From a consistent perspective, allergies are never a legitimate reason to file a lawsuit. Peanut butter is FDA approved for consumption, despite some people being deathly allergic to peanuts. For something to be dangerous, there needs to be evidence that any person who uses a product will experience harm, like lead or asbestos in makeup. Or a majority at least. People have varying concerns and sensitivities to almost everything we eat or use on our skin. The important thing is proper labelling and research.

yeah exactly. and for example, retinol products can cause skin irritation in many people starting out with one. doesn’t mean that it’s not approved for use 🤷🏻‍♀️

Yup. You can literally be allergic to anything. I'm allergic to the sun ffs! I have a friend who's allergic to coconut, so she has to check labels for coconut-derived ingredients on the ingredients, and if a product has them, she just... Doesn't buy them.

that’s right. it’s all in individual consumer choices. as the main comment said, all we really need is clear and consistent labelling so that consumers are aware of what’s in a product.

Agreed! I'd rather take issue with clear ingredient labeling, especially when the same ingredient can have multiple names. There is definitely a balance between consumers having some accountability for checking and companies making it easily available for us to check.

I'm still not comfortable buying any products with talc in it until there are strict regulations in place that require brands to prove their talc is asbestos free. I'd honestly love just more regulation in general of the beauty industry though. There is so much they don't watch and for what they do watch, they have no way of actually enforcing things it seems.

The FDA definitely needs to update their regulations, especially with the rise of “clean” beauty. There is so much misinformation out there. It’s confusing and infuriating as a consumer and as someone who works in advertising.

All reds pretty much make my eyes burn, itch, and swell. That means reds, oranges, pinks, some purples, and warm browns are suspect. I just don’t use them or use them knowing I will react at some point in the day. Not going to sue; my allergies are my allergies not some else’s problem. Providing the ingredient list is accurate! That’s when it’s a problem, undisclosed ingredients.

You might have better luck with products that use carmine instead of red dye. Most brands don't use carmine because it isn't vegan but if that doesn't bother you, you might want to give it a go. I have really sensitive eyes and red dyes make my eyes burn, red, itch, and swell. I found better luck with eyeshadows without the red dye. It doesn't always work for me without the red dye but it never works for me with it!

SAME! The biggest trigger for me were Anastasia palettes. Unfortunately, I had to declutter all of those palettes.

When I first heard about this lawsuit, I thought for sure it was for Morphe adding carmine to their shadows while still calling it vegan. So many indie brands use pressed pigments and are pretty good at putting the warning on their palette packaging.

hi, multichrome addict, here! certain shades can show the full rainbow in certain lights & at certain angles when swatched, but i have not encountered anything that shows the entire rainbow on the eye. you can get close to all colors with the holo shadows, but you have to be in direct sunlight, and super up close to see it at all.

The only shadows that I think are truly unsafe for use in the immediate eye area are glitters. Glitters can really be dangerous so I feel like pressed glitters should definitely have warnings. But other than that, pressed pigments are generally fine for most people other than staining. I hope laws are updated accordingly.

The FDA uses the research provided by the brand itself. There is very little research on its own to verify the info it is given. I did a research paper about carcinogens in food to finish out my degree 3 years ago and was floored at the lack of independent testing actually done by the FDA. So I am not sure hoping the FDA would regulate better is worth it. They just go with the $$ paid to have their product deemed safe.

I wouldn't say I have an issue with Alicia Keys wearing and producing makeup, but I have an observation. Back in 2016, she was very vocal about her no makeup movement. Now in 2022, if she has changed her stance (I don't care either way), then maybe she should be just as vocal. Maybe it should be part of the marketing of the makeup. She could say, hey I like a bold lip now and then. Women would understand. The point is, she has never changed her stance publicly, so it feels like a cash grab.

i literally thought it was an april fools joke when i saw mock ups for her line. like nah she doesn’t even like makeup why would she have a brand? but i was so very wrong lol. it definitely feels like she’s just joining the never ending list of celebrities with boring makeup who also have a brand to suck money out of their fans.

She never said she hated makeup. She never said she would never wear makeup anymore. She merely said she had enough of feeling like she NEEDED makeup to feel good and didn't want to HAVE to wear makeup. She was NEVER anti-makeup. Social media made it into that and ran with it, because it's trendy to hate Alicia Keys.

