The question is, In case the petitioner retired in 2022 and he is filling this I-864 this 2024, what would be his current individual income? Thank you so much for this video. It helps a lot. One question for you. My son is applying for me (he is 21 and married). I include his wife on the part 5 (household size) so in that case the total household will be 3 but do I have to send any documentation from his wife too? like her identification, proof that she is married to him, and that she is a student? Their income tax are together but she doesn't work. Please let me know. One thing I just want to make it clear that if the immigrant is eligible for I-864W (i.e. have 40 credits from social security or other criteria) then there is NO need to file I-864. This information is not clearly mentioned anywhere in the video. However, the video is very informative and helpful. Thank you Kseniya.

Can you please expound upon the co-signer aspect? You mentioned very briefly that the petitioners income becomes irrelevant with a co-signer - but how is this calculated? Is it combined with the co-signer's total income? or do you need to choose a co-signer whose total income on the tax form already exceeds the current years total income requirement? He’s supposed to list persons who are NOT sponsored but if married he should put 1 for spouse. Even though this document is being filed FOR his spouse, me. I have three kids; I, my wife and two of my children are residents with green cards; we came in as immigrants in 2022 without our last child who was 2 years old then, because the visa payment portal was down and no Visa fee was made for her, as we didn't go in without cash. She went for her interview last month, the visa fee was payed, and I-864 was uploaded by the petitioner " my sister", who's a citizen. After the interview, she has been asked again to fill out and upload the i864w instead of the affidavit of support which is one of the requirements in the invitation letter sent for my daughter by the embassy. What do we do? Is it okay for my daughter, since parents are not yet citizens?

I love learning from your videos, you are the most knowledgeable person and detailed with everything, but so far I got confusions with my process, I am under K1 visa and I have K2 derivatives which is "follow-to-join". I arrived in August last year and submitted my I-485 with concurrent filing of EAD and AP, I received my EAD and AP January this year and am currently working. When I filed mine, I submitted with 2 - I-864 (from petitioner and joint sponsor). I received RFE and comply, still on a pending status for my green card at the moment. My confusion was when I filed the I-864 last year, I already included the K2 derivative names, although they arrived in August this year, and I am in the midst of processing their AOS. Do I need to submit another I-864 again with their form I-485 and include updated attachments? And can I include them on my online account? I would really appreciate your response, K2 follow-to-join derivatives have a very limited source of guidance all over the internet. Thank you very much.

I don't understand what is the purpose of this because it just adds more work and time to print out at a library or Staples and having to scan and upload to pc and NVC. If I dont write in my stepdaughter in section 3 (family member 1) then when I get to household I end up showing a house hold of only 2 and the same when I complete the form for my step daughter and not listing her mother....it ends up a household of 2. so how do i show it is a household of 3???

For those of you wanting to speak to a live person at USCIS, try these keywords or otherwise you will just go in circles with the robot. Try saying UPDATE CONTACT INFORMATION. I have no idea why they make it so difficult because if you don't say the proper keywords, they robot will just say send you a link via email or text for more information. I hope this helps.

I have a question: if the petitioner filed taxes jointly with their spouse, but the petitioner's income alone is enough to sponsor the beneficiary, does the petitioner's spouse's income need to be included in Part 6, Sec. 8-10?? Or should the spouse fill out the form I-864A anyway and include their financial info? I ask because in 24a-c the total income will include the spouse as well. Thank you!!

Is it acceptable to use an i-864a and a second joint sponsor with another i-864? Meaning, I the petitioner use an i-864, my parent who resides with me fills out an i-864a, and a second joint sponsor who lives elsewhere fills out an i-864? I want to provide as much financial support as possible and I do not make the financial requirement currently. My second joint sponsor does and maybe the i-864a is not necessary or allowed with two i-864 forms.

Hi , If your joint sponsor for example sibling helps you to sponsor your spouse and doesn’t live in the same household address but resides in a different house in USA and will help support you by using their income because you dont make enough income to individually bring your spouse do you still count them in part 5 ? I am in the US, living in the same address with my wife (the sponsor), what should i write in "In care of name" and the rest..... my sponsor's address? I heard you said to leave it and just fill the address, is that correct? PART 5 Household. Hi Kseniya, thank you very much for your guide and advice! Now my husband is filling I 864 form for my and my son's greencard , as I understood as a "principal immigrant" my husband must indicate me and "as family member" my son in I864 form? And when he will be filling I864 for my son it should be the same I m as principal and a "family member" he has to indicate my son. Which means it will be exactly same Affidavit form for me and my son who came with me? Thank you in advance!

Hi, I am getting confuse with I864 part 5. I am petitioning my 2 minor kids and my mom who are living abroad. I put "1" on item number 1 (person sponsoring on this affidavit), 2 (yourself) and 4 (if you have depended children) on all three I864 forms. Should I put "1" on item number 5 which is my mom? Question Part 6 #7 how do u calculate the individual annual income ( eg: if my sponsor/ the petitioner work as army n current pay slip/ LES amount is 8824.87. Can I multiply that amount by 12 month to get the estimate (8824.87 x 12 = 105,898.44) will this be correct estimate for the individual annual income.

Hi Kseniya, petitioner did not file taxes for 2022 and 2021 (unemployed), but 2023 income is way above the poverty guidelines (about 200% more). IRS is taking forever to send our request for verification of non-filing letter (their website link has been broken for months now so we hd to request through mail). Is it ok to replace the verification of non-filing with 2022 and 2021 W2 (when we click the link of petitioner’s W2 online it only says “no record or return filed” showing tax period dates of december 2022 and 2021. Or do we really need to wait for the verification of non-filing letter from IRS? We’ve been waiting for a month now.
