Sir explained the special majority with incorrect information. SPECIAL MAJORITY as per article 368 requires a majority of 2/3 members present and voting supported by more than 50% of total strength of the house.

There were two Articles in the 1949 Constitution which provides the correct to property, i.e. Art. 19(1) (f) and Art. 31, but both the articles were deleted from the Indian Constitution by the 44th Amendment Act. Article 31 with sub heading “Right to Property” has been omitted by the Constitution 44th Amendment Act, 1978.

Yes, they can be amended but in a way that the 'basic structure of the Constitution' is not altered. Refer to "Kesavananda Bharti Case(1973)" Plus, there have been amendments to Fundamental Rights before like "The Right to Property(previously, article 31) was deleted from Fundamental Rights under the 44th Amendment Act, 1978 and transfered to Article 300A(Part Xll). Being merely a fundamental right doesn't mean it is a part of basic structure of the constitution. We have to analyse what exactly the term 'basic structure' signifies. 'Basic structure of our Constitution' is something much sacred and altering it would cause serious consequences in governance and also in unity and integrity of our country. Like, secular, democratic, republic, separation of powers, federal character, equality, right to freedom, etc.
