A trouble my fiancé and I face is that it is almost impossible for me to travel from the US to her in the Philippines. I farm alone and can not leave my farm that long. We would like her to travel here to visit, perhaps on B-2 visa, and the after we have met in person we would be able to qualify for the K-1 and have her do the K-1 interview in Manila when the time comes. Thoughts? I also saw that there is a hardship clause offering a waiver for the in person meeting. Would I possibly qualify for that since I can not travel due to farming alone?

Hi Walter, hmmm as for your plan inviting her to visit you in the issue, there will be some issues and challenges with this because while between you two, you might have a genuine relationship, how are you going to convince the visa officers of this? Not meeting in person and inviting a Filipina abroad is a sensitive unertaking (problems with possibility of human trafficking etc). I always advise my client to invest on time to let their foreigner boyfriend to visit the Philippines to establish the genuineness of the relationship (meeting parents, plans of establishing something together, financial buildup etc). This will also be helpful if in the future you will continue with the K1 application. Re Extreme Hardship Considerations and Factors, i will suggest ask an immigration agent or attorney on this. This will be circumstances-dependent, and will be viewed in totality in determining admittance or denials. Hope these helps! Stay safe!

Hi Minette, when re applying, tutok ka dun sa reason ng denial the first time you apply. Kasi mas scrutinize nila yung circusmtances na yun. Kung nag-improve na or nawala na yung reason kung bakit ka nadeny, then they will assess you fair and square naman. Ingat lagi!

Hi! Question lang. Nagpakasal po kasi kami ng other half ko thru Online. Nagmeet kami once. Unemployed po ako dahil pinagresign ako ng other half ko at sya na po nagsusupport sa akin. Di pa po kasi kami sure kung mag-apply ng k1 or cr1 dahil isa po sa purpose ng pagpunta ko don is malaman namin if don kami magstay or sya magstay sa atin. If decided na kaming don nalang magstay, tsaka po kami magtry ng isa pang visa. Ang purpose po ng b2 visa ko is for pleasure and tourist na rin po, other half ko po ang magiging sponsor ko. Maging issue po kaya sa case ko yung pagiging unemployed ko? Required po ba na magprovide ako ng bank statement/proof of income ko kahit sponsoran po ako ng partner ko? Pano po kung sya ang magpoprovide ng itinerary ticket ko back and forth with insurance? Irerequired po ba na original copies ang proof of documents ng relationship namin like marriage license/certificate and apostille, qr code lang po kasi meron ako at photocopy?

Hi Gray, hindi naman yung unemployment mo lang yung basis ng assessment ng ability to support yourself during the trip at rootedness. If mapapakita mo naman na you can support yourself (WITH or WITHOUT a sponsor, well and good). If willing sya to sponsor, i think better to send a notarized affidavit of support: www.uscis.gov/sites/default/files/document/forms/i-134.pdf If magrequire ng documents, usually, soft copies na iaattach sa online application (unless required na dalhin yung physical copy sa interview. Hi Jie! Depende po sa purpose. Mas madaming step at requirments ang work visa kasi specific yung purpose nito --- employment. Sa tourist visa, dahil papasyal ka lang naman doon, mas straightforward yung process at requirements.

Hi Gil, if your boyfie is working in the US, then he can sponsor,. Your expectations and processes will depend on the purpose you will declare in travelling to the US. If the purpose is not immigrant-based, then the marriage is irrelevant. Also, if yhe will sponsor you and you have not met in person yet, hmmmm might be red flag in your application that requires further proof of genuiness of your relationship.

Hi. Kung next year nyo po balak mag travel don, maganda po na mag apply na kayo. Minsan mahaba ang wait time for the interview schedule (depende sa bansa kung san ka nag apply). Pag sa Pinas po, around 6 months ang wait. Di ko lng alam sa SG, kc deoende rin sa dami ng applicants. Dapat po ma-prove nyo na may sarili kayong financial capacity & strong ties. Good luck po.

Other than the essential documents for travel (valid passport, return ticket, address of accommodation, visa), i suggest you to prepare the following: 1. Invitation letter galing kay BF AT kay tito (stating their extent of sponsorship and tourism assistance while staying there). 2. Pakuha ka kay parents ng travel insurance (this way, you can assure the IO that you have a fallback if any incident occurs) 3. Prepare a SOLID ITINERARY. Give them a good travel narrative with activities with your BF 4. Donn't mention the ghosting thing. If the IO suspects that this may be possible, then magiging problem. 5. If kaya pa, credit card/s.
