Good ol' Johnny Law gave me a hard time as I was traveling to Memphis to film the video on how to 'Precision Fly' a drone.
The officer was in the wrong, and with a little help from my trusty dash-cam... I have proof!

in the uk , police cars are fitted with speed cameras, so even if the police car is moving towards you , and you are moving, the camera works out your speed. unfortunately, if the officer says " he was doing 82 " when you were doing 62, the court will ' usually ' take his word for it. unless you have another dash cam pointed at your speedo :)

FINALLY someone who was VERY professional during a stop and not rude. I give both you and the officer props for both of you being very polite, courteous, AND professional. Anytime I’m stopped, I ALWAYS turn on my hazards for a few flashes to show the cop I’m acknowledging them and am looking for a SAFE spot to pull off. Then once I’m on the side of the road, I turn them on again, shut my vehicle off and place the keys on the dash for them to see them and place my hands on the wheel where they can see them. If it’s nighttime, I also turn on my dome lights to help show them who’s in the car for everyone’s safety, show them that I will cooperate, and just to help them feel safer in general. Then once instructed I put my window down and when they ask for ID I politely tell them it’s in my back pocket and I just need to reach for my wallet. I’ve only had one rude cop encounter but the rest have always been polite and seem to appreciate that I take the time to cooperate and help everyone feel safer all around. Actions speak louder than words in situations like this.

Thunderbyrd also, if it’s night time, consider throwing on the interior lights so everything is nice and visible from the outside, and roll down the window as Ken did. Only thing I would say to do that Ken didn’t, is that when you are told to get your DL and Insurance, TELL the officer where it’s at and that you’d like to get it. Wait to be told to go ahead, and make your movement slowly. We definitely appreciate when people help us to know they aren’t a threat to us. Given the number of deaths just this year, it’s at the top of most officers minds. And yes, everyone will say, “I would never hurt a cop,” but no officer out there has ESP and can know that walking up to a car. In my area, an officer was killed by an elderly female she had dealt with numerous times and was going to give a ride to detox. So yes, everyone is treated as a possible threat. I do concur though that he began a little harsh. I also don’t understand positioning your car for a head on approach OR expecting that an oncoming vehicle will know to pull over as if they are being pulled over. Pull over to create a buffer between the squad with lights oncoming, sure, but pull over completely? No way. Even with, “the arm.”

Good advice, Ken! My Dad taught us (my brother, my sister, and me) that all responses are "Yes sir, no sir, or [answer to question here], sir." You show the greatest respect and courtesy to the LEO (Law Enforcement Officer) the entire time that you are in that situation. ...Years ago (an unknown number, as far as you know), I was driving back from a Summer vacation, 18 yrs old, and my best friend in the old car. We came upon a line of cars on I-12W, near Pumpkin Center, LA. As we weaved through the traffic, we came upon a State Trooper doing his best 'Pace Car' impersonation, cruising along at 55mph (the national speed limit back then)... So we eased past him and he soon disappeared in my rear view mirror... That took 10 minutes or more, but there was suddenly blue lights on my rear bumper! He came from -nowhere- in a flash! His FIRST COMMENT to me was, "DO YOU REALIZE you're the ONLY IDIOT on this highway who is NOT DRIVING THE SPEED LIMIT?" I thought to my self, "That's because all those other idiots were stuck behind you." HOWEVER, I did the 'yes sir/no sir' thing until he gave me a ticket for doing 58 in a 55mph zone... It was both an exercise in restraint and frustration, but I lived through it! Sorry for the novelette... :D

Around here our boys don't have cameras at all. They don't even have GPS on their cars. The dispatcher has to call and ask who is closer to a particular area. They don't have computers. They run cars down and call in tags while behind them. Being forgettable might not work in the city but I feel it would be effective around here.

