The prosecutor pursuing a murder conviction against Hannah Payne gave a fiery opening statement Wednesday that revealed chilling details from the altercation between her and the man she shot. Bonnie Smith outlined how Payne and Kenneth Herring had a tense argument after she witnessed him leave the scene of a hit-and-run crash. Payne followed Herring and ordered him to return to the scene, which he refused to do. Payne then allegedly fatally shot Herring as he sat in the driver’s seat of his car. Payne is being charged with malice murder, two counts of felony murder, aggravated assault, false imprisonment, and three counts of possession of a firearm during the commission of the crime.

I started learning about it not too long ago and was unsure if I’d watch the trial or not. It seemed like a pretty open snd shut case, she followed when told not to, did what she did and is guilty. But this lawyer has me invested with her opening statement, she is doing a great job of laying out the scene.

I agree. I have had this happen to me once. People need to get a life! This is a senseless crime that could have been avoided if the defendant had a life. All she had to do was LISTEN to the cops and COMPREHEND the cops' instructions! If the cops say do not follow then you do not follow! Simple as that! Cops are the experts on traffic issues and a 911 operator deals with this stuff every day at work so LISTEN to the cops' instructions!

Another case of a coward with a gun. She was told repeatedly to NOT follow him. She had her gun so she felt brave and continued to chase this man. Once she caught up to him, knowing she had a gun, she physically confronted a man that was in distress and shot him. Look at her now…looking like the coward that she is…crying for mercy. I remember a year ago I was home and I happened to be standing by my window and saw this a driver driving a little reckless and stopped almost in the middle of the road. I watched him act erratically and I was concerned for him and other road users cos I thought he was under the influence so I called emergency. Most drivers drove past hurling insults but none bothered to stop and checked; perhaps they thought he was drunk too. Eventually the police came and they tried talking to him calmly but he wasn’t budging so they dragged him out of the vehicle onto the ground, held his hand back to handcuff him and he was screaming and acting really strange. Long and short, it turned out the man was diabetic and was having some sort of episode. The ambulance came and they gave him some insulin and attended to him . They apologised profusely to him for the manhandling. At some point,I was scared they were going to shoot him. I didn’t realise how serious diabetes was until that day. Had this young woman left the issue to the police instead of taking matters into her own hands, the man wouldn’t have died and her life basically ruined.

Or was she acting on concern of medical issue and then got out of control when medical issue turned him violent cause confusion, cause they said "someone he didn't know came up to truck", but he had to have known her from first scene but medical issue could have made him a threat to anyone and clearly he fought if shirt ripped. Seems shock response of picking up phone and saying really need ambulance since Last request hadn't been answered. I agree he shouldn't have been killed but could have been very scary when attacked and clearly she had already some incidents that she got a gun for protection, and maybe trying to get her point across by simplifying "ill shoot" since "drunk" concerns so indicates altered mental status. And reaching for something n fighting with her, could have been self defense, especially with a reachable weapon as proven. As well as attorney admitting unable to verify his prints were or weren't on gun due to unclear testing.

Simply from a legal/trial standpoint, this prosecutor did an excellent job of not only creating a coherent roadmap for the jury (which is actually more difficult than it sounds), she also caught the jury's attention with strategic and inflammatory language. Narcissists like to use their cars as weapons they are also always right. They also never will accept responsibility when they are in the wrong. Even when caught in the middle of a crime in front of eye witnesses. It's always someone else's fault. I learned this fact from my father who was a narcissist. He loved to tail people and drive like a maniac. On the way to my wedding he almost killed me and my mother going 80 miles an hour in a 55 mph zone. Stressed out for no reason. Insane.

My ex used to do this 🫠. If we were in the car and something set him off, he would start driving like a maniac. If it was something external that set him off like traffic or a pedestrian all I could do was grit my teeth and hope for the best. IfI had said or done something that set him off (like existing) he wouldn't stop until I was crying and begging him to please let me out of the car. I look back at it now, a few years older, a lot wiser, in a healthy marriage with someone who respects me and wonder, "Why did I tolerate that?", like the woman I was when I was with him is a stranger and I feel bad for her but it doesn't feel like it was me. I'm a defense attorney in California and the first thing I said when I saw this is that I would have tried to get her a plea deal for a charge of voluntary manslaughter. 20 years. It may not have worked but advising your client to go to trial on a case that has so much evidence and witness testimony stacked up against them is negligent. It's up to the client if they want to proceed to trial but after I would have finished explaining to her that she was absolutely going to prison, she was absolutely going to be convicted, she was absolutely going to do the maximum, I think she'd have probably taken the deal.

If Mr. Herring was about to merge into traffic when she blocked him, the truck would have already been gear before the defendant got there. He had issues starting the truck at the original accident and after driving it in that condition he would have had even more issues restarting it if he had turned it off. She said he just mashed the gas. It makes since that the only reason that the truck wasn't moving was because he had his foot on the break and when Hannah Payne approached him and started fighting with him causing his foot to come off the break causing the truck to moved forward a few feet.

Arming yourself like a cop, does not make you a cop, any more than buying a Big Bird suit would make you Big Bird. One of the main things instilled in police academy is when dealing with someone driving in an apprentice reckless or erratic manner is to investigate whether there may be a medical issue, particularly cardiac or diabetic related. America is full of people with an overinflated sense of aggression and entitlement because they are carrying a gun, without having taken any type of situational or tactical training. This is a prime example. For all this poor man knew he was in the process of being carjacked by a crazy gun wielding woman in the middle of traffic. As utterly avoidable as it is tragic, particularly when she was told specifically not to follow. The fact she then tried to blame him for pulling a trigger on her weapon just adds insult to injury. If you are close enough for someone t reach the trigger of your weapon unless in the process of putting hands on to make an actual arrest, then you are incompetent, reckless, and criminally liable for anything that occurs. Ultimately, two lives are now over, one innocent and the other by incompetence, both completely avoidable.
