The state has sovereign immunity and therefore cannot be sued unless the state explicitly allows you to, the criminal's insurance (if they even have insurance) will deny coverage because they always deny coverage if the collision occured during the commission of a crime. And your insurance may not cover such incidents if you don't have comprehensive/collision insurance.

I’m in the UK and worked in the NHS as a Secretary. One of the Teams I worked on was Mental Health. One of patients we had referred to my Team was a lady in her 50s who was diagnosed with Lewy-Bodies. The Consultant who went out to visit her at home asked her if she could show him how she got into her car. She hadn’t got a clue and ended up trying to climb into the boot (trunk) of the car. That’s when she was admitted to hospital. She only lived about 12 months after the diagnosis. Our Sister Team had a lady aged 37 years referred to them. She had Young Onset Dementia and died six months later. She left a husband and three young children, one of which was a baby.
