sir lal bahadur shasri and indira gandhi also assumed office o demise of pt. nehru and mr. shastri , they also did not face any election as 3rd l.s term was 1962-67 . so how did thel H.E. gyani zail singh broke the convention it was already done twice before by H.E. DR. sarvapalli radhakrishnan. the famoush K. kamraj and morarji desai controversy even dint make space for an early election

What if the president keeps appointing the minority party's leader as PM for next 1 months! Will it be checked under judicial review or any other criteria?

The president only appoints the winning party's leader. In case of no clear majority he may choose between the close competitors

@@earnwithkailash it's not up to the president to repeat it every month. It's not his discretionary power. He can only do so when they are not able to prove their majority. 1990s till 2003 was an era of turbulence. Check it up. And yes the procedure is not influenced by the court but it is in the range of judicial review
