The plaintiffs put down a deposit on a boat the defendant was selling. They said they would only buy it if their mechanic checked it out, but he found three holes. They’re suing for a refund on the deposit. The defendant argues that he told the plaintiffs the hull had been damaged and repaired. He said he transported the boat to show it to them and gave them a long tour, so he doesn’t think he owes. He’s countersuing for boat transport, winterization, and depreciation.

Common sense tells you if the hull shows cosmetic patching it's a repair of damage. If this couple has been boating for 30 years - they would know that.

Interesting how so many people seem to have lawyers hovering in the background when they want to try and intimidate another. If the plaintiff didn't want to pay $1000 to have the boat inspected before giving the deposit, he sure wouldn't be paying an attorney for legal advice or action, lol.

Apparently, 16k is waaay below the going price for that boat, that's why the Plaintiff jumped on it. Wouldn't that imply that the price reflects the condition? Isn't it the Plaintiff's fault for underestimating the cost for repairs and not taking it for a inspection BEFORE paying? Plus, the Defendant disclosed all the issues(he didn't hide them), the Plaintiff just had a b0ner for the inexpensive selling price. Fair ruling.

Why would the plantiff be awarded a days pay for his wife missing work for the case? She didn't speak at all! Also to add: I believe the plantiff to be slimy. Glad he lost.

they only gave the 1000 to get the boat and then try to resell it at a profit and when they could not do it fast enough then they wanted the 1000 back . they are not boaters , they are opportunists that failed .

if u dont personally know a friend or relative who is a mechanic to go with you then first learn as much as u can as far as what to look for before u go looking , but to pay a mechanic is a waste of money because he will always say do not buy so he wont be liable .

Your son was the one who allegedly said he was assured nothing was wrong and he didn’t show up to testify. You were test rode the boat for 2 hours and chose to not have it surveyed or being a mechanic. But then you lied as to why you post dated the check. It shows your character whereas the defendant was more than generous.

just more fake people pretending to be rich but got no cash . when they realized they could not come up with the money then they cancelled and they are most likely not boaters but people who thought they could pay a low price for something that they could resell quickly for a few thousand in profit .

yes , they are grifters and not boaters . they thought they could get the boat and then sell it quickly for a profit , but they realized they could not sell it fast enough and then wanted their measly thousand back .

I think the "glass man" grossly overestimated what the repair would be. It would be EASIER to remove everything and flip it, but there's no reason you can't repair even a big hole in the hull. That said, the Plaintiff was obviously trying to make the deal contingent on an inspection without telling the Defendant.

@@perfectlyimperfect9129 It's great, but you don't have space enough to make more than one mess at a time. All four of your dogs would hate it since they like to run around and have space. Even cats don't like it, but I imagine it's because they are surrounded by water. It is a different experience though, and sailing and boating is very enjoyable once you get into it. Best to you! 😊

Obviously if the holes were as big as the patches the boat would have sank. There are probably a lot of gouges and a few small holes chances are the repairs are safe

@@DonziGT230 If the boat sank it would take a ton of money to get it running again not too mention raising it out the water. I bought my 1st boat in high school and I did auto body repair including fiberglass work on my own boat when I hit a rock

I really hope the plaintiff’s wife gets away from him. She looks like an abused woman, I would bet my life on it, and when the defendant calls the plaintiff a bully, you can see the fear in her eyes that that man had been called out. I hope she leaves him.

The defendant played himself. He should've kept the check. It was his but when he went got the boat he accepted the refund. It was as is. He deserved to keep the deposit but he jumped the gun and need to fire his lawyer that probably don't exist. He came up with that dumb move on his own.

The defendant should have tried to cash the check and if it had been cancelled could have sued in court and would have won, it was an AS IS sale and the plaintiff is very lucky the check was returned...

First of all he should be happy that he didn’t pay the other $15,000 owed . I would be so happy that I dodged that bullet I would be happy to let him have the 1000.00. Secondly , Milan is a hypocrite. One minute she tells every litigant that they should’ve had a mechanic look at it , and when one finally does - she tells him he was taking advantage of a good deal . Smh 🤦🏽‍♀️

Nah, it's the way he did it. He acted in bad faith, basically locking up the "good deal" for himself (the deposit took the boat off the market) , whist assuming that he could get his $ back if he backed out. You need to get it inspected FIRST, before the purchase (deposit is part of the purchase). She explains it well at around 12mins.

Always pay for a survey for older boats over 28'. Especially if it's one where people will be sleeping. Carbon monoxide can be an issue. At the very least, the peace of mind will always be worth it.

A survey won't protect you from CO, and there's no logical reason to only recommend surveys to a boat over a certain length.

​@@DonziGT230Do you just feel like arguing with somebody today?Is that it ? You can have any space tested for carbon monoxide , The boat owner can also get detectors just like in a home. I think you should always get anything inspected by a professional before you buy it if it's Used no matter how old it is. It's a proof in fact that things break down over time So I would say if it's twenty eight years or older I would definitely Be concerned.

@DonziGT230 surveys, if done by a certified surveyor, can spot things that can turn into CO risks. And larger boats are more likely to have sleeping quarters. Sleeping quarters with CO issues are obviously a concern. Any decent boat insurance agent or company will make you get a survey on larger vessels as part of their underwriting.

I am confused by this ruling. What happened to "you bought is as is?" So, the defendant keeps the deposit bc the deal was done but the boat isn't sold bc he didn't deposit the check? It's seems like both can't be true.

Milian seems to always be on her best behavior in these "higher end" cases as opposed to others I've talked about ad nauseam. She's much more professional, orderly and speaks with more respect towards the litigants as well. The other cases with black folks her tone and disposition is entirely different.

No way would I ever buy a used boat period. I don't care how great of a brand it is or if the guy says it runs great. I've never owned a boat but I am not stupid. I wouldn't trust anyone I don't know just based on someone saying I promise it works. That doesn't fly with me at all.