Tennessee law, at least last time I looked at it, states that when passing vehicles in a passing zone, you must do it in as quick and safe a manner as possible. They make no mention of speed, only that you must do it quickly. So you can't be speeding if you're passing because your trying to get back in your lane of traffic as the law states. Nothing he did was dangerous. This is just an example of a trooper with nothing better to do.

Hello Ken. I may have some bad news for you. I am a retired Maryland police officer/accident reconstructionist. After analyzing the video, the good ole boy Sheriff was not too far off. According to DOT specifications, each of the dashed lines is 10 feet in length with 30 feet between. 40 feet total per segment. At various points in your video, I was able to count the segments and use a stop watch (not the KZbin clock) to time the distance traveled. The Speed Racer portion (0:13 to 0:16): From when you shifted into high gear until the camera edit, you passed 8 segments in 2.68 seconds. 119.40 feet per second or 81.44 mph average speed. The sheriff said 80 mph at 1:37. Because of the short distance involved if I give you the full 3 seconds elapsed, you average speed will drop to 72.76 mph. Ultimately, the shorter the distance, the greater the margin of error. Coming to the Long Arm of the Law: From the first yellow line segment after the white survey marking after the bridge until the freeze frame at the sheriff (0:26 to 0:36), you passed 22 segments in about 9.85 seconds. Giving you the full 10 seconds, your average speed was 60.00 mph over that distance. Leading up to the incident: Using the same principles, I calculated the car and pickup’s speed to be about 54.57 just before you started to pass them. The sheriff said 62 mph. Again, shorter the distance the greater margin of error. The good ole boy probably had his radar set to detect oncoming traffic only at the time. When you passed the car and the pickup, you became the first and fastest target on his radar. Frankly, I did not like his “You in a heap of trouble boy” attitude, but he is “The Man” in his county. You have a decision to make: 1. Roll the dice and take it to court. Remember - The judge could very easily be his first cousin and wife. 2. Pay the traffic school fee, go to the school and make a video about the experience. If it prevents your insurance company from finding out about this, you will be saving a ton of money. Happy motoring!!!

He was demonstrating to you, the car behind him, that he is checking for clear traffic to pass the slowpoke in front of him. And then you, with your sporty sports car decide to pass the guy who is obviously jockeying to pass another car, putting yourself in his left blindspot and risking all three of you. Makes me think your accident might have not entirely been the fault of another driver.

The cop saw him as he was passing, and then switched on his radar, hence Ken's Passport didn't alert him prior to initiating the pass. When I heard that sound, I knew the cop had him. Incorrect. The car in front was swerving and tailgating. Maybe if that moron had maintained a safe following distance like Ken did, he could have seen more of the oncoming lane instead of just the truck's rear end and wouldn't have had to keep swerving to try and see around the truck. That's why Ken could pass as soon as the oncoming lane was clear, whereas the car in front was still sitting there staring at the truck's rear end like a chump. If the car in front had also maintained a safe following distance, he could have been passing the truck before Ken had a chance to pass both of them. Watch the beginning of the video again: that silver car is a dangerous idiot.

Scruffy, on my way to Reno there was two 18 wheers holding up the flow of traffic. I was dead last behind 6 cars as they entered a passing lane on a long uphill grade. I went around the first car on the left, as I sped up the second semi pulled into the passing lane in front of the other cars. I guess he thought he could pass the lead truck. I kept the petal down and served into the right lane, passing all the cars and that slow truck, as we topped the hill, I went back to the left lane passing the lead truck well ahead of the other truck. I watched as not one car followed by lead, but sat in the passing lane behind the truck that wasn't passing. Never shy away from a safe chance to improve your position by doing the unconventional. Those poor bastards taught all their lives to only pass using the left lane are probably still in traffic stuck behind a truck .

