7:12 don’t really wanna defend a child abuser. But Ricky’s dad (Officer) didn’t have an exigent circumstance, or warrant. So, he couldn’t have entered. He could open the door and scream for SGT. Green and Cliff. But, can’t enter until he hears a scream of pain or some exigent circumstance arose. By entering any evidence the officer finds will be suppressed due to it being fruit from the poisonous tree. Only evidence that will be left is the testimony from Ricky; from the game. That’s it :-(
@junivanofdragonia2 жыл бұрын
@Lonnie that’s called Exigent Circumstance. And in CA or NV. Just opening the door and entering without cause is a violation of the 4th Amendment. And again not defending him. But the Officer entered without any cause. Just cause your son said he was told that Cliff was being hit. Isn’t justification enough to enter. And you said “reasonable grounds” opening a door and not hearing any sound is not “reasonable grounds” to assume someone is hurt, injured, about to be injured, or in danger. And hearing your son say “Cliff didn’t tell me but told me on a word game that he is being hit. And I saw bruises. Isn’t “reasonable grounds,” either. It is enough RaS and PC to detain once contact is made. Or enough to wait to the next school day to make contact with Cliff and get the story. But, not enough to violate the 4th amendment and enter a home without a warrant. I wish it was, but it isn’t.
@junivanofdragonia2 жыл бұрын
@Lonnie here is the 4th Amendment: _”According to the Fourth Amendment, the police cannot enter your home without a warrant from a court of law. A judge must sign the warrant and the warrant must give a description of the items that the police are trying to seize, as well as a description of your residence or premises. If a police officer enters your home and obtains evidence without a warrant, that evidence is inadmissible in a court of law.”_
@junivanofdragonia2 жыл бұрын
@Lonnie since I’m assuming this is CA. There is actually a really great case law, backing my argument since you said I’m Incorrect. I wish I was incorrect. But… _Howe v State_ 916 P.2d 153 (1996) or 112 Nev. 458 (1996), respectively. This case falls in the 9th Circuit. CA and NV fall under the 9th.

Bro, ngl, as a victim of child abuse and sexual abuse this got me all sorts of worked up. Unfortunately I was an antisocial child and didn't have any friends aside from little ants and caterpillars I would find crawling near my window. It went on for about 5 years before CPS was involved but somehow nothing happened due to testimony claiming the assailant would "never hurt a child" so I was just making it up. Fast forward to being a teen and it happened again cept this time my older brother was the abuser. He received straight A's and was legitimately a prodigy. My needs were never met and even after i came forward to my mother that he was doing inappropriate things to me whenever i tried to take a nap, she shunned me and said it couldnt be true and i was just dreaming. So, I attempted to kill myself because I just couldn't take it anymore.While buying new school clothes, my mother discovered all the cuts on my back, legs and stomach and pulled me out of the store, slapped me so hard and said I was stupid and made her look like a shitty parent. Then she took me to therapy and whenever they caught on after the 2nd session I was pulled out. CPS was involved again and nothing happened. My mother said numerous times, "we have your brother's career to worry about". I'm now an adult with this unbelievably heavy burden and I am currently battling terminal illness so sadly this has to go to my grave. Meanwhile my brother landed a nice cushy job at Google in San Francisco and said that I need, "to get over the past" and "won't help you with therapy funds because you're going to just die anyway, so keep being the loser you are and I'm blocking your number". Absolutely no one else in my family knows about this. They wouldn't believe me. I'm a loser to them. I dont have a family at all. Oh well...I tried to be happy. Sorry for posting this comment. The video just got to me. Sorry again.
