Ballerina Judge Fires at Defense After Daughter of Murder Victim is Called Out For Speaking to Media

Eva Benefield, the daughter of slain father Doug Benefield, was called up to the stand on Thursday morning after she was found talking to the media about the trial when she was allegedly under subpoena. Defense attorney Neil Taylor asked for Benefield to retrieve her phone after he found social media posts of her talking about the trial on TikTok. The judge fired back saying that it was a waste of time, and the state believed it was a violation of privacy.

In September 2020, Ashley Benefield ran to a neighbor's house in Lakewood Ranch, Florida, and stated she had just shot her husband. Douglas Benefield had several gunshot wounds to his leg, arm, and chest area. Ashley Benefield claims she shot him in self-defense after months of alleged abuse. She was arrested and charged with second-degree murder. Ashley Benefield made bail and has been living with family and her daughter since the crime.

I just watched her TikTok and her posts have NOTHING to do with the case. She's doing a "fit check" and mentions the trial is starting; second video mentions how nerve wracking it is to testify on live TV; and finally, she says she finished testifying and then talks about the necklace she's been wearing to court! When you're the survivor of a crime, this is ridiculous! She did NOT mention any testimony, witnesses, the jury or even about the specific crime! This is a defense ploy!

@@roseann5562 the main reason to not speak about it would be to protect identities of important factors in the case, from jury to witnesses, and they decided that not talking about the case AT ALL with anybody is the best way to avoid accidentally or purposefully exposing information that should not be giving to anyone at all. That is mainly to protect witnesses and jury from being intimidated or assaulted/murdered.

It was 100% a fishing expedition and intimidation tactic, any halfway ethical lawyer would have reviewed all her posts before initiating this complete farce. You don't get to make assumptions that then have to be disproven, that's not how the burden of proof works _at all._