I am so sick of those red-dye lawsuits. I would love to see medical reports that show anyone got more than mild redness as a bad reaction from these pigments. They're in tons of eyeshadow palettes at this point and we're not seeing mass reports of major injuries. And they're approved for eye use in other countries and somehow there isn't massive issues with injuries.

I think more are mild reactions happens as well and not a lot are super serious. Most people just quit using the product. I watch Risa does makeup and she cannot use most deep red, pink or cranberry colors because her eyes swell up. So she like most people just don’t use the colors we know might break us out. But some people think they can make money so they file a lawsuit.

@@Aimee-Gates same with samantha march. she had issues with the pink and red in the PMG bridgerton palette. i have had irritation (itching), specifically with a few shades in the james charles palette (lol), before i started using eye primers. of course it was mild, but i can see it being an issue for someone.

We can be “sick” of “red eye” lawsuits, but I think I’ll wait to see what the actual facts and evidence actually are instead of making an opinion and judgement based on emotion and feelings.

it's not eye shadow.its pressed pigments that are not fda approved for eyes being used in eyeshadow pallettes. Johnny Ross did a video ranting about Kylie cosmetics doing this with their newest launch,where three of the shades are pressed pigment,and not meant to go on eyes.okay,why ,then,are non fda approved items still going through?if it's not made for eyes,or as makeup at all,why keep putting pressed pigments in makeup?that's the issue

Companies need to stop putting eyeshadows and pigments that are “not for use around the eyes” in an eyeshadow palette. They all do it. And it’s entirely clear that they’re intended for the eyes. Maybe if the big brands get slapped hard enough everyone will stop doing it. And if you want those pressed pigments, great. They should be sold in separate palettes that are not mixed in with actual eyeshadows.

Also, apparently "immediate eye area" actually means inner corner tear duct area, inside the lower and upper waterline (tightline), and eyelashes. Not your eyelids.

On the asbestos issue, it bothers me a little that the source only speaks to skin effects. The main danger with asbestos is inhalation risk. That’s what causes the cancer. Since the make up is being applied to the face and around the nose, there’s a pretty good chance one will inhale some powder during application. Good quality talc should not contain asbestos, but the FDA testing standards have been criticized as being set at a level that would not detect asbestos levels at dangerous levels in talc. I have also seen critiques from other public health experts who are concerned about repeated use of cosmetic powders in general, even if they do not contain talc, believing the inhaled powder over years will impact lung health later in life. (I don’t use setting powder, but you will have to pry my eyeshadow from my cold dead hands.) My problem is that if they target talc to the point cosmetics companies no longer use it, they generally tend to substitute corn starch. I’m allergic to corn products, so that would likely mean I wouldn’t be able to use many cosmetics anymore. I can’t find any foot powder on the market that doesn’t use corn starch because manufacturers don’t want to end up in lawsuits over talc like Johnson & Johnson did.

Jen! You got me curious about the Cup O Noodles thing. I Googled it and I found a press release saying "Cup Noodles changing its name BACK to Cup O Noodles" You are not going crazy, there is no Mandela Effect here, they DID change it (in 1993 they took the "O'" out).

People are so litigious. The pressed pigments lawsuits are kind of ridiculous in my opinion. I guess there might be people who don’t know about eyeshadow and pressed pigments, but the lack of critical thinking used by people is not lost on me these days. If you’re using a red, blue or purple eyeshadow it wouldn’t be surprising to get stains on your skin. But that’s just my opinion.

Talc - my grandmother recently past away within 3 months from Ovarian Cancer .She always used powder all over her body. Cosmetic companies should just put a wrapper so when you are opening it it has a warning along with the actual package…. When it looks like eyeshadow that’s what ppl will use it s as .

Ugh....the lawsuits. I agree that these companies need to make these "not intended for eye use" claims more obvious to customers. As much for their own protection as the consumers. That being said, you can find dozens of youtube videos on practically every palette that contains these pigments and see influencers raving and recommending them. Some mention the eye safety issue, most don't. So should they also be held accountable since they are truly the driving force behind sales these days? I don't necessarily think so but another interesting side of it. I just had the new Gilded Desert palette from Morphe delivered today and I can't wait to use it. These pigments have never bothered me. There's not a face product on the market that doesn't have at least one review of someone complaining about irritation. I don't know. I'm with you...the FDA just needs to get it together and make a decision about these pigments and whatever comes of that will be it. And the Beekman 1802! I have almost the whole line of their products. I didn't buy it for the probiotic claims but again, I agree with the disclosure issue. But I will be very sad if the brand goes away because of this.

