Only $50K for the settlement? I would have wanted at least the equivalent of 5 years of salary including raises, bonuses, and commissions. Plus they would have to pay my lawyer’s fees. Finally, I would want an apology along with a glowing job of recommendation.

Sometimes people just want it over with and don't think it's worth going through all the trouble. That's why settlements are a thing. Though I would have asked for triple the amount.
@iglidor
@iglidor 2 жыл бұрын
And that is why lawyering up is important. They will know better if the offer is better or worse then what would a judge give them. We do not know the amount and severity of transgressions that would be provable at court. It is quite possible that judge would be willing to give them only 75-100k at best. So getting 50k now and not have to deal with lawsuit and cost that goes with them could very well be the better outcome
@superdave8248
@superdave8248 2 жыл бұрын
Actually, $50k is generally higher than the average EEOC out of court settlement. But still I'd have countered with $50k, legal expenses, and a written apology with a defamation clause that any negative comments made by any current or future employee about the OP would be grounds for another cash payout. Because the OP has to use them as a job reference and the only thing you want their representative stating is that the OP fulfilled her contract.

I used to work at Dollar tree. I hated that job because they always wrote me up for the dumbest shit. The first write up was because I had "too many void purchases" which is dumb because we were in California land of the indesisive and I always had people changing their minds about stuff they wanted last minute but I can't void more then 10 items a day and have more then 30 a week. Hell one time this lady came up with 3 items $3.24... it was "too expensive for her so she asked me to void out one of the times bring it down to $2.16... it was still too expensive so she decided she just wanted one of them... Then she asked me to put one of the other things back on...then off again... And after racking up 5 voids I told her if I keep doing this I'm going to get fired and to please just decide now so I wouldn't get into trouble... She got all 3. The second write up was because my manager had lost some money. Normally I would stay to count out my drawer before I leave but one day it was crazy busy, my replacement had run late and I was looking at over time. So they told me that I can just go since there was 3 managers there who can count it out and confirm the drawer count. Before I had left but after I clocked out one of the managers told me my drawer was off a few dollars. $3 is a write up anything more then that is instant termination, so I was freaking out. But I had remembered that they had messed with my change earlier that day and told them to check the safe. I come back the next day and had asked them if they had found the money and the manager I talked to the day before had told me that the money was indeed in the safe. Well a few days later I'm being handed a write up for the incedent. Which pissed me off because they had told me it was resolved. And I didn't technically get a third write up but one of the bitchy managers had threatened me with them over the dumbest crap. I treat my coworkers managers included like I would treat my friends. I'm friendly and I joke around with sarcasm a bit, but I do what I'm told and I know when I have to be respectful and professional. None of my other managers have ever had a problem with me but this one newer one had some vendetta against me or something. I tried to get along with her I really did, I don't like fuding with my higher-ups because it just means more unessisary problems for me, I went out of my way to get her to like me more like offering to get her coffee some times or even staying late after work one night to help her jump start her car and such. But no matter what I did she would always mock me, mimick whatever I say in a really consensending tone, and even threatened to write me up once for insubordination just for making a sarcastic joke to try and lighten the mood after a long night.

50k seems pretty low, that's like, what, one year's wage for one employee? For the amount of legal trouble OP had the ability to get them into, they really should have come with a better offer than that. If it went to court, they wouldn't even HAVE a company anymore and some of them would likely be in jail. They're lucky OP just wanted a quick win at that point.

The specific type of revenge drags in too many completely unrelated people in my eyes. Given BB worked in finance marketing, it would have probably enough to circulate the info that she had been forging official documents to have nobody interested in doing business with her in that field ever again. Great story. Can relate. I worked 3 jobs and went to school online. 2 of those jobs had petty, spiteful, power hungry Karen’s as my direct supervisors. I was retaliated against regularly. I was working on a human services degree and had several classes in psychology and critical thinking. I documented everything that was done, got them both fired, and was granted unemployment in full. So I got paid to go to school, spend time with my kids, and bask in my pool. What a great time that was.

In the last story it was good that she was able to get a satisfactory settlement with the icing on the cake being BB getting fired. Maybe I would have done the email bomb the first year, but after that it became an obsession preventing her from seeing that she was also disrupting the work of the innocent employees at BB's company. So 18 years of as she said "petty revenge" of bombing BB's company went out of business leaving the innocent employees without a job. 18 years is way too long to be exacting revenge. How much energy and time did she spend over 18 years to carry out the harassment of the employees of BB's company and how much stress, anxiety and disruption did she cause for those employees? How much emotional damage did she cause to herself because she kept her hatred with her? If I were her friend and found out she was doing what she was doing, I would have suggested she stop, and when she wouldn't I would drop her in a hot second. With that kind of hatred she likely refuse to take suggestion and move on, leaving me to wonder what she would do to me if I crossed her. MY GOD! Get a life. You have wasted nearly 20 years of your life exacting revenge because of your hatred. For most of us that translates to 20% to 25% of your life! What a waste when you could have been doing more constructive positive things with your time.
