT be held against you or used against you. What does “the demeanor is chilled and showing no grief” even MEAN?? Is that an English sentence? Are you talking about Karen Read’s demeanor in court?? You think she should have been sitting at the table crying every moment for 9 weeks and if she wasn’t that means she doesn’t have any “grief”???? This might be the stupidest thing I’ve ever heard. You know nothing about her emotional state. You have no idea what emotions she’s feeling at any moment. Do you walk around all day displaying every emotion you’re feeling at every moment? Have you ever in your entire life seen a defendant sitting at the defense table displaying sadness for months on end??? What kind of insanity is this?

My friend was on a jury in Mass last summer and they were hung and sent back 2 times and it ended up being a “not guilty” so let’s keep positive.

Love the panel. But it’s crazy, I’m all in, watched every day, and my husband has no clue what is going on and he checks all mainstream media every day. He doesn’t KZbin or Twitter, or Facebook, but this may be only relevant if your cookies guide you, lol. Only commenting this due to mistrial possibility. We are also in Florida, but I’m amazed that he has no clue about this case even here.

Btw, don't judge all of MA based on Canton. I grew up in Western Mass (kinda near Vermont actually). I haven't lived there in many years, but it was very very different than Boston or those surrounding areas. Where I lived it was just forest and hippies. Not cop loving at all. No place is perfect, but many states vary a lot from place to place. (California is a great example of this-- highest amount of KKK in the US, and also the bluest state, go figure.)

@@archangel807 I have no idea-- like I said, I grew up in Western Mass, which was totally different. The area I lived didn't have any kind of cop culture at all. Based on what I know about dirty cops, though, just in general, they probably get a lot of money by doing dirty cop shit.

She lied. You will find she has been telling Peggy she was the only one to try and save John .....yet we know she was on the phone to 911 and then Nicole .....inside the car!! Jen at the time had no idea that she was being recorded on Johns voicemail. She started plying Peggy with lies from 11am that day. She also rubbished the 02:27 Google search ....yet when the phone is her alibi it's absolutely correct including Apple Data ....when it proves her guilt its absolutely wrong!!

But it’s supposed to be the prosecutions burden to prove guilt in the USA. We don’t say defendant is guilty now defense prove the person is not. So I don’t think a defense wants to lock in one possibility but say “what about this?. Setting reasonable doubt.

Same problems as many other theories with where the tail light glass ended up, John's shoe being seperated from him, snow being under him in the first photo we have, and a hit to the head on that frozen ground probably being unable to cause the head injury. You can imagine a world where the snow in the first photo doesn't accurately reflect the original scene, assume that the ground was sufficiently frozen and can explain away the arm injuries, but the rest of the injuries become all the more mysterious. The small bruses on John's knuckles and front of his knee cannot be explained by a fall onto the back of his head, and one of the injuries on the front of his head is known to be seperate from the back of head fracture. I'm very sure that any explanation involving Karen dropping John off and John dying before reaching the house is doomed to fail because of those details. A pedestrian collision is the thing which best fits all of those facts, and even it is absurd and clearly impossible.

The reason being Lally lies!! Notice at the end of Mr Greens testimony his question at the very end was ....You misinterpreted the evidence ....didnt allow MR Green to answer ....then in closing he told the jurors he admitted it!! He showed videos counting drinks that the video didn't show. He introduced an inverted video unknown to the defence. He knew about McCabes visit to Lank .....but they report came in after she had testified. Lally has no issue lying ....if you watched the pre trial he made a lot of claims that during trial were proven to be completely false!!
