The music business is not about making friends. It’s a business. LEGALLY, Beyoncé went through the proper business protocols to use the sample. Whoever contractually owns the music is who you clear a sample with. Kelis does not own the rights to that entire album and it’s unfortunate that the Neptune’s screwed her out of her money, but her beef is unwarranted with Beyoncé. She couldn’t sue Beyoncé if she wanted to. She doesn’t have a legal leg to stand on. Those are the facts. At the end of the day it’s not about peoples emotions and how they feel. Like I said before it’s a business and a brutal one at that. 🤷🏻‍♀️

EXACTLY. Not to mention, the sample consists of like 10 secs of a beat Kelis herself did not create. I looked at the credits on the album and there are so many I can’t imagine Beyoncé picked up the phone and called every single one of them personally. As long as things are done correctly, I don’t see the big issue. And Kelis knows damn well if you mention having any type of problems with Beyoncé, it’ll strike up a some controversy. It’s a bit of a reach for me personally.

However... it is simply not right that the first time Kelis found out her biggest hit was sampled was through a leaked album. There's a concept called professional courtesy. Just a few things of notable mention. (With the hopes of having informed dialogue) 1. It has been said that Beyoncé did things legally (got the sample cleared) and out of graciousness ( gave Kelis writing credit even when she didn’t receive it in on the original song.) 2. The song in reference is “Get Along With You” not “Milkshake” 3. Kelis was simply seeking communication (via email,phone call, text etc.) a heads up if you will. Not for permission as she is aware that she doesn’t have ownership in the song. Solely based on common courtesy, I agree with those who believe that she isn’t owed this. While it isn’t a requirement just in human nature/emotions I get it. 4. She (KELIS) did say that her gripe is minimal towards Beyoncé and majority of the focus is towards the Neptunes (most of the energy is for Pharrell) 5. Her issues are the familiar story of “new artist signs a contract that wasn’t in her best interests”. Hope this adds just a little more context

Team Kelis all the way. It’s specifically callous to use “well too bad you don’t own the song” as a way to gaslight her when that is exactly the issue. She doesnt own the song she wrote because her writing credits were stolen from her. This happens to a lot black artists. Instead of shaming her, we need to shame these predatory industry tactics that make it ok to steal from black artists because it’s written in a contract. We also need to encourage young people or others trying to get into the industry to use their own attorneys and make sure they understand what they are signing. Funky Dineva: Beyonce has been in trouble before where it's arguable her people knew and still she pushed through with the project or didn't care because she is the more famous holding til today between the two, and Deseree is known but clearly a different look, and isn't POP, like Beyonce has shared the genre of. It's hard to say, but she didn't have "the sense" then legally to not get embroiled with it, and Deseree did elect to SUE Beyonce, who some believe everyone is intimidated by, but apparently in this case, Deseree was not and won based on the merits of the case. Beyonce basically put the song on her deluxe album even after she (or her people) got a NO from Deseree for remaking the song "Kissing YOU." Deseree's version is PURE fire. The song as soundtrack for Romeo and Juliet was fire, although Beyonce wanted to bring it back, the reality IS, it can erase the original person and everyone swears that Beyonce is everyone's LSW hope, that brands the song with her signature voice, and makes it better. That's NOT always the case, as Bey sang this song, BUT it didn't HIT like Deseree's did. Albeit subjective BUT I challenge anyone to hear the two versions and not pick that UP. Beyonce is a chanteuse and a half, BUT this song has ebb and flows that just made Beyonce's a good version, it wasn't great. Who knows the reason why it was rejected, BUT to have Beyonce still release IT, was egotistical, if not a misunderstanding. Many of Beyoncé's iconic choreography and performances were straight up lifted from many international artists without giving them credit. The Countdown video was plagiarized from a well known Belgium choreographer. The choreography for Freedom was plagiarized from a Brazilian dance troupe. I understand Kelis's anger. It not JUST about Beyonce. It's the whole situation, but it doesn't make it any better that it is Beyonce. Pharell, it seems, did Kelis similarly to how Michael Bivens did Another Bad Creation. Because Michael was taken advantage of during contracts in the early days of New Edition, when he finally got that corporate role, he did the same to his artists. Pharell is an amazing producer but used the friendship, Kelis's naiveté, and the fact that they shared the same attorney (which is a conflict of interest) to obtain full publishing rights along with Chad for songs he did not write. As a result he gets most of the smoke. However, with her and Bey being in the industry at the same time you know good and well they knew each other. Most likely not friendly (especially since their men were at odds), but they knew each other and since Kelis has been open about her publishing issues, there's no way that the powers that be in Parkwood didn't know. So now, Bey samples the song knowing good and well that they don't really kick it like that and that Kelis won't see a dime of the money because she doesn't own the publishing and everyone expects Kelis not to say anything?
