you don't know what royalty free is. Most royalty free anything still has licensing that you must follow. The most basic thing is crediting the sample. Anyone who gives out royalty free samples will want to be credited especially if it's for monetary gains. By them not crediting the producer he could of sued regardless

Bro, I'm not a producer, don't know much about music. But from what I understand it works like this: You don't have to pay an entry fee, but if you do make money from the song, you gotta credit the artist (which should be a given, like c'mon) and also pay him, because he essentially made part of the song. It sounds completely fair and worth it to me, cause if you buy a pack, you not only have to PAY FOR THE PACK, but also pay royalties and give credit. That's what I understood.

@@Cocinaughty that’s not accurate. When I said “or the equivalent” I mean in terms of streaming to sales. Roughly (edited) 150 streams is equivalent to 1 unit sold. Platinum is 1 million units sold. Each platform pays out a percentage of a penny sometimes 2 Pennies per stream. The number made from a platinum record today is not 1:1 as it used to be. The amount of money the song makes doesn’t matter in regards to the platinum or gold status. Soundscan tracks sale numbers/units and not the quantitative amount (because singles can be purchased at different rates whether it streamed or bought for .99/1.29) the song made monetarily. If the song goes platinum, that means it has amassed an equivalent of 1 million units, not 1 million dollars.

The kit is free as in it's offered at no cost, that doesn't mean it's royalty free whatsoever. Also, any time a kit is free it specifies it's not for commercial use unless you get permission from the producer. You are also required to credit the producer which they didn't do, little buddy. It's funny that OT does three things wrong, yet you're calling out the dude who's in the right.

If it’s a free sample kit, you already got paid. That’s the way the law perceives this situation. You placed that loop in a kit that was labeled as free. Meaning royalty free. It was also on a website designed to provide free sounds/kits for production. Meaning he does not have to pay you for that beat. I would have told you to take me to court so legally you could be told the same. You had no expectation of payment upon placing that kit on a site as a free kit! You can’t expect one now when there was no paperwork stating that deal. This works the same as if there was a contract. If you accept 5K upfront and 3-5 points on the backend, that’s what you get! Only way to alter said deal is contract renegotiation. The only difference in the two processes is you can’t renegotiate what was already given out as free! Free means free! No matter what!

Yeah as the comment above mentioned, you just need to give credit. The pack was released as royalty free so they didn't need to lose any money on it anyways. Depending on the license, even credit may not be required, but that's just human decency to credit the right people. What happened in the video was understandable since the person who made the full beat probably didn't disclose that it wasn't his own sample, and they ended up clearing the misunderstanding anyways. This video itself is misleading though, they should have started the video saying that the music was royalty free. Way too much drama for nothing.

What are you talking about? The Johnny Dang track was just a fluke, could have just easily happened on a non-royalty free loop but it didn't. Producers have to put free shit out there sometimes. It's necessary promotion for their brand, and enables up and coming producers to experiment with pre-existing samples or loops. Nothing at all wrong with manipulating some MIDI notes to build your own song. The guy who created them didn't even notice it was his music!! Maybe that's because these guys create thousands of different sounds. They don't always know how "good" something is that they're making, so it's completely their responsibility to copyright certain things or choose to give them away.

OT didn’t steal anything. Another producer used it form a “FREE” pack and OT got it from him. If OT never picked it up, never would’ve seen the light of day. As Nas would say, they made it a hot loop, OT made it a damn hit! Not to discredit the creator but this likely took him less than an hour to make. It takes hours to lay down the verses, structure the beat around the lyrics and many more hours to mix and master the song. Now you make the video and promote the song. It was a hit with or without that beat. OT and Paul Wall have turned many instrumentals into HITS. To the credit of this channel and the producer of the track, they, as you mentioned, created a lifetime connection. Networking is key in this industry. OT made his track a hit and now he’ll get the recognition he deserves and hopefully will now have a way to support his family in a career I imagine he loves.

This isn't subject to any copyright claims, in my semi-educated opinion - I went to music college for audio engineering and music production, and took a few semesters of music/copyright law classes. Now, that doesn't make me a lawyer, but I have more than just an online search. If they sampled your song, or cut a loop out of published releases, that would be one thing. But he released a free sample/loop producer pack to the public - it is for public use. That is literally what the purpose of the pack being released was - to have other producers use it. In this case, I think it would be the same thing as you buying samples/loops, he just did it for free (self promotion). This is almost like a form of entrapment. I'd bet that if this went to court, Kyle would lose. EDIT: He released it as, free, and many are saying "royalty free." Now I've found a section in the website terms (listed nowhere near the purchase or product provided) that specifically lists "Royalty free is applicable only to songs under 5,000,000 streams, anything above 5,000,000 streams must be cleared with original creator." So basically, they wrote in a clause/exception for "Royalty Free" so that they could list it as royalty free but still make money/get credit for it if it was successful. Under 5 Mill streams wouldn't profit much. I'd argue that is false advertising, if nothing else. I'm unsure of precedents but I think it is fairly inaccessible and misleading.

the packs come with terms and conditions. he didnt even get credited for the beat at all. one could assume the producer made it himself, not even from a pack. i dont even think it would have been that big of a deal if he simply credited him.

When you get the beat it's free as long as you don't use it to make profit. If you want to use it for commercial release you need to buy or lease the beat. I'm a producer too

You can't use it for COMMERCIAL use. Using it to make a track, and sing in the bar or something is one thing. There are terms you agree to. Kyle would win most likely due to that fact it was commercially made.

@@OliveVeyah If your "works" is sampled, you do. His producer pack, which was full of loops/samples for others TO USE, is not covered by the copyright. For example, for every song (they often use hundreds of samples to make a single song), you'd have to list the entire creative team for each sample as "writers" or "producers", and they'd all get compensation. "Samples" aren't just loops sampled from songs, every audio clip is a sample, and most of them aren't recorded by the producers - they are bought/downloaded for free. He released that pack for free, for use. He has no claim to it, the same way he doesn't cite every sample source from every song he puts out - he doesn't pay every sample creator either.

you need to read the fine print in the tos on the site (section 5 to be specific).It's royalty free until you hit a certain amount of streams or purchases (of course you would never know if you meet that criteria until it happens so ig if you wanna save legwork and avoid being accused of stealing after the fact assume this guys loops are not royalty free. Would be nice if they bothered to include tos within the pack or be more transparent about these predatory business decisions but alas.
