आदेश 8 नियम 10, भारत के सर्वोच्च न्यायालय का हालिया निर्णय।Civil Procedure Code 1908
Order 8 Rule 10 ,Supreme Court of India recent judgement .
The SC held that “mere failure or neglect of a defendant to file a written statement controverting the pleaded facts in the plaint, in all cases, may not entitle him to a judgment in his favour unless by adducing evidence he proves his case/claim”.
सुप्रीम कोर्ट ने कहा कि "सभी मामलों में, वाद में दिए गए तथ्यों का खंडन करने वाला लिखित बयान दाखिल करने में प्रतिवादी की विफलता या उपेक्षा, उसे अपने पक्ष में निर्णय का हकदार नहीं बना सकती है, जब तक कि सबूत जोड़कर वह अपना मामला/दावा साबित न कर दे"