@@bobwoods5017 I have not disagreed to a comment before this, but I can say as a truck driver for over 25 years, that passing a truck on the right is a dangerous move and completely the wrong move. It is very difficult to see a vehicle on the right side of a semi sometimes, and if you like to pass on the right, you may find your run off the road due to the truck drivers inability to see you. There is a reason that you will see signs on the back of some semi-trailers that say "passing side, suicide" with arrows pointing left for passing side and pointing left for suicide. Yeah because weighting for someone to head on in front of you and ending up in a pile up is always the best option. If you are drunk I'm not going to drive behind and wait until you crash into someone in front of me. I'm not going to slow down 15 mph below the speed limit while he impedes traffic. I'm passing and putting some distance between me and him. If he is swerving every car that goes by in the oncoming is a potential head on with him. If you pass him and put him behind you then you don't have to worry about him wrecking in front of you. Especially on an open highway. The less time you spend around a potential hazard the less chances of an accident you have.
@125AXer

J_D, I strongly disagree. The best course of action is to call in the hazardous driver via 911. Then stay far enough back so that you can't get caught up in anything that may happen before the cops can stop the offender. I have done so several times. Have been thanked by the police for getting a 2nd time DUI driver off of the road. Your course of action is not safe at all, and leaves the danger on the road to potentially maim or kill someone. If you REALLY don't want to be near a dangerous or potentially impaired driver, you'd stop and wait a few minutes, or make a turn and use another route to your destination.

Ken, it looks like to me that his radar picked up the oncoming Suburban that passed by you in the other direction after you passed the silver Altima and the white GMC pickup. If he was using radar at that distance, there is no way he could have focused it on you. The Suburban was between you and him at that time. You need to find out what method of radar he used. It sounded like your detector said ka band. The only way he could have pinpointed you at that range would be if he was using laser. While you may have exceeded the speed limit I have my doubts it was 80 mph. I feel that this would be a stronger defense for you to pursue. Although most officers will give you a little wiggle room for speeding while passing, it is not legal to exceed the posted limit, period. Just make sure that you don't condemn yourself by saying that you may have sped when you passed the vehicles. Always ask politely to see the locked speed on the gun if you get a ticket and plan on fighting it. They have to show you if you ask. If he didn't lock the alleged speed in the gun, this would have helped your case even more if it went to court and I've even heard stories where once the officer was asked to show the locked speed, he reduced the ticket to a warning because he couldn't produce it. Go get em"!

except that is not exactly true. since it is a ka-band radar, it's probably one of the newest radars. the latest models have the ability to not only clock vehicles going in the same direction and going in the opposite direction but also can clock multiple targets at the same time and tell the operation who is driving at what speed. however, if the officer says he clocked somebody else (and not you) to determine your speed, i think you are good to go. check it out: kzbin.info/www/bejne/q6LOhqeKoLCVitU

As Ken Steele says, the radar isn't "focused". The emitted signal is bounced back by anything reflective, so a radar is always getting multiple signals. If multiple cars are going in the same direction with the radar of to the side (an interstate, for example) it will be hard to identify which car it's targeting if the speeds are similar. That's one reason that the officer's vsual estimate is important or even necessary. In this case the signal from the SUV will be stronger (bigger, and much closer), but the radar is also getting signals from Ken and the cars he's passing. The SUV isn't coming towards the radar and the cars Ken has passed aren't going faster than him. When the radar reports the highest (oncoming) speed detected it's either Ken or something from Star Trek that's made out of transparent aluminum. And since the cop is behind the SUV, and may have been there for quite a while, he knows that guy isn't the one doing 80.

Ken, I forgot to mention. As a retired cop and traffic officer, I doubt that he got the speed of your vehicle and the other vehicle. He should have offered to show you the speed device he used and your speed. With your video and his lack of logical information, I think you have a good case. What poor advice! The officer doesn't need the speed of the other vehicle, only Ken's. If Ken broke the speed limit, he's in violation. The officer doesn't have to show Ken the speed on the radar gun, or even have to offer it. Ken's own video shows he was lasered. It doesn't show what speed he was doing. Ken's excuse for passing makes no sense. If he had concerns about the swerving vehicle, he should have slowed down and created distance to keep it in sight, not speed up and pass it, while going over the speed limit. He will lose this case, unless he's extremely lucky, and he'll likely get points on his license and everything that goes with a speeding ticket. Doing traffic school gives him a freebie. I'm also a recently retired police officer.

