Useful information. But, here, after getting my perrsonal bitter experiences against Three Criminal Cases and One Civil case regarding unknown cheque bouncing complaints between 2009 to 2016 (although ultimately, all Four cases are finally dismissed in favor of me, for which, I thanks to god), some important aspects are need to be presented such as: Firstly, if an accused faces such criminal case regarding unknown cheque bouncing, Secondly, Complainant has unlawfully gets success some unknown signed cheques of accused by taking wrong advantages of extraordinary conditions of accused and its family members, Thirdly, Complainant uses those unknown signed cheques as proof of receipts of payment of such unknown cash amount to accused, Fourthly, Complainant presents some false unknown witnesses.

I have availed a home loan and was unable to make timely payment thru ecs due to loss of job. I have received a summon under sec 25 of payments and securitization act 2007 against emi return due insufficient fund as on april 2020. As per 2015 amendment the law was very clear that territorial jurisdiction will be decided as per the location where the bank account of complainant is situated irrespective of the place where cheque was presented for clearance. Can you please help me with any judgement or any authority which allows me to file a case at a place where complainant does not have bank account but only presented the cheque for clearance. Your observation is completely right. If it is taking years in resolving the issues of cheque written cases, it’s completely pathetic state of affairs of Indian judiciary and completely illogical. Because check written is not something like murder mysteries. There the attempt of breach of trust is clearly established and can easily be proven bye documentary records. Such cases can be disposed within very few days or even two days. The very basic objective of any judiciary system is to protect trust in systems and thereby protect economy and society and state establishment. This is very basic to protect order. How can they so much unwarrantedly delay the redressing and Justice in easily resolvable matters like check written.

Hi, this is regarding mechanism to include cheque bounce into rent agreements. Sometimes tenants are reluctant to vacate the property even after conclusion of the lease agreement. Since the court proceedings can take a lot of time, can I in some shape and form include a clause in the rent agreement where the tenant has to provide a signed undated cheque to me with its cheque number mentioned in agreement and with the condition that landlord can deposit this cheque with some amount , say max 5yrs of rent, as a penalty when tenant doesn't move out within 15 days of the agreed date of his exit (communicated via notice by one party to the other, or at the expiry of agreement). In case such an event doesn't occur and tenant vacates the flat peacefully within stipulated time, then owner would return the cheque to the tenant. Can I include such a thing in my rent agreements?

If it is taking years in resolving the issues of cheque written cases, it’s completely pathetic state of affairs of Indian judiciary and completely illogical. Because check written is not something like murder mysteries. There the attempt of breach of trust is clearly established and can easily be proven bye documentary records. Such cases can be disposed within very few days or even two days. The very basic objective of any judiciary system is to protect trust in systems and thereby protect economy and society and state establishment. This is very basic to protect order. How can they so much unwarrantedly delay the redressing and Justice in easily resolvable matters like check written.

@@yogeshmehta1645 भाई जज ने कुछ नहीं सुना सीधे जजमेंट मेरे खिलाफ सुनाकर मुझे जमानत भी न दिया और जेल मे 14 दिन तक धकेल दिया और मै जेल मे रहकर अपील सेशन गए तो वहा भी सेशन जज ने जमानत और केस चलाने नहीं दिया कहा की छुट्टी पर हु .. कारण सामने वाले फरियादी के दबंग वकील जो भुज बार एसोसिएशन के महामंत्री थे इसलिए सेशन जज लोअर जज और प्रिंसिपल जज मिलकर बड़ा गेम रचा था की अपील के ग्राउंड दिए है 1. पार्टनर फर्म को कंपनी को न पार्टी बनाया और न कोइ नोटिस भेजा . 2. तीस दिन के बाद नोटिस भेजा 3. अड्रेस अलग थे लीगल नोटिस और कोर्ट शिकायत मे 4. सुप्रीम कोर्ट और गुजरात हाईकोर्ट के मुख्य प्रमुख जजमेंट रखे फिर कुछ नहीं ध्यान दिए जज ने खूब करके अन्याय से भरा न्याय दिये है , वर्ष :2018 के समय हमें दिमाग़ खराब कर दिये थे अब हिम्मत से जागा हु तो अब मुझे केस को रीओपन करना है और जज के खिलाफ शिकायत करनी है तो आप मार्गदर्शक गाइड दीजियेगा .🙏

Even if the Bank account is dormant or closed, the person who issues the cheque from the said account and the cheque bounces, person is responsible for it and a case under section 138 of Negotiable Act can be filed against him by giving prior notice for payment of cheque amount.