The thought of using pressed pigments on the eye doesn't bother me as much as the thought of using those pressed glitters they say is not safe for eye use which is in A LOT of "shadow palettes" these days. With that said, how are customers supposed to use these pressed pigments if not on the eye area? Seems very useless to me to create products that you would only logically use around the eyes and it's not even "safe" to do so. Might as well make regular eye shadows then...

Because a lot of "regular" eyeshadows(reds, pinks, purples, oranges, etc) use carmine (which is crushed beetles) and isn't vegan. It's not that the pigments are any more dangerous than anything else and they are approved in the EU and other (better regulated) Countries. The US FDA is extremely behind the times

What I took away from the "Not So Pretty" episode was that the standard of cosmetic testing for talc only magnifies up to 400x while asbestos is not detectable until approximately 1000x magnification. This generates an immense amount of false negative tests since the standard of testing is not even able to detect the asbestos that is/could be present. Also, there was an interview in the episode where the interviewee stated that Talc & asbestos grow/are formed together and that there is no way to effectively separate the two. So, where you have talc, you will have asbestos. The big concern with asbestos is inhalation and we typically think of eyeshadows as not being inhaled but, how many times have you knocked off excess shadow from your brush before applying it to your eyes? That powder is now in the air. Same with brushing away fallout or using setting powder and it is all done literally right in front of your nose. As for the J&J lawsuit, in the documentary it talked about how J&J has set up a separate company that basically assumes all liability for the talc related lawsuits but that company is bankrupt and has no way to pay out on any judgments so all of the lawsuits, even though they have been won and J&J has been PROVEN to knowingly sell asbestos contaminated powder, J&J loses absolutely zero money and peoples lives that have been ruined receive no compensation for the company's greed. I thought the series was incredibly well presented and it has definitely made me rethink my use of makeup and the ingredients I'm willing to use.

i ever so vaguely recall way back in the early days of beauty youtube (2009 maybe) hearing someone say that there aren't really red eyeshadows because what makes them red isn't safe for the eyes. and i think someone in a Mac store also mentioned something like that to me.

Johnny Ross did a rant video about Kylie cosmetics pushing yet another ugly,bland eyeshadow pallette with 3 pressed pigments.pressed pigments are not intended for eyes.so,why is it in eyeshadow compacts,then?if it's not fda approved,how are people obtaining and using it? that's the issue.not the colors themselves,the ingredients,it may be a pressed pigment not meant for eyes,fda did not approve it.

Another independent brand who had a small drop is Lisa Eldridge, she released a new shade of the Elevated Glow Highlighter, called Pink Moon. And I think she will release soon a range of pigmented lipsticks for summer, in the insanely saturated formula, I am very excited about that. :)

Agreed! Any ingredient that is not approved or is known to be harmful to a certain area of the body shouldn’t be put into products that are designed for use in that area.

I’m so glad you addressed the Talc thing. I’m seeing some people on TikTok freaking out about it. I haven’t watched the docuseries, but I listened to The Eco Well podcast, and they had several scientists (including Michelle - LabMuffin) weigh in on it. I highly recommend a listen, if you get a chance.

“Cup Noodles” was called “Cup O’ Noodles” from 1971 (their launch year and my birth year) until 1993. I still call them their “dead name” out of habit. I’m an industrial hygienist. Definitely asbestos is bad because of it being a carcinogen. We also air sample for talc (not containing asbestos) as well. It has an exposure limit of 2 mg/m3 TWA for an 8 hour work shift. In short, I limit my exposure to talc of any kind. Back to Morphe and their sister brands…. (Including REM and Jaclyn)…. Not for me. Ethics. Love from the spooky Pine Barrens in NJ

Man, I used to be really into makeup and had a nice little collection. But life happened and my opinion shifted. I got rid of all of it and went 100% makeup free for about 5 years. Well, here we are now, and my love is back in full swing, if not more since my discovery of indie brands and the financial stability of my 30s lol! People are allowed to change. Alicia Keys' products don't interest me but I wish her the best. Also, I love pressed pigments so much. I truly hope they don't get banned or something.

omg same! i have a similar story, except that my opinion of makeup never changed, i just didn’t wear it for years because…life. i have been so happy since i have been back into it. to me, it represents having found myself again. and i hope they don’t get rid of pressed pigments, too.

