Meanwhile, it Massachusetts- they just stuck them out in the water where nobody has land rights and completely ruined our whole fishing grounds. They tried to test run one of these new units and the blade exploded. We had tractor trailer loads of fiberglass and foam wash up on the beaches. This green energy stuff is wacky. We have 400ft turbines with 150 gallons of lubrication oil in each unit off our shore in a hurricane zone. Same with the solar farms, hundreds of acres of forest clear cut to install solar. How is this green renewable energy if you destroy the land and water to do it?

When I worked in the federal government I was on a fringe of a study looking at putting windmills off the Virginia shore. The environmental impact was expected to be disastrous to local marine life. Supposedly the harmonic vibrations and random acoustic noise introduced into the water would run off most marine life in self protection.

See Steve Letho’s video, “Wind Turbines Built w/o Permits Ordered Torn Down at a Cost of $300M”. Enel DID lease the land (surface rights). They did not lease the mineral rights from Osage Nation. Therefore, ON sued. IANAL, but ON’s case is based on the rocks that were excavated from the 10ft/3m (depth of a basement) hole for the foundation. Enel reused the rock around the foundation and/or in the concrete for the foundation. Both sides agreed to disagree. ON now no longer wants to lease the land to them and asked for the wind farm to be removed. The Judge has agreed. Rough order of magnitude: Enel used around $8 million in rocks from the land. Additional ROM, the farm makes $125+ million in electrical per year (but that is just sales and not profit).

Months ago I read the court paper from it. It just seemed the turbine company screwed up and thought the excavated material was considered wasted and reused yet didn't realize the mineral rights of reservations were different. If they had piled the rock next to the turbines, there'd be no case. ON can now legally extort the energy company because they were entitled to the mineral rights and they want the foundations gone.

According to the gentleman speaking 0:58 they did not get a lease or proper lease and permitting, surface damages occured along with the mining of rock substrate for construction purposes, now many of you may not realize but rock is mined for many purposes such as building roads, homes, dams, landscaping and making concrete just to name a few and its not free, try going to your local home improvement center to pick up a free bag of rock for your landscaping, no they dont have any free rock

They probably were. You cannot construct on a reservation without signed documents. There may even have been an IBA - impact benefit agreement so that a share of the profit goes to the nation. Maybe their council signed without a referendum, so many on reserve objected. There will be gain for the reserve. The flip side is that companies may not want to do business with indigenous peoples for the reason a fully functioning project is pulled. That's not good - doesn't help participation in the general economy.

However once electricity gets into the grid there is NO way to determine what electricity is green and what isn’t. The companies get tons of tax breaks while the people whose land the turbines sit on don’t see any tax breaks. IF they become profitable in the time frame you suggest it’s only because it’s at the expense of everyone else.

This company mined the rock and turned in to a finished construction material. The rock is the minerals in question. Cell phone towers are not constructed in the same fashion. I’m Osage I live within a mile of the noisy things. Terrible noise. Eagle killers too. I talked a person who checks for dead birds and she said she couldn’t find any. I mentioned that the coyotes get to them while they are fresh and drag them to their dens.

That's my fear with this ruling. If I disturb dirt in Osage County, do I need to go through the Osage Minerals Council now? I read (in the news) and understand the arguments from both sides. This seems like an easy dispute to settle. It looks like either Enel refused to budge on their position or the tribe really didn't want those wind turbines.

The company is ALWAYS the responsible party as the local authority is who issues the permits! The Osage nation IS one of the authorities!! Lawyers? Who’s lawyers drew up the contract? Answer: it still does not matter as it is the AUTHORITY who issues permits and it is the SOLE responsibility of the company desiring to build to ensure they get all relevant permits/approval from ALL authorities with jurisdiction. Osage nation: keyword is NATION. that’s the first hint on who has the FINAL say.

What I want to know is why do they need a mineral permit for a wind generator? Mineral resources they listed, wind wasn't on that list. Regardless, thanks for the waste of resources for letting it get this far, only to destroy the wind farm. I never want to hear the Osage people talk about the environment and how it needs to be protected again. Because regardless they knew the company was leasing the land for the wind turbines to be installed. So after some reading, it seems that the holes made for the bases of these turbines which they turned around and back filled around the turbines the dirt they removed is considered precious minerals to the Osage Mineral control department. I find it funny, that the environmental damage impact of this will only grow more because it basically comes down to they used minerals (the dirt) without a permit, minerals that weren't per say removed, just re-used. And the mineral rights owners didn't get paid for it. Thus this is all about not getting paid money for something that wasn't sold for profit. Now I could understand where they may have them pay for those permits plus penalties and fines, etc...but to destroy something across 8400 acres seems very environmentally unwise. You want to blame the power company for greed; however, the mineral rights is being just as greedy behavior wise here. I find it funny that the environment impact of this comes down to not paying for basically dirt when they made the holes for the foundations. There had to have been a better way of doing this, like giving the turbines to the people, making a certain percentage of the profits for years to come go to the people....but destroying all of it? That is laughable, especially when they think that is a win.