But you've also offered no proof that you are a retired LEO. I have my HR218 card in my pocket, if that helps. I stand by what I said, you gave poor advice. I have no idea what your prosecution rate for traffic offenses was, but I very rarely lost in traffic court. Of course, I'm in California, and our training may be very different from yours. A few comments up, there's the opinion of a former prosecutor who became a defense attorney (Keith-someone). Ken might find reading his opinion worthwhile if he doesn't trust mine.

It was legal to pass at the time you did, ie - no double yellow, or even on your side of the center. Accelerate to pass safely and then return to normal driving speed. I don’t see any violation at all. And, I don’t believe lights on and sticking your arm out of the widow as the correct way to initiate a traffic stop. Granted, if you approach an emergency vehicle with lights flashing, you should pull over safely, if possible without creating a greater safety hazard. Indeed, I believe the traffic courts will throw this out when contested. Good luck with it.

Sorry Ken but you are going to lose. The fact of the silver car swerving doesn’t give you the right to speed. You can avoid him “for your personal safety” just as effectively by slowing down and letting him pull ahead of you. The only way you would have a chance is if you had the gps to show you weren’t speeding. Former prosecutor here. Just sayin’. Take the class.
@lmccluer

Keith Preston well except the officer said he stopped in Ken’s lane and pointed for him to pull over. First, he never stopped in Kens lane, and it his arm wasn’t highly visible and Ken could argue that even at posted speed, he didn’t see it, (I didn’t) or he didn’t know he was pointing at him, or didn’t know what he wanted him to do. In any event, Kens already caught him in nit telling the truth right from the start, something an iffy we should ever do as it will ruin your court presence from then on.
@prestonkd
@prestonkd 6 жыл бұрын
Louis, that would only be applicable if the officer wrote him for fleeing or failing to stop. My understanding is the ticket was for speeding.
@lmccluer
@lmccluer 6 жыл бұрын
Keith Preston that is my understanding too. The officer plainly says I was stopped in your lane and pointing for you to pull over. He was not stopped in Kens lane. He said that twice. Getting technical I know, and Ken is likely guilty of speeding. However, a good, bit even great defense attorney would have this officers lunch in his back pocket for misstating he was in his clients lane, stopped, trying to get him to pull over. I can’t even tell you how many classes I was in, both in police depts, and testifying classes where you are told not to fudge a statement even a little, unless you immediately correct it. Otherwise, you will be considered an unreliable witness, and you might as well resign at that point. In this case, Ken, if he so desires, can ask the judge, his can you believe him saying I was going x speed, when he lied from the start by telling me he was in my lane, when he wasn’t.
@prestonkd
@prestonkd 6 жыл бұрын
In my experience, the officer always wins the “benefit of the doubt” test. Ken has an absolute out here where he can go to class and get it dismissed versus rolling the dice and possibly being out money plus the points, etc. I was a prosecutor and then a criminal defense attorney. The way I explained situations like this to clients considering a plea offer was “you can decide your own fate and know exactly what you are getting or you swap that for what Jay has in the box on the aisle and get whatever you get.” I apologize if you aren’t old enough to get the Let’s Make a Deal reference. Ken was either speeding or he wasn’t. The inconsistencies you mention would go a lot further with a jury than they will with a judge, which is who will decide a speeding ticket.
@lmccluer
@lmccluer 6 жыл бұрын
Keith Preston your correct. It might not be worth the effort. However, as an officer that never lied to write a ticket, or arrest someone, and treat others as they would treat you, in my opinion, this is the low end of the stories about why officers can’t be trusted. Maybe he just thought he stopped in Kens lane. But then again, if he lied about something as simple as this to write a simple speeding ticket, then what else has he lied about? I thank God I was raised by a Dad that spent many years as a reserve officer, and a Christian, who taught all three of his sons, the virtue of being true to your word, treat people on the street the way they deserved to be. All three of us spent time in law enforcement, myself and my youngest brother, careers. Now all you hear about us officers that lie about what happened, even though most are stories about officers are exaggerated. We know it’s not all, but those that do, put all in the same light. Unfairly or not. Sure it would be easier to roll the dice, go to traffic court, and go on with life. I just have a feeling by the way the officer stuck by his statement so easily, that this is likely not the first or last time fudging on a ticket. I wonder what his supervisor would say if the truth was known?

