These things depend pretty vastly on some situations. If the plaintiff A) Had to seek help from professionals such as a psychologist or psychiatrist due to the defendant's actions and if they can provide written proof that they went to a professional. B) Received physical bodily harm from the defendant, and with a following police report and a doctor's diagnosis. Or C) Did the defendant act in such a manner that a a reasonable person would consider traumatic (for instance, if the defendant was recorded from a security camera stalking you and recording you in your sleep or something). You would usually accompany this with whatever recordings, police reports, or other relevant evidence you can obtain. Nobody likes to endure these hardships they have to go through in the courts, and without some limitations, literally anyone could just tack it on their list of grievances.

I must say this a million times. If you want to sue for emotional damage, either A. The defendant needs to act so abnormal in court that the judge sees why you’re suing for that (which is extremely unlikely to happen) or B. Someone (a therapist, psychiatrist, psychologist, etc.) needs to give you a bill and a note saying that the treatment provided was as a direct result of the defendant’s actions. For example, I see a therapist about once every two weeks, and a psychiatrist about once every month (both for my anxiety). If I go to court, I can’t sue someone for my copays, medications, etc because those were already in place. HOWEVER, let’s say that someone’s actions make me so distraught that I need additional sessions with my therapist or to up my medication with my psychiatrist, they could write an affidavit stating that these changes were because of this, provide an invoice for the additional expenses incurred, and then I could sue for those. But that’s maybe going to only be a few hundred dollars tops. All of these cases where people try suing for $1,000.00+ just because “I felt bad” are ridiculous and no judge wants to deal with someone whining that their life isn’t perfect.

In the terms of the law, emotional damage has to be caused by an accident/injury created by someone else. If not, then when someone breaks up with someone else, emotional damage, lawsuit. A doctors note isn't always proof, especially with emotional issues. You can't see anxiety like you can a broken bone. I know it sucks cause I live with quite a few invisible illnesses.

That’s definitely a tough job being a landlord. I’m sure he was not the most pleasant to deal with, knowing it’s a smaller lady who he is dealing with and maybe exploiting that bully pulpit. However, as a landlord those are the risks you take when allowing someone to live on your property