The generator company tried to act like the Osage didn't have regulatory rights over their land. The law says they do. One presumes that the generator company is fully aware of the laws and regulations relating to their business. But let me put this out in the middle of the table where everyone can see it: Did the Osage try and shake down the generator company in order to get the needed permits? It's possible. The Sioux and Navajos have in the past. I point this out because there is a possibility that this isn't a race/privilege issue but a corruption issue. Graft and corruption don't care what race you are and payola happens everywhere. But being 100% fair to all parties, none of this may be the case at all. This could be one of those rare times when everything is as presented. What will probably happen is that the generator company will declare bankruptcy and abandon the turbines to the Osage. They will, of course, not spend money to maintain the turbines so the Osage will inherit a wind farm where perhaps 75% of the turbines don't work.

Think of the tribe like a giant HOA. The property owners let the company build the windmills on their own property. They're probably getting $10k/year per windmill. The Tribal Council HOA didn't like it or wanted a kickback, so the Karens on the Council sued to get them removed.

More on this. Why did the tribe allow it to be built without a permit? By the time the company invests the money,they say it is "illegal". What usually occurs is they demand a new lease with a much higher payout. Same strategy was used in Wisconsin over a road. Houses were owned by non tribal members. I live in Calif, and I have seen the acres and acres of windmills by Palm Springs and also near San Francisco. I think as part of the buiding, they should include a fee for removal when the windmills reach the end of life.

Wait... 0:50 they failed to get permits through the MINERALS council? They did lease the land, not to dig up minerals but to put up windmills and that was what they paid for... why would they need a MINERALS permit if they are not mining for minerals? Osage owns the rights to oil, gas and other minerals 01:12 and have to get a permit for any MINING! But they aren't mining, they just dug relatively small holes for foundations. So what if they dug holes for the bases? Do people who build houses also have to get permits to dig foundations for their homes? It's ludicrous. 2:00 that woman just screams HOA Karen to me...

The hole for the foundation of the turbines is 10ft deep and 60 ft wide. The material they used to pour the foundation came out of that hole. Surface lease vs Mineral lease

This process involved the extraction of soil, sand, and rock of varying sizes-all of which was of a common mineral variety, including limestone and dolomite. Rock pieces smaller than 3 feet were crushed into even smaller sizes and then, after each foundation was poured and cured, the crushed rocks were pushed back over the hole and compacted into the excavated site. Larger rock pieces were then positioned next to the holes from which they came.

Yep, I saw a case that reached the Supreme court in Canada about 20 years ago. Natives had agreed to an airport and then didn't want it. They were carefully told about the noise and pollution, but decided to change their minds and pretended they'd been duped. Like anyone can afford to build an airport and then tear it up. They lost that one. There case was so weak, it never should have made it to the Supreme court.

I’m part of the Cherokee Nations, and I still think this woman is living in the past. Obviously they’re not pleasant to look at, but given the alternative? Part of living in civilization is learning to adapt with it. I don’t see her complaining about her centralized heating/cooling, car she drives and her refrigerator. Or all of the other modern technological comforts she has. At least this one is to help preserve the land that she cares about.

Those wind farms aren't "sustainable energy." The maintenance cost on those makes it not even worth it to put in. They only have a 20 year lifespan and after that the company ditches them and the landowner is left to clean up the mess we're fighting against the installation of more of those wretched things here in my county in Texas. As well as a solar farm. It's not "clean" energy if you destroy thousands of acres of clean land to put bullshit man made garbage there

Reasons why wind power can not replace fossil fuels a 2 MW wind turbine weighs 1688 tons: 1300 tons concrete that equates to 300 cubic yards of Concreat, 295 tons steel, 48 tons iron, 24 tons fiberglass, 4 tons copper, .4 tons neodymium, .065 tons dysprosium. The funny part of this equation it the wind generators use the most electricity of anything around where I live. They work like a alternator on a car they have to have electricity or like a car a battery to start making power. They're not a true generator. Generators doneed power to make power.

Solar so many components have to be mined we can't do it here because of the same people that want us to use them it's counterintuitive to make so we get the minerals from China where they use slave labor and that's ok as long as we dont see it 🫣🤫. Just look up the process of making them very harmful to the environment. Wind turbines ruin the land where they're placed. Cattle don't like being around them they kill alot of birds. The area that they cover is like taking 8 4 door long bed pickups make a square on the top of the ground that's the surface area but thats on all sides just like a 🎲 dice it's next to impossible to get that back out of the ground. Man can't make anything better than God has provided for us such as petroleum, coal natural gas. These are the best energy sources. The green crap is just making a tree huger rich. That's it in a nut shell.