Wrong about the ‘older cops hate tattoos’, I’m 51, recently retired police officer, I never assume anything about a person with tattoos. I fought to get dashcams in our cruisers. Every officer was hella against them. But, I was proactive and receiving a letter from an angry driver was almost all that was needed to be disciplined. And, I received LOTS of ‘discipline’. Then, I found a grant for two cameras, I got one and our first K-9 officer. It changed everything. And now I recommend every person install a dash cam system, you’re gonna see how many times you pick your nose, fart, eat, text(while driving) and the worse thing, SINGING!!!(like you won some Emmy award)! But, you will be surprised how much you miss from other travelers or pedestrians doing stupid shit, and, how poor my own driving habits were. So, get one installed!!!

Well, Ken DID have to get his camera repositioned and start his commentary before deciding to pull over. He was already thinking "Man, this is gonna make a great video." As for the gray car "swerving" he can move around in his lane all he wants to. Did it ever occur to Ken that the other driver might just be looking for oncoming traffic prior to passing the truck? Rather, he just provided Ken the excuse Ken needed to try and wiggle out of a deserved speeding ticket. If you can't pass without breaking the speed limit then you wait until you have enough open road otherwise you become the only real hazard present. Besides, passing two vehicles at one time on a two lane highway is just not good defensive driving, especially when you make an admission that the roadway is narrow. "There just wasn't a good place to pull over." I didn't see anywhere in Ken's "evidence" video where the other driver crossed the double yellow on his left or the white on the right. As for not getting prior speeding tickets, well, sometimes you get away with a lot before you finally get caught. Then Ken poo poos the officer for saying "You know exactly who I was talkin' about". Ken's remark? "That tactic isn't gonna work with me." But didn't Ken, himself make assumptions, like he was "getting a ticket because he has tatoos"? Guess what, Ken, some cops have tatoos, too! Do you want to really defend yourself against a wrongful speeding ticket? Put your Garmin within view of your dashcam and record your actual speed. Now THAT is evidence!
@ausanders79

Wow, there are some seriously inept people commenting on this page. First, it’s called radar. That’s how the cop can assess Ken’s speed. And yes, even from a mile away as long as he has a clear shot. Second, the radar gun determines speed of oncoming traffic, not traffic going the same direction as the officer. And third, the car in front of Ken was not “all over the road.” Now maybe there’s more footage showing otherwise, but Ken should take the driving class and be done with it. That cop didn’t have any gestapo tactics or bias or whatever else you snowflakes want to imagine. Ken was speeding and got caught. End of story. I speed all the time and have paid my tickets every time I get them.

Driving behind some twerp who was either texting/playing with his phone, or diddling himself...he was swerving and his speed was varying wildly by 20mph...up and down. I punched it to get around him as I had visions of him crossing the white line, hitting oncoming traffic, and sending both vehicles careening in to me. As soon as I came back into the lane, was lit up with X-band radar. Interestingly, I HAD a RX8, but never had a police mishap (love the sound of a rotary), but once I got my Mazdaspeed3, the LEO fun started. Must be the hood scoop.