@@mus1quenonst0p it represents the same to me too! I went through a big change at the time and just blocked out all unnecessary stuff and kinda got tunnel vision to build my life back. But then, in another change, came back to myself and realized that I am not unnecessary and the things I enjoy aren't either. So I embraced it, and even got back into painting and stuff. Man, I haven't thought about that in a while. Life is a journey!

I personally never agreed with the Johnson and Johnson lawsuit. Because I think it's bs. And that lawsuit and the McDonald's one created a very slippery slope that society went down full bore. I mean honestly I would never think of putting baby powder in my vaginal area, that area on a woman is vastly different than a baby. Like ever. Not to mention when you used baby powder on a baby, it was only supposed to be lightly on the area, not so much that it would get into the vagina.... And I will never trust any of the 3 letter agencies in the government. They've pretty much shown they are useless in what the purpose was for creating them.. And yes Alicia along with everyone else should be able to wear makeup or not, change their view or not. But as is typical of social media, this behavior doesn't surprise me...

I think that cosmetic labs should be checked over routinely because if makeup is coming out of a dirty lab then the makeup is going to be contaminated... And the FDA should update their info

I watched the Not So Pretty documentary. They said that ALL talc cosmetics contain asbestos which I completely disagree with. I remember your reporting on the FDA report showing no asbestos in random samples. At the end of all four episodes in this documentary series, references were made to "clean" beauty organizations for viewers to get more information...very sad.

I only made it through two episodes. The amount of misinformation was infuriating, along with the so-called experts. I was waiting for EWG mention and there it was at the end of each episode.

@@blythea35 The episode on nails was actually good. It talked about the prolonged inhalation of toxic fumes by nail salon technicians. I agree that is a problem, but you're right...the second I saw EWG listed as a resource, I was immediately turned off.

I NEVER had issues with morphe or pressed pigments until I bought 3 NEW palletes then because I didn’t use them super often at first I didn’t realize that it was causing my eyes to itch. I assume it was the perfume bar at work or someone’s detergent. Then as I used them more I began to have very itchy eyes and even styes. It’s quite literally insane! I want my goddamn money back! I’ve always loved morphe and this shit is insane

Hello. First of all, all the eyeshadows are mixed and pressed. JC didn’t explain the difference is one is not safe for the eye use ( pressed pigment ).

Why I am not surprised? I bought a Morphe eyeshadow about 2 years ago. The most horrible powdery formula literally sucked the life out of delicate eyelids not too mention the fallouts under my eyes. Needless to say that was my first and last interaction with Morphe's cosmetic line. Nowadays I stick to brands like CT expensive but enjoyable 🤔

Alesha was talking about feeling as though you have to wear makeup. Many people either can't wear makeup or don't want to wear makeup all the time and there is a lot of stigma around women's looks. The expectation is for women and girls to not to leave the house unless they are "presentable" and it impacts our work, education, and self-worth. She wanted to feel beautiful without makeup and exist without makeup. Makeup should be viewed as optional and women's bodies shouldn't be critiqued by everyone. We shouldn't be brainwashed into thinking that we need to spend hundreds of dollars a year or more just to make our faces "presentable" enough to go outside. (If you want to wear makeup that's great and that has nothing to do with my point.)

the refy powder is super interesting, when I apply it with a (dry) brush it feels like the brush is wet! It's super nice for my dry skin and lasts well throughout the day - would def recommend.

Oh, no way! I went to school with Ang "AK"! And yes, it definitely used to be Cup 'o Noodles. There is a similar reduction in the UK called Pot Noodle, so maybe that's the connect.

Regarding the Refy powder, didn’t Revlon have a similar product many, many years ago? It felt cooling on the skin. It was so strange, but I remember it being a really good powder lol

It was Cup O' Noodles at the beginning, and they changed it waaaaay back in the 60's, but everyone still calls it that! I'm 39 and I've always called it Cup-a-noodles. 😄

That "water" powder isnt the first one. I forget which line had one years ago...but it felt actually wet applying it. Gosh, I wish I remembered the line. But it was pretty cool.

