The problem is that if no doctor or judge ever declared the person mentally ill, the person isn't legally mentally ill. Apparently, no one ever did that. That's where the failure was. It is a law that "individuals with diagnosed and documented mental illness" are not allowed to buy guns. It's called the "Brady Bill'. It was passed after President Reagan was shot by a mentally ill individual who bought a gun. That was many years ago. The problem is the person has to be, as you said, "diagnosed and documented". If not, the mandatory background check will find nothing. The problem here wasn't the law. It was that all the people who dealt with her in the past, doctors, lawyers, judges, etc, apparently never "diagnosed and documented" her as having a mental illness. Was that because of political correctness? was it just because they felt sympathy for her? I don't know! But that's where the system failed. None of those people were willing to say "this person is mentally ill". And that's how she was able to pass the background check and buy the gun. The system didn't fail. The people involved did.

It was passed and became law in the 1980s after a mentally ill man bought a gun and shot President Reagan. If you buy a gun anywhere in the US, it applies to you and you have to undergo the background check. I know, because I've done it numerous times. The problem is as I said. The law can only work if a person has been legally declared "mentally ill". When sympathy or political correctness causes Doctors, lawyers, judges, etc., to NOT follow through and declare a person "mentally ill", there's no way the system can work. My twin sons are 7yrs old, the same age as him, & i could never imagine putting them in any danger let alone being the reason they get hurt..i feel so sad for this baby. The son’s father was connected to that church. He had already reported to the court that he was in fear of their son’s safety because of his wife’s violent behavior. But obviously the court allowed her to still be with the child. She and the child’s father were divorced and other reports said they were in a custody battle.
