The Supreme Court on February 29 (Thursday) held that an application seeking amendment of plaint shouldn't be allowed under Order 6 Rule 17 of CPC if the amendment alters the nature of the suit.
सुप्रीम कोर्ट ने 29 फरवरी (गुरुवार) को कहा कि यदि संशोधन से मुकदमे की प्रकृति बदल जाती है, तो सीपीसी के आदेश 6 नियम 17 के तहत वाद में संशोधन की मांग करने वाले आवेदन को अनुमति नहीं दी जानी चाहिए।
Order VI, Rule 17 of the Code of Civil Procedure deals with amending pleadings. Pleadings are the statements made by the Plaintiff or the Defendant in their respective claims and responses. An amendment can involve altering, modifying, or deleting something in these statements.
सिविल प्रक्रिया संहिता का आदेश VI, नियम 17 संशोधन अभिवचनों से संबंधित है। अभिवचन वादी या प्रतिवादी द्वारा अपने संबंधित दावों और प्रतिक्रियाओं में दिए गए बयान हैं। संशोधन में इन कथनों में कुछ परिवर्तन करना, संशोधन करना या हटाना शामिल हो सकता है।
Order VI Rule 17 reads as under:
“17. Amendment of pleadings - The Court may at any stage of the proceedings allow either party to alter or amend his pleadings in such manner and on such terms as may be just and all such amendments shall be made as may be necessary for the purpose of determining the real questions in controversy between the parties:
Provided that no application for amendment shall be allowed after the trial has commenced, unless the Court comes to the conclusion that in spite of due diligence, the party could not have raised the matter before the commencement of trial.”