I tried the Becca one which was pretty awesome, especially to set concealer. I think L’Oréal had one too but I never got to try it before it discontinued

This goes way back to the beginning of beauty products. They have harmed skin in many ways or stained skin even with natural ingredients which also isn’t always safe for all.

I raised an eyebrow to the Alicia Keys cosmetics personally. I suspect they'll be the more natural lightweight, natural, minimal coverage products.

I live in an EU country. I just read in our news that soon more than 3000 different 'chemicals' (sorry english is not my first language) used in cosmetics and body care will be baned. Including all coloured inks for tattoos (only blue and black will be allowed, if I'm not mistaken). I think it will come in force next year. So, I guess, those pigments are really not safe.

I know I’m in the minority, but I have had an allergic reaction to pressed pigments in the past so I just stay away from them. As long as I can tell which is pressed pigments and which is eyeshadows I’ll be fine.

The FDA does need some kind of expansion or social media presence to actually clarify and give examples on issues like contaminated talc vs talc, etc., I’m not personally talc free but I absolutely refuse to use pressed glitter eyeshadow or glitter pigments on or near my eyes... that’s my biggest issue. For Alicia, I wish she could be equally as vocal about makeup in a positive and healthy way as she was about not wearing makeup and basically being the “Not like other girls” towards beauty products, I get the whole people change thing and I’m sure we all love character development here lol, but I would like to hear her actually speaking about her own journey first with self image or more actively through the brand because it seems really hypocritical right now. That’s the biggest thing for me getting on board with a makeup brand by her. Especially, with how saturated the cosmetic industry is by celebrities now... IMO it really comes across as one of the BIGGEST cash grabs of all the celebrity makeup brands so far. And it sucks because I really appreciate her and I love her music but the messaging here feels uneven. 🤔

Asbestos naturally occurs and forms on talc. So it is a gamble when you use it. 20 year latent period before causing things like Mesothelioma: malignant lung cancer. It is impossible for the makeup companies to test all of their talc products before shipping. Maybe if they could somehow streamline constant consistent testing in the lab where the makeup is getting put together- or factory- even just the talc before it goes into their formulas- before pan- maybe things could be cleaner and safer. It is a gamble with all talc product's. I never had a problem with talc until my last bottle of J&J baby powder- it was irritating my lungs and lasting 45 mins after use. That caused me to become more aware and I am seeking a talc free makeup collection eventually. Definitely got some corn starch or rice starch baby powder now, great smell and formula- here in Japan. i am impressed and it is safer since it goes airborn. What someome can do is - don't use brushes to apply eyeshadow, use a finger or an applicator. Switch to talc free bronzers-blushes (liquids with talc are fine). Get away from the talc baby powder- let's save the babies lungs too! Setting powders/finishing powders, foundations- apply with a beauty blender or switch all powders to talc free. Isn't bare minerals talc free? I still do not know, but that is a great selling point for them if so.

Not a big fan of colourpop, but man I’m finally excited for one of their palettes. I’m in my mid 30’s and I grew up loving Star Wars. This was during a time when it was not cool to like star wars. I love the original 3, and would ALWAYS get made fun. Even my own sister would make fun of me, but now that it’s socially acceptable guess who is their “biggest fan.” Don’t really love the color story, but my inner child who had a crush on Luke is forcing me to get the palette. It’s fine though cause star wars is now cool

I love Star Wars too! I just got the Star Wars Colourpop Palette! I have the Grogu & Mandalorian palettes but this recent Star Wars is my favorite so far. definitely try it! The colors swatched in real life look so awesome. It’s such an amazing palette! Hope you enjoy!

My favorite face powder is the Becca Hydromist powder. It literally makes your face feel wet when you put it on and it is awesome to set your undereyes with if you have dry undereyes. Rest in peace Becca.

I'm not surprised they are being sued as they are very similar to an notorious 5 dollar eyeshadow palettes. Usually I'm not a complainer, but it really blows, especially when we're laying down our hard earned dollars for such an inferior product.

I agree with you about Alicia Keys. Look at Bobbi Brown whose original line had no sparkle. Gradually sparkle became a part of the brand and her new brand has plenty of sparkle.
