My wife is going to petition her parents by filing the I-130 form online. We are about to have our oathtaking for citizenship and once we get the certificate we will send the application right away. The only problem is that her parents only have 4days until their stay in the US to be expired based on the I-94 date. My question is do we need to file an extension of stay using I-539 OR can we file for the I-485 (change of status) already? Once I-485 is submitted, does that mean that they can stay in the US indefinitely or does that take effect once the application was received/ approved?

I just want to comment here and let you know what an amazing resource your channel was in helping my wife and I file our paperwork last year. From the time we sent it in, we had one minor request for more information, I forget exactly what it was, but we sent it in and were shortly approved thereafter, with no interview. Whole thing took less than 6 months if I remember correct. Anyways, thank you! ps: I wanted to hire some visa coach guy for $2,200+ to do the paperwork for us, but my wife assured me we could get it done ourselves and I'm glad I trusted her!

I am a US Citizen and my spouse and step children live outside of the US. All I-130s were approved and we are waiting for the approval of the I-864s. Each of them has an approved I-130 and I-797 Notice of Action. Since they are residing outside of the US, am I able to still able to complete and submit the I-485 for all of them or do I need to wait until the visas are approved and they are physically in the US? Kseniya, I filed form I-130 on line about 18 months ago and it hasn’t been approved. I did receive a request for additional documents and already submitted it. I also mailed a packet to USCIS with forms 485, 765, 864 and 693 in May 2023. The check for 1,140 was cashed by DHS on July 24,2023. I didn’t receive any receipt for these documents and have not heard anything from USCIS about receiving them. I’m absolutely freaking out now. Could these been lost? What should I do? Is form 130 online connected to the rest of the forms? Thank you

I know my package must have been rejected, because my bank blocked my payment. However it's already been a month, and I never received neither a rejection notice nor my package back... I submitted the I-130, I-131, I-845, I -765, USCIS sent the I-131, saying the payment amount is incorrect or not has been provided. As it say on the USCCIS when you are filling with the I845 its $0. they asking me to refile and send it with the correct amount. I don't see any payment on the website. also, I'm wondering why they did not send back all the package.

Hi K! I'm using a I-130 fillable pdf (the new one that expires 2/28/2027), and many of the fields only allow numeric characters. So I can't use 'N/A' - instead I hafta use 'NONE' b/c the slash isn't numeric. (eye roll) That's no big deal UNTIL I come to question #46.b that asks for the I94 record that is all numeric EXCEPT for the next-to-last character which is alpha! (The letter 'A') Is there a workaround? What do you advise? Should I print and fill in that alpha character by hand? TY! Michael

Ok so the I-797 is the I-129F approval we needed, great. In your video you mention not needing a new medical exam if the one you received on your K-1 visa is less than one years old and you married within the first 90 days. My question is when we look at the required documents for the I 485 it asks for a DS-3025. But that is only a vaccine report. Do we need anything additional for a medical exam ? The only other thing we received was a video from the hospital, performing the medical exam in Manila.

There are online translation services that aren’t super expensive and are pretty fast (within 24 hours): Immitranslate, Rushtranslate, and RapidTranslate. Although USCIS doesn’t have a rule against people translating their own documents but in my opinion it’s best to use a third party service or person.
